A RESOLUTION OF THE CITY OF DANIA BEACH,APPROVING THE VARIANCE
REQUEST SUBMITTED BY JOHN AND DOREEN BARTLEY, FROM CHAPTER
28, ZONING ARTICLE 5, SECTION 5.44, FOR PROPERTY LOCATED AT 201
S.E. 2ND AVENUE, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances, Article 5, Section 5.44, sets the
Accessory Structures, minimum yard, lot and bulk regulations for the City of Dania Beach; and
WHEREAS, John and Doreen Bartley have applied for a variance (VA-16-01) to allow the
construction of a garage addition, up to 12 feet in height as measured to the ceiling of the garage,
with a seven feet rear yard setback (10 foot setback required) for property located at 201 SE 2nd
Avenue, Dania Beach; and
WHEREAS, the Planning &Zoning Advisory Board on March 21, 2001, recommended that
the City Commission grant variance request VA-16-01 based upon the criteria set forth in section
10.13 of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-16-01, for a variance as described above (from
requirements in Chapter 28, Zoning Article 5, Section 5.44), a copy of which is attached as Exhibit
"A" is approved subject to no a/c equipment in the seven-foot rear yard setback area.
Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are
repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

the applicant of rights commonly enjoyed by other properties in the same zoning district and
would work unnecessary and undue hardship on the applicant.

OTICE IS HEREBY GIVEN that a public hearing will be held before the City Commission on April 10, 2001 at
.30 p.m., or as soon thereafter as possible, in the Dania Beach City Commission Room, Administrative
Center, 100 West Dania Beach Blvd., Dania Beach, Florida 33004, for the purpose of hearing any comments
which might be made to the following requests:
B) VA-16-01 - Variance Request by Doreen and John Bartley, for property located at 201 S.E. 2nd Avenue,
Dania Beach. The Bartley's' are requesting a variance from Chapter 28, Zoning Article 5, Section 5.44, to allow
construction of a garage addition, up to 12 feet in height as measured to the ceiling of the garage, with a seven
feet rear yard setback (10 foot setback required).
Legally described: The North 100 feet of lots 1 and 2 block "Dania Golf View", according to Plat thereof as
required in Plat Book 36, Page 50 of the Public Records of Broward County, Florida.
Copies of the proposed petitions are available for viewing in the Growth Management Department, 100 West
Dania Beach Blvd., Dania Beach, Florida between the hours of 8:00 a.m. and 4:00 p.m., Monday — Friday
please call (954) 924-3645 for more information. Interested parties may appear at the public hearing and be
heard with respect to the proposed petition.

SUBJECT: 201 S.E. 2"d Avenue (RD-6000 Duplex Zoning): Variance to allow a
garage addition, up to 12 feet in height as measured to the ceiling of the
garage, with a seven foot rear yard setback (10 setback required)
Applicant wishes to construct a 40-foot long by 28-feet wide garage addition to an
existing accessory building. The expanded garage measures 11' 6" to the bottom of the
ceiling (maximum 12 feet permitted). It is my understanding the applicant wishes to
store a house trailer within the expanded garage.
The proposed rear yard setback (east lot line) is seven feet. The Zoning Code requires
® a 10-foot rear yard setback for accessory buildings. Because the subject parcel is a
corner lot, the applicant's rear yard faces his next-door neighbor's (to the east) side
yard. As such, the applicant's neighbor can construct a two-story home within seven
feet of the common lot line shared by both parties.
The site plan indicates three Alexander Palms. Due to the length of the expanded
garage (approximately 60 feet) staff suggests additional architectural detail on the east
building elevation.
PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION
Approved subject to no a/c equipment in the seven-foot rear yard setback area.
