A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,APPROVING
THE APPLICATION BY NEIL ZUCKER, OWNER OF THE HARBOR GRILLE
LOCATED AT 815 NE 3RD STREET, DANIA BEACH; FOR AN EXTENDED
HOURS LICENSE; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, Section 4-18.1 of Ordinance No. 102-98 provides that any place of
business operating as a restaurant or restaurant bar in the City which is duly and regularly
licensed by this State to prepare, sell and serve full course meals to the public, if it is also a
place of business which sells and dispenses alcoholic beverages, and is duly and regularly
licensed by this state to sell and dispense alcoholic beverages, wine or beer therein, may
apply for an extended hours license, and
WHEREAS, the Planning &Zoning Advisory Board has recommended that the City
Commission approve the application for an extended hours license for the Harbor Grille
(EA-63-02) at its October 30, 2002 regular meeting.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application for an extended hours license (Daily until
4:00 a.m.) submitted by Neil Zucker, owner of the Harbor Grille located at 815 NE 3rd
Street, Dania Beach, a copy of which is attached hereto and made a part hereof as Exhibit
"A" be and the same is hereby approved pursuant Chapter 4, Alcoholic Beverages,Article
II Operation Regulations, Section 4-18 Hours of Sale, subject to the following conditions:
• 1) The license must be reviewed by staff every year before renewal.

2) Traffic controlling devices will be placed to force the traffic down to Dania Beach
Boulevard. .
It is also noted that the appropriate City officials are hereby directed to execute same.
Section 2 . That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

Prior to completing the application for the extended hours license, the applicant is encouraged to become

I do not plan on posting hours of operation until 4:00am nor operating until 4:00am under
regular business operations. My request for permit is only to cover special weekend and
holiday events. In every case I intend to utilize Broward County Sheriff detail officers for
crowd and parking control. I have also consulted with a sound engineer to determine
speaker placement to insure sound levels do not disturb the local community.
Attached please find a copy documenting my enrollment with the Responsible Vendors
Program.

DATE: November 12, 2002
The Harbor Grill has requested an extended hour's license (4:00 am; 5:00 am on New
Years Day. The Harbor Grill is an existing restaurant/bar/nightclub (with full liquor bar)
occupying the former Tugboat Annie's.
Consideration of the extended hour's license relates more to public safety than planning
and zoning. BSO comments are attached (See page 2 of BSO memo).
At the request of the commission, staff notified property owners within 300 feet
(approx. 30 persons) of the extended hour's license application.

Harbor Grille 815 NE 3 St.
. I have met with the owner of this business to discuss concerns over loud music. since our
meeting measure's have been taken to reduce the noise level. Noise buffers have been
installed and the area around the stage has been closed in, speakers have been adjusted to
point away from buildings and other obstacles that sound could bounce off of and
become a nuisance to surroundings residents.
There is a B.S.O. off duty detail on the weekends and additional deputies are hired
For special events.
I also conducted a computer inquiry for police service calls at this business.
This inquiry was from 01/01/2001 thru 10/27/2002.
I find no illegal activities within the last year. See Attached Form.

Our department is processing an application for an extended hour's license for the
above referenced location. Section 4-18.1 (c)(2) of the City of Dania Beach Code of
Ordinances requires that a check be performed of any law enforcement activities
generated by the operation of the restaurant/bar, both outside and inside the location.
We are particularly interested in activities concerning vandalism, noise, vehicular use by
patrons and illegal activity of any kind by employees, patrons or others associated with
the establishment within the last year.
I would like to receive this information as soon as possible, so that we may complete
our review of the request and schedule it for the next available Planning and Zoning
Advisory Board and City Commission meetings.

THE FOLLOWING IS A COURTESY NOTICE given that a hearing will be held before the City
Commission on Tuesday, November 26, 2002 at 7:00 p.m., or as soon thereafter as possible, in
the City Commission Room, Administrative Center, 100 West Dania Beach Blvd., Dania Beach,
Florida 33004, for the purpose of hearing any comments which might be made to the following
request:
Request by Harbor Grill for Extended Hours Liquor License (Property located at 815 NE 3rd
Street). The City Code currently allows the Harbor Grill Restaurant to stay open until 3:00
am. The Extended Hour's License, if approved by the City Commission, would allow the
Harbor Grill to stay open until 4:00 am (5:00 am New Years Day).
For information about the proposed extended hour's liquor license, contact the City's Growth
Management Department, 100 West Dania Beach Blvd:, Dania Beach, Florida, (954) 924-3645
between the hours of 8:00 a.m. and 4:00 p.m., Monday - Friday. Interested parties may appear
at the public hearing and be heard with respect to the public hearing.
In accordance with the Americans With Disabilities Act, persons needing assistance to participate
any of these proceedings should contact Charlene Johnson, City Clerk, 100 W. Dania Beach
Mr,vd, Dania Beach, FL 33004, and (954) 924-3622, at least 48 hours prior to meeting.
Any person who decides to appeal any decision made by the Planning and Zoning Advisory
