Home My WebLink AboutR-2001-055 RESOLUTION NO. 2001-055 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THAT CERTAIN WIRE TRANSFER AGREEMENT WITH REPUBLIC SECURITY BANK AND APPOINTING THE INTERIM CITY MANAGER AND FINANCE DIRECTOR, ACTING SINGLY, AS ITS AUTHORIZED REPRESENTATIVES IN SUCH MATTERS; PROVIDING FOR AN EFFECTIVE DATE AND PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach from time to time finds it necessary to wire transfer funds from the City's accounts with Republic Security Bank; and WHEREAS, the Republic Security Bank requires that the City of Dania Beach authorize a representative to request that said wire transfer be made. NOW THEREFORE, be it resolved by the City Commission of the City of Dania Beach, Florida: Section 1. That the City Commission of the City of Dania Beach, Florida does hereby approve the agreement between the City of Dania Beach and Republic Security Bank, authorizing transfer of funds; a copy of which is attached hereto and made a part hereof as exhibit "A". Section 2. That the Interim City Manager and Finance Director, acting singly, are . hereby authorized to transmit such funds as necessary, consistent with the needs of the City of Dania Beach, to the State Board of Administration for investment in the State Boards' investment pool, wire transfer funds for the retirement of bonds and payment of interest thereon, and to wire transfer employee payroll direct deposits. Section 3. That this authorization shall be continuing in nature until revoked by action of the City Commission of the City of Dania Beach. Section 4. That all resolution or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 5. That (a) in furthering the transfer, Republic Security Bank may make use of any banking channels or other facilities which it may select, all without liability for any acts or failures to act (inclusive of any failure to identify the intended transferee) on the part of it's branches or correspondents, or for any failure of the said amount to reach the intended transferee; (b) if Republic Security Bank has been instructed to effect the transfer by electronic transmission but it is unable to do so with reasonable promptness, Republic Security Bank may, in it's discretion, proceed to effect the transfer by telephone, ( c ) Republic Security Bank may send any message relative to the transfer in explicit language, code or cipher and shall not be liable for errors, delay or defaults in the transmission of any such messages by mail or wire facilities employed by it or by any of it's branches or correspondents, or for any total or partial suspension of any such means of transmission; and (d) if a refund is requested prior to the completion of transfer, Republic Security Bank will endeavor to effect a cancellation of any instruction to pay which it may have issued, and upon receipt by it of confirmation of such cancellation and the return to it of whatever funds it may have previously paid or credited to any third party for the purpose of furthering the transfer, Republic Security Bank will refund the said amount, less it's expenses and those of any correspondent(s) or other relative to the transfer. 4.
