Home My WebLink AboutO-2001-035 ORDINANCE NO. 2001-035 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, UPDATING THE CITY CODE OF ORDINANCES AND CHARTER TO CONFORM TO CURRENT PRACTICES AND PROCEDURES OBSERVED BY THE CITY; REPLACING THE TERM "CITY CLERK- AUDITOR" WITH THE TERM "CITY CLERK" THROUGHOUT THE CHARTER AND CODE; AMENDING CHAPTER 2 OF THE CITY CODE OF ORDINANCES, WHICH CHAPTER IS ENTITLED "ADMINISTRATION" BY AMENDING ARTICLE VII, ENTITLED "ADMINISTRATIVE SERVICES DEPARTMENT" TO CLARIFY THE DUTIES OF THE ADMINISTRATIVE SERVICES DIRECTOR; CREATING ARTICLE VIII OF CHAPTER 2 TO BE ENTITLED "CITY CLERK", PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERANCE; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City Code of Ordinances and Charter are each amended by replacing the term "City Clerk — Auditor" wherever it appears within the Code of Ordinances and Charter with the term "City Clerk". Section 2. That Article VII entitled "Administrative Services Department" of Chapter 2 of the Code of Ordinances of the City of Dania Beach, which Chapter is entitled "Administration" is amended to read as follows: ARTICLE VII. ADMINISTRATION Sec. 2-123. Creation of department. The department of administrative services is established as an administrative branch of the City of Dania Beach and shall be comprised of the following divisions: Gi+� risk management and human resources management. Sec. 2-124. Appointment of director. There shall be an administrative services director, who shall be appointed by and who shall work under the direction and supervision of the city manager. Duties. Article VIII, to be entitled "City Clerk" (of Chapter 2 of the Code of Ordinances of the City of Dania Beach, which Chapter is entitled "Administration") is created to read as follows: ARTICLE VIII. CITY CLERK Sec. 2-126. Creation of department The department of City Clerk is established. Sec. 2-127. Appointment of City Clerk There shall be a city clerk, who shall be appointed by and who shall work under the direction and supervision of the city manager. The city clerk shall work at the pleasure of the city manager at a salary established by the city manager. Sec. 2-128. Duties The city clerk shall be responsible for performing or for providing, as appropriate, the following services: (a) The signing of all written contracts made on behalf of the city in conjunction with the signing by other city officials. No written contract made on behalf of the city or to which the city is a party shall be valid unless signed by the city clerk or designee. (b) The countersigning of all bonds, revenue certificates or other indebtedness of the city and the keeping of accurate accounts of them, and the keeping of records showing for what purpose such evidence of indebtedness was issued, to whom and the amount of the same. (c) Administration of any oath required by law. (d) Acting as, or providing the services of, a recording secretary to and for the city commission. (e) Administration of all city elections. (f) Acting as the official representative of the City of Dania Beach in all business with the supervisor of elections of Broward County, Florida in relation to matters pertaining to the conduct of municipal elections. (g) Acting as the city's qualifying 'agent for candidates qualifying for municipal office. (h) Attending or providing for attendance at all meetings of the city commission to ensure that the minutes of its proceedings are kept, as well as assuming responsibility for keeping of advisory board minutes, the correctness of which proceedings shall be F:/566001:/0rdinances:/City Clerk 3 ORDINANCE NO. 2001-035 certified by his or her signature or that of his or her designee. The official minutes of the city commission or board, as appropriate, when duly certified by the signature of the city • clerk or designee, and by the mayor-commissioner, or acting mayor-commissioner, or board chairperson, as appropriate, shall be prima facie evidence of the facts and events stated in them. The city clerk shall be responsible for the keeping of all of the ordinances and resolutions adopted by the city commission. (i) Acting as the official custodian of the seal of the city and of all records and papers of a general character pertaining to the affairs of the municipality. Whenever an official seal is required on any official document of the City of Dania Beach, it shall be affixed by the city clerk or designee. 0) Performing any and all duties required by the ordinances of the City of Dania Beach, or any duties applicable and proper to be performed, as assigned by the city manager. Section 4. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict with this ordinance are repealed to the extent of such conflict. Section 5. That if any section, clause, sentence or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this ordinance. • Section 6.
