A RESOLUTION OF THE CITY OF DANIA BEACH,APPROVING THE VARIANCE
REQUEST SUBMITTED BY LARRY W. MACKEY, FROM CHAPTER 28,
ARTICLE 4 DISTRICT REGULATIONS, SCHEDULE OF LOT,YARD AND BULK
REGULATIONS; ARTICLE 29 - PERVIOUS AND IMPERVIOUS AREAS AND
ARTICLE 5.31 SUPPLEMENTARY LOT REGULATIONS IN AN RS-6000
DISTRICT, FOR PROPERTY LOCATED AT 814 ARGONAUT ISLE, DANIA
BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28,Article 4, sets the Lot Yard
and Bulk requirements in the City of Dania Beach; and
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, Article 5.31, sets the
supplementary lot regulations within an RS-6000 zoning district,within the City of Dania Beach; and
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28,Article 29, sets the Pervious
and Impervious area requirements in the City of Dania Beach; and
WHEREAS, Larry W. Mackey has applied for a variance (VA-59-00) as follows:
1) To allow the demolition of the rear portion of a one story single family home currently
providing a 5 foot side yard setback (7 feet required -- north side of the house) and 39%
pervious area (40% is required), and replace said portion of the home with a two story
addition that maintains the same side yard setback and pervious area, and
2) allow a second story side yard roof overhang to extend into up to 36" into side yard
setbacks (maximum 24" permitted - north and south sides of house).

WHEREAS, the Planning &Zoning Board on January 17, 2001, recommended that the City
Commission grant variance request VA-59-00 based upon the criteria set forth in section 10.13 of
Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DANIA BEACH, FLORIDA:

Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are
repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its passage
and adoption.

NOTICE IS HEREBY GIVEN that a public hearing will be held before the Dania Beach City
Commission on February 27, 2001 at 7:30 p.m., or as soon thereafter as possible, in the City
Commission Room, Administrative Center, 100 West Dania Beach Blvd., Dania Beach, Florida
33004, for the purpose of hearing any comments which might be made to the following request:
VA-59-00 —Variance request by Larry W. Mackey, 814 Argonaut Isle, Dania Beach, FL 33004
from Chapter 28, Article 4 District Regulations, Schedule Of Lot, Yard And Bulk Regulations;
Article 29 - Pervious And Impervious Areas and Article 5.31 Supplementary Lot Regulations in
an RS-6000 District. Variance request to:
1) To allow the demolition of the rear portion of a one story single family home currently

Copies of the proposed petition are available for viewing in the Growth Management
Department, 100 West Dania Beach Blvd., Dania Beach, Florida between the hours of 8:00 a.m.
and 4:00 p.m., Monday - Friday. Interested parties may appear at the public hearing and be
heard with respect to the proposed petition.
In accordance with the Americans With Disabilities Act, persons needing assistance to
participate in any of these proceedings should contact Sheryl Chapman, Administrative Services
Director, 100 W. Dania Beach Blvd, Dania Beach, FL 33004, and (954) 924-3630, at least 72
hours prior to meeting.
Any person who decides to appeal any decision made by the Planning and Zoning Advisory
Board or the City Commission with regard to any matter considered at this meeting or hearing
will need a record of the proceedings and for such purpose may need to ensure that a verbatim
record of the proceedings is made, which record includes the testimony and evidence upon

4. SUMMARY EXPLANATION & BACKGROUND:
Request for variance from Chapter 28, Article 4 District Regulations, Schedule Of Lot, Yard
And Bulk Regulations; Article 29 - Pervious And Impervious Areas and Article 5.31
Supplementary Lot Regulations in an RS-6000 District as follows:
1) To allow the demolition of the rear portion of a one story single family home
currently providing a 5 foot side yard setback (7 feet required -- north side of the
house) and 39% pervious area (40% is required), and replace said portion of the
home with a two story addition that maintains the same side yard setback and
pervious area, and
2) Allow a second story side yard roof overhang to extend into up to 36" into side yard
• setbacks (maximum 24" permitted - north and south sides of house).

SUBJECT: 814 Argonaut Isle (VA-59-00) — Variances to Demolish the Rear Portion of a One-
Story Home and Replace it with a Two-Story Addition
The applicant has requested three (3) variances relating to the partial demolition of a one-story
single family home and replacement with a two-story addition:
1) Permission to construct the two-story addition along the existing five-foot building
setback line (Minimum seven feet required).
0 In single family zoning districts, "minor" house additions less than 20 feet long can be
constructed along an existing five-foot setback. In this case, the code would permit the
applicant to demolish and rebuild a "one-story" addition along the five-foot setback line of
the existing house. Applicant's proposal to construct a two-story addition does not
qualify as a "minor" house addition, and therefore cannot be approved without a
variance.
PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION: Approval.
2) Permission to construct the second floor building addition along the existing five foot
building setback line with a maximum 36"roof overhang (maximum 24"allowed).
Applicant indicates this variance is not necessary.
3) Permission to construct the second floor building addition with 39% pervious area (40%
required).
