HomeMy WebLinkAboutR-2001-086 RESOLUTION NO. 2001-086 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, RELATING TO ZONING IN PROGRESS; DECLARING THAT THE CITY IS CONSIDERING THE ADOPTION OF ZONING REGULATIONS PRESCRIBING THE IMPOSITION OF A SINGLE FAMILY RESIDENTIAL ZONING CLASSIFICATION UPON CERTAIN LANDS CURRENTLY LYING EAST OF 1-95 AND ZONED AS "R-2" AND "R-D 6000", TO BE RE-ZONED TO "R-S 6000", TO PROMOTE PRESERVATION AND REDEVELOPMENT OF SUCH LANDS AS SINGLE-FAMILY OWNER-OCCUPIED RESIDENTIAL AREAS, SUCH LANDS BEING IDENTIFIED IN EXHIBIT "A", ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Dania Beach believes that specific regulations which prescribe the imposition of a single family residential zoning classification upon certain lands currently lying east of 1-95 and zoned as "R-2" and "R- D 6000", if re-zoned to "R-S 6000", would promote preservation and redevelopment of such lands as single-family owner-occupied residential areas, such lands being identified in Exhibit "A", a copy of which is attached to this Resolution, and that such action would be in the best interests of the City, and WHEREAS, such action would be of benefit to the residents of the City of Dania Beach since it is expected to result in the preservation of property values and to promote and encourage single-family home ownership within the City; and F:/566001:/Resolutions:/Zoning in Progress 1 RESOLUTION NO. 2001-086 • WHEREAS, the City Commission wishes to place all parties on notice that it is considering such regulations and that parties who contemplate residential construction activities in the City will be obligated to comply with the provisions of such ordinance if their lands lie within the areas described in Exhibit "A"; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City Commission of the City of Dania Beach declares that it is processing an ordinance, which will be an amendment to the zoning ordinances of the City of Dania Beach, which will prescribe the imposition of a single family residential zoning classification upon certain lands currently lying east of 1-95 and zoned as "R-2" and "R-D 6000", to be re-zoned to "R-S 6000", to promote preservation and redevelopment of such lands as single-family owner-occupied residential areas, such • lands being identified in Exhibit "A", a copy of which is attached to this Resolution and that parties seeking to commence residential construction activities within such areas shall be subject to the regulations adopted by the City Commission, provided such regulations are adopted within the next one hundred eighty (180) days. Section 2. That all affected property owners are placed on notice that any application for a development permit or any construction activity involving residential development or improvements which lie within such affected areas shall be subject to review pursuant to the requirements of the ordinance in progress pertaining to the proposed rezoning and any such permit or activity must be consistent with the terms of such ordinance. Section 3. That the adoption of this Resolution shall be evidenced by placement in a newspaper of general circulation within the City in a one-eighth page advertisement on two occasions within two weeks after adoption of this Resolution. Section 4. That all resolutions or parts of resolutions in conflict with the resolution are repealed to the extent of such conflict. Section 5. ANSBRO, CITY ATTORNEY • F:/566001:/Resolutions:/Zoning in Progress 3 RESOLUTION NO. 2001-086 GROWTH MANAGEMENT DEPARTMENT STAFF REPORT TO: Jason Nunemaker, City Manager FROM: Laurence Leeds, AICP, Director Growth Management Department DATE: May 22, 2001 RE: Zoning in Progress: RS-6000 (Duplex) and R-2 (Duplex) to RD-6000 (Single Family) The City Commission directed staff to prepare a draft proposal to rezone duplex properties to single family residential. The City Commission did not identify a precise area to be rezoned. For purposes of discussion, staff has prepared a proposal depicting the rezoning of all duplex properties east of Ravenswood Road to single-family residential. The attached map identifies these properties and their respective location in SW, SE, NW, and NE Dania Beach. Annexation areas west of Ravenswood Road were intentionally left out so as not to exclude duplex use from the City entirely. How much duplex zoning the City is obligated . to provide is ultimately a legal question for the City Attorney. The map identifies two duplex zoning districts east of Ravenswood: RD-6000 and R-2. RD-6000 districts are located throughout "pre-annexation" Dania Beach. R-2 is a Broward County duplex classification that is limited to a portion of NW Dania Beach. While there are subtle differences between R-2 and RD-6000, both districts are intended to accommodate duplexes on 6,000 (60' x 100') square foot lots. There are approximately 1500 RD-6000 and R-2 lots located east of Ravenswood Road. If the Commission chooses to comprehensively rezone all 1500 parcels to RS-6000 single family, staff could be looking at costs (and staff time) similar to that encountered in the [ROM/IROC rezoning. Assuming four (4) advertised and noticed public hearings (IROM/IROC required six public hearings), the estimated minimum cost to review, process, notice, and advertise the rezoning would be as follows: Postage/Advertising: $8,000.00 Legal Fees: $8,000.00 Materials: $2,000.00 Clerical staff (hours): 400 hours (IROM required over 640 hours) • Professional staff (hours): 200 hours (IROM required over 450 hours) ZONING IN PROGRESS CC MEMO 041701.doc The "real cost" in staff time is that current planning activities will be delayed to allow staff sufficient time to process the city-wide rezoning. Current planning functions include site plan review, special exception/variance review, rezoning and land use plan amendments, city-initiated zoning code text changes, and other items requiring P and Z Board or City Commission review. Most IROM/IROC staff time (legal, professional, and clerical) was devoted to meeting with concerned property owners and their attorneys. IROM/IROC involved 165 parcels where this project includes over 1500 lots. Also, [ROM/IROC took over eight months of intensive sustained effort, nearly twice the four months allotted under the Zoning in Progress resolution. Based on the above, 120 days (four months) will be insufficient time to process, advertise, notice, meet with affected persons, and adopt the zoning change. Using a consultant to meet with interested persons (and respond to their requests for information) will allow staff more time for current planning functions. However, it will add several thousand dollars to the cost of the project. In any event, staff estimates a city-wide duplex to single-family rezoning process will require at least six months. Finally, all existing duplex properties rezoned to single family would immediately • become both non-conforming structures and uses. As such, if a duplex building that is zoned single family is damaged such that 75% of its floor area is made unsafe or unusable, said structure can only be rebuilt as a single-family unit. This may affect the ability of some duplex property owners to obtain refinancing. Also, duplexes zoned single family cannot be expanded, enlarged, reconstructed or structurally altered except when changed to single family use. RECOMMENDATION None.
