A RESOLUTION OF THE CITY OF DANIA BEACH
FLORIDA, APPROVING THE SITE PLAN REQUEST
SUBMITTED BY THE LAW FIRM OF GUNSTER YOAKLEY,
REPRESENTING DANIA DISTRIBUTION CENTRE, LTD.,
FOR PROPERTY LOCATED ON THE SOUTH SIDE OF
DANIA BEACH BLVD., BETWEEN SW 12T" AVENUE
(EXTENDED) AND THE C-10 CANAL, DANIA BEACH;
PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the
City of Dania Beach, Florida, states that a site plan is required as a condition to the
issuance of a building permit; and
WHEREAS, Gunster Yaokley, Attorneys at Law representing Dania Distribution
Centre Ltd., has applied for site plan approval for the proposed construction of a 220,000
square foot Industrial/Office/Distribution Complex to be located on vacant property located
on the south side of Dania Beach Boulevard between SW 12th Avenue (extended) and the
C-10 canal, Dania Beach; and
WHEREAS, the Planning &Zoning Board on August 21, 2002, recommended that
the City Commission grant the site plan request (SP-31-02), based upon the criteria set
forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania
Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
SP-31-02 1 RESOLUTION NO. 2002 -205
Section 1. That that certain application (SP-31-02) for site plan approval, a copy of
which is attached and made a part of this Resolution as Exhibit"A", is approved subject to
the following conditions:
1) a) Oak trees (inside wall)to be staggered as shown on the original landscape plan.
b) Mahogany trees (outside wall) shall be setback at least 5—7 feet from the wall.
c) Coco plum hedge to be installed on the outside of the wall.
d) Retention area to be prohibited in the north lot line buffer.
e) Landscaping and irrigation within Dania Beach Boulevard right-of-way to be
provided in accordance with requirements of the Public Works/Utilities
Director.
f) Screen wall may be concrete block, tilt wall, or poured wall construction
(horizontal slat wall prohibited).
g) Applicant to provide a detailed cross-section of east lot line buffer, including
placement of trees along slope of retention area. Retention slope not to exceed
4:1.
h) Additional landscaping (including irrigation)within SW 121h Avenue right-of-way to
be provided in accordance with requirements of the Public Works/Utilities
Director.
2) No changes from the approved site plan concerning the location or type of retention
facilities, landscaping, or screen wall without the prior approval of the Growth
Management Director.
It is further noted that the original Site Plan is maintained in the office of the Growth
Management Department of the City of Dania Beach.
Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of
Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals
shall automatically expire and become null and void unless building permits are obtained
on or before 18 months from the date of this resolution.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.

Section 4. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

Centre, Ltd., concerning vacant property bound by Dania Beach Boulevard
on the north, SW 12th Avenue (extended) on the east, the C-10 Canal on
the west, and the Stirling-Levy Commerce Park on the south.
VA-30-02 — Variance Request:
1. Variance to provide 19% pervious area (30% required).
2. Variance to allow a generalized landscape variance
from Chapter 26 (Vegetation) of the City Code.
• SP-31-02 - Site Plan Approval request to construct a 220,000
square foot Industrial/Office/Distribution Complex
DATE: November 26, 2002
The applicant proposes a new 220,000 square foot Industrial/Office/Distribution
Complex directly behind the Stirling Commerce Park. The property is zoned I-G
Industrial General. Access will be via a 25 foot easement that runs along the south lot
line and SW 12th Avenue.
No access to Dania Beach Boulevard is proposed and there are no plans to extend SW
12 Avenue to Dania Beach Boulevard. Both the Fire Marshall and Public Works/Utilities
Director have determined that adequate access has been provided (see attached letters
dated August 26, 2002 and September 17, 2002).
The site plan meets or exceeds parking, setback, loading, building height, and lot
coverage requirements. Variances have been requested for landscaping and pervious
area.
NORTH LOT LINE ADJACENT TO DANIA BEACH BOULEVARD
The applicant has provided a 17 foot wide buffer along the north lot line. The metal
picket fence has been replaced with an 8 foot wall.
The plan indicates a double row of live oak trees inside the wall and a single row of
40 mahogany trees located outside the wail. Staff recommends following:
a) Oak trees (inside wall) to be staggered as shown on the original landscape plan.
b) Mahogany trees (outside wall) shall be setback at least 5 — 7 feet from the wall.
c) Coco plum hedge to be installed on the outside of the wall.
d) Retention area to be prohibited in the north lot line buffer.

ARCHITECTURE
The applicant has revised the architecture along the north lot line to add more detail,

building and adjacent to Dania Beach Boulevard), screen wall, and revised architecture
and color are consistent with what is provided in the rear yard of the Dania Boulevard
Publix.
RECOMMENDATION
