A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA APPROVING
THE VARIANCE REQUEST SUBMITTED BY SAM ENGEL&ASSOCIATES,
REPRESENTING REVEREND TIMOTHY T. SHELLMAN,SENIOR PASTOR OF
SAINT RUTH MISSIONARY BAPTIST CHURCH, FROM CHAPTER 28,
"ZONING", ARTICLE 4, "SCHEDULE OF LOT, YARD AND BULK
REGULATIONS", FOR PROPERTY LOCATED AT 145 NW 5TH AVENUE,
DANIA BEACH;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 4,
"Schedule of lot,yard and bulk regulations",prescribes the setback requirements for buildings within
the RD-8000 zoning district in the City of Dania Beach; and
WHEREAS, Reverend Timothy T. Shellman, Senior Pastor representing Saint Ruth
Missionary Baptist Church,is requesting a variance for the installation of an entrance canopy located
at 145 NW 5tt, Avenue and has applied for a variance (VA-72-06) from Chapter 28, "Zoning",
Article 4, "Schedule of lot, yard and bulk regulations", from the required setback requirements to
allow a minimum of a 5.5 foot front yard setback (a minimum of a 25 foot front yard setback is
required); and
WHEREAS,the Planning&Zoning Board on November 15,2006,recommended approval
of the variance request, based upon the criteria set forth in Chapter 28, "Zoning", Article 4,
"Schedule of lot,yard and bulk regulations",of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-72-06, from requirements in Chapter 28,
"Zoning",Article 4,"Schedule of lot,yard and bulk regulations", of the City Code of Ordinances is
approved.
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

Variance for front setback to allow the addition of a permanent entrance canopy
to replace a vinyl canopy destroyed by Hurricane Wilma
CRITERIA FOR VARIANCE:
a) The original Church was constructed in 1957. We have no knowledge of the
required setbacks at that time;
b) We now have to provide access for the disabled thru the main entrance of the facility;
c) Other buildings in this zoning district will be governed by the same provisions of the
Law;
d) It is necessary to have protection over the entrance as getting disabled patrons thru
the doors takes considerably more time than a non-disabled person;
e) The entrance canopy is only large enough to protect the landing leading to the
entrance canopy.
f) The granting of this Variance is in harmony with other similar uses in this zoning
district and will not be a detriment to public welfare.

Dear Commissioners:
This office is presently designing interior renovations to the captioned Church.
Part of our work will be to bring the entrances and exits to comply with A.D.A.
requirements, and in order to provide adequate coverage of the main entrance
we will have to encroach further into the front setback. The closest portion of
the existing building is presently 9' from the front property line. The support
column for the proposed canopy would set back 5'-6". The line of sight would
not change as the support column would only be approximately 8" in diameter.
We would appreciate your consideration in approving this Variance.

VARIANCE
The applicant is requesting a variance to allow the construction of an entrance
addition to be made to the east side of the existing church building, facing NW 5
Avenue. The current building is an existing non-conforming building, provided
only a 9' setback. The new entrance will consist of an open air, covered
entrance. The new roof will be 5.5' from the east property at its nearest point.
The existing building is 9' from the east property. .
PLANNING AND ZONING BOARD RECOMMENDATION
On November 15, 2006 the Planning and Zoning Board recommended approval
of the proposed variance.
