HomeMy WebLinkAboutR-2001-050 RESOLUTION NO. 2001-050 A RESOLUTION ,OF THE CITY Or DANIA BEACH, APPROVING THE SIGN ADJUSTMENT REQUEST SUBMITTED BY PHIL GLASSMAN, MANAGING PARTNER FOR THE DANIA SHOPPING CENTER, FROM CHAPTER 28, ZONING,ARTICLE 28, SIGNS, FOR PROPERTY LOCATED AT 100-130 SOUTH FEDERAL HIGHWAY, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances Chapter 28, Zoning, Section 28 Signs, sets the signage criteria in the Downtown Dania Beach Redevelopment District, within the City of Dania Beach; and WHEREAS, Phil Glassman, Managing Partner for the Dania Shopping Center, has applied for a sign adjustment (SA-01-01) to allow the following signage in the Dania Shopping Center: 1) Family Dollar: 96 square feet (maximum 37.5 square feet permitted); 2) Check Cashing Store: 80 square feet(maximum 20 square feet permitted)and to insert new"sign copy" (see attached sketch) in place of the existing check cashing store sign; 3) Jackson's Ice Cream: 72 square feet (maximum 37.5 square feet permitted); 4) Cigar World: 18 square feet (maximum 15 square feet permitted); and 5) To allow all of the existing Window Signage in the Dania Shopping Center to remain. property located at 100-130 South Federal Hwy., Dania Beach; and WHEREAS, the Planning &Zoning Advisory Board on March 21, 2001, recommended that the City Commission grant the sign adjustment request SA-01-01 relating to Wall Signage and recommended the Commission deny the sign adjustment request relating to Window Signage; based upon the criteria set forth in Article 28, Section 28.200. "Relief from requirements; Sign Adjustment; Variances", of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application SA-01-01, for sign adjustments from Chapter 28, Zoning, Article 28, Signs, "Downtown Dania Beach Redevelopment District Sign Regulations", a 1 RESOLUTION NO. 2001-050 copy of which is attached as Exhibit "A" is approved subject to the following conditions: Planning and Zoning Board Recommendations WALL SIGNS 1) Family Dollar: Approval. 2) Check Cashing Store: Approval of the proposed "change of copy" check cashing sign subject to the following: New sign lettering (3'x 15)to be lime green surrounded by a hunter green border. 3) Cigar World: Approval. 4) Jackson's Ice Cream: Approval. WINDOW SIGNAGE 1) Jackson's Ice Cream exempted; 2) All existing businesses at the Dania Shopping Center are allowed to retain window signs until a workshop meeting could be scheduled to review the City's policy. Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. The following questions pertain to the criteria upon which the City Commission and Planning and Zoning Board will consider this application: 1. Describe how the sign will still maintain the basic intent and aesthetic improvement purposes of the sign regulations, particularly as it affects the appearance and compatibili with ro erties in the surrounding areas. The four (4) wall signs in question are ail in f�iar�nony with the existing center signs. The signs are all in relation to the store frontage • and are aesthetically compatible. eg' Family Dollar Store has 100 foot front Jaxson's has 50 foot front 2. Describe how the signs permitted under this code cannot be adequately viewed due to physical Msite distinctions other than those imposed by City ordinances or created by the applicant. The four (4) signs that have been previously allowed under the old sign code are not unsightly and blend in with the Shopping Center signs 3. Describe how the architectural design of a structure or the site plan pose unique and extenuating characteristics.which are not compatible with the requirements of the sign article. 4. Describe how the structure or site configuration are unique, which causes the signage permitted by this article to be ineffective in identifying a use or structure that would otherwise be entitled to a sign. Even though we are technically in "Downtown perimeter" the signs in this Plaza should be viewed as STioppiing Center and be less restrictive. 5. If the sign is an existing sign, describe the age of the sign and the extent to which the sign deviates from the existing code requirements, in addition to the criteria above. (24' X 4'); Checks Cashed/Auto Tag Agency Sign: 80 Sq. Ft. (20' X 4'); Cigar World Sign: 18 Sq. Ft. (3' X 6'); and Jaxon's Ice Cream 72 Sq. Ft. (24' X T). The following wall signs in the Dania Shopping Center exceed this requirement: 1) Family Dollar: 96 square feet (maximum 37.5 square feet permitted). ® 2) Check Cashing Store: 80 square feet (maximum 20 square feet permitted). 3) Cigar World: 18 square feet (maximum 15 square feet permitted). 4) Jackson's Ice Cream: 72 square feet (maximum 37.5 square feet permitted). The applicant wishes to insert new "sign copy" (see attached sketch) in place of the existing check cashing store sign. While the total sign area would still be 80 square feet (4' x 20'), the lettering would only occupy 45 square feet (3' x 15') of the sign. The remainder of the sign (border area) would be "hunter green" to match the existing canopy. PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION (WALL SIGNS) 1) Family Dollar: Approval. The size of the sign is in reasonable proportion to the size of the tenant space {Section 28.200 (1) (b) of the Sign Code}. 2) Check Cashing Store: Approval of the proposed "change of copy" check cashing sign subject to the following: New sign lettering (3' x 16) to be lime green surrounded by a hunter green border. Approval based on the age of the current sign {Section 28.200 (2) of the Sign Code), . 3) Cigar World: Approval. The sign deviates minimally from Zoning Code requirement. GLASSMAN SIGN VARIANCE.doc 4) Jackson's Ice Cream: Approval. The size of the sign is in reasonable proportion to • the size of the tenant space {Section 28.200 (1) (b) of the Sign Code}. WINDOW SIGNAGE All businesses in the Dania Shopping Center contain one or more of the following window signs: neon signs, laminated plastic lettering signs, paper signs, plastic signs, or painted signs. Section 28.180 of the Zoning Code prohibits all window signage, whether temporary or permanent, along streets designated as principal arterials. Limited exceptions include: 1) Graphic representations with no lettering or words. 2) One neon "OPEN" sign, generally no greater two square feet. 3) Graphic representations of Credit Cards. The Zoning Code provides no guidance for granting a sign adjustment for window signs. PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION (WINDOW SIGNS) Denial (3-1) of all window signs.
