RESOLUTION NO. 2006-199 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA APPROVING THE VARIANCE REQUEST SUBMITTED BY BOAZ COHEN, FROM CHAPTER 28,"ZONING",ARTICLE 28,"SIGNS",FOR PROPERTY LOCATED AT 1410-1420 SOUTH FEDERAL HIGHWAY, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 28, "Signs", prescribes the signage regulations for businesses within the City of Dania Beach; and WHEREAS, property owner Boaz Cohen is requesting a variance for the installation of a monument sign located at 1410-1420 South Federal Highway and has applied for a variance(VA-62- 06) from Chapter 28, "Zoning", Article 28, "Signs", to allow the installation of a 45 square foot monument sign, (a maximum of 36 square feet is otherwise permitted), measuring 12 feet high (a maximum height of 7 feet is otherwise permitted) and a setback 2 '/2 feet from the street lot line (a minimum of 5 feet is otherwise requested); and WHEREAS,the Planning&Zoning Board on October 18,2006,recommended approval of the variance request with conditions, based upon the criteria set forth in Chapter 28, "Zoning", Article 28, "Signs", Section 28.200 of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-62-06, from requirements in Chapter 28, "Zoning", Article 28, "Signs", of the City Code of Ordinances is approved with the following conditions: l. The applicant must submit a revised site plan providing for parking improvements, specifically new landscaping. 2. The sign should be 8 '/2 feet high. 3. Applicant to provide a dumpster enclosure which should always remain in the rear of the building. 0 Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3. Most of the Plazas on the Federal Hwy, buildings are facing Federal Hwy and that's why our plaza is not visible and requires big Plaza directory. We need to install a Plaza's Directory 12'x6' which exceeds the current size approved by city and needs Variance application or approval. Plaza's Directory(Size 12'x6') is necessary so plaza presence should be visible from Federal Hwy. VARIANCES: 1. 45 square feet sign face (Maximum 36 sq. ft. allowed). 2. 2.5 feet street setback (Minimum 5.0 feet required). 3. 12 foot height (Maximum 7.0 feet allowed). • The applicant wishes to install the monument sign to improve the identification of businesses located in the shopping center. The applicant has not demonstrated a hardship (each business fronts on US 1). PLANNING AND ZONING BOARD RECOMMENDATION: On October 18, 2006 the Planning and Zoning board recommended approval subject to the following conditions. 1. The applicant must submit a revised site plan providing for parking improvements, specifically new landscaping. 2. Provide a dumpster enclosure. 3. All improvements shall be installed prior to sign permit approval. STAFF RECOMMENDATION: Subsequent to Planning and Zoning Board meeting, the applicant has relocated the small dumpster to the rear of the building and installed the landscaping in the front yard.
