A RESOLUTION OF THE CITY OF DANIA BEACH,APPROVING THE VARIANCE
REQUEST SUBMITTED BY BRYAN JAHODA, FROM CHAPTER 28 ZONING,
SCHEDULE OF LOT, YARD, AND BULK REQUIREMENTS, FOR VACANT
PROPERTY LOCATED ON THE SOUTH SIDE OF SW 9TH STREET BETWEEN
SW 4TH AVE. AND SW 2ND AVE., IN THE WOODHAVEN SUBDIVISION LOT 5
BLOCK 2, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, Zoning, Schedule of Lot,
Yard, and Bulk Requirements, sets the set-back requirements in a Residential Zoning District for
the City of Dania Beach; and
WHEREAS, Bryan Jahoda has applied for the following variances(VA-08-01) in conjunction
with the construction of a Single Family Residence: 1) construction of a single family home on a
48 foot wide lot(minimum 50 ft. required); Sec. 5.15) 2) air conditioning to extend 36" in side yard
setback (maximum 24" permitted), property located on the south side of SW 9th Street between
SW 4th Ave. and SW 2nd Ave., in the Woodhaven Subdivision Lot 5 Block 2 at Dania Beach; and
WHEREAS, the Planning & Zoning Advisory Board on February 21, 2001, recommended
that the City Commission grant variance request VA-08-01 based upon the criteria set forth in
section 10.13 of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania
Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DANIA BEACH, FLORIDA.
Section 1. That that certain application VA-08-01, for a variance as described above (from
requirements in Chapter 28, Zoning, Schedule of Lot, Yard and Bulk Requirements), a copy of
which is attached as Exhibit "A" is approved.
Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are
repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its passage
and adoption.

NOTICE IS HEREBY GIVEN that a public hearing will be held before the Dania Beach City Commission on

27, 2001 at 7:30 p.m., or as soon thereafter as possible, in the Dania Beach City Commission Room,
Administrative Center, 100 West Dania Beach Blvd., Dania Beach, Florida 33004, for the purpose of hearing
any comments which might be made to the following requests:
VA-08-01 - Variance request by Bryan Jahoda for vacant property located on the south side of SW 91h Street
between SW 41h Ave. and SW 2"d Ave., in the Woodhaven Subdivision Lot 5 Block 2. Request is from Chapter
28, Zoning, Schedule of Lot, Yard and Bulk Requirements. Mr. Jahoda is requesting the following variances in
conjunction with the construction of a Single Family Residence: 1) construction of a single family home on a
48 foot wide lot (minimum 50 ft. required); Sec. 5.15) 2) air conditioning to extend 36" in side yard setback
(maximum 24" permitted).
Legally described: Lot 5, Block 2, AMENDED PLAT OF WOODHAVEN, as recorded in plat Book 10, page 56
of the Public Records of Broward County, Florida.
Copies of the proposed petition are available for viewing in the Growth Management Department, 100 West
Dania Beach Blvd., Dania Beach, Florida between the hours of 8:00 a.m. and 4:00 p.m., Monday — Friday
please call (954) 924-3645 for more information. Interested parties may appear at the public hearing and be
heard with respect to the proposed petition.

The applicant wishes to construct a single-family home on a 48-foot wide lot. The
property on either side of the lot is already developed. This precludes the applicant
from acquiring the additional two feet necessary to meet the lot width requirement.
• Applicant indicated at the P and Z Board meeting that the a/c unit will be located to the
rear of the house. Applicant should clarify if this is still the case.
