Home My WebLink AboutO-2001-016 ORDINANCE NO. 2001-016 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA AMENDING THE CITY CHARTER, PART II, ENTITLED "LEGISLATIVE BRANCH AND LEGISLATION", ARTICLE 7, ENTITLED "MEETINGS OF THE COMMISSION", SECTION 3, ENTITLED "REGULAR MEETINGS" TO PROVIDE THAT THE CITY COMMISSION MAY MEET REGULARY AT SUCH TIMES AS MAY BE SPECIFIED BY RESOLUTION RATHER THAN BY ORDINANCE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERANCE; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City Charter, Part II, entitled "Legislative Branch and Legislation", Article 7, entitled "Meetings of the Commission", Section 3, entitled "Regular meetings" is amended to read as follows: Sec. 3. Regular meetings. The City Commission shall meet regularly at such times as may be specified by erdina„r--e-resolution, except that it shall meet regularly not less than twice each month. Section 2. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict with this ordinance are repealed to the extent of such conflict. Section 3. If any section, clause, sentence or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this ordinance. Section 4. ANSBRO CITY ATTORNEY -2- ORDINANCE NO. 2001-016 CITY OF DANIA BEACH MEMORANDUM TO: Charlene Johnson, Deputy City Clerk CC: Jason Nunemaker, Acting City Manager FROM: Thomas Ansbro, City Attorney DATE: May 3, 2001 RE: Ordinance Amendment (of Charter) to Allow for Establishment of City Commission Meeting Times by Resolution Attached is a copy of an amending ordinance (amending a section of the Charter) which will comport with direction given by the City Commission at its April 24, 2001 meeting. Although this pertains to a section of the charter, this type of charter provision is amendable by ordinance (rather than by "referendum") under applicable state law. Additionally, this will give the Commission the flexibility in the future to change the times of meetings as it may see fit. When the ordinance is adopted on second reading, and immediately thereafter, adoption of a resolution setting the new regular time at 7:00 p.m. can be introduced (I will prepare it unless you can do it - please advise) This is now ready for City Commission action.
