FAMILIARITY WITH APPLICABLE LAW
Staff Qualifications - In additional to the numerous insurance-related academic
qualifications held by the members of the Siver staff, both Jim Marshall and George
Erickson hold Juris Doctorate(JD) degrees and, although not engaged in the formal
practice of law, are active members of the Florida Bar.
Jim Marshall is a graduate of Stetson University College of Law, where he graduated
Magna Cum Laude and was Valedictorian of his law school graduating class.
George Erickson is a graduate of Duke University School of Law, where in three
years he obtained a Juris Doctorate (JD) degree, as well as a Masters degree in
International Law (LLM).
Because of Siver's recognized expertise in both insurance/risk management and the
law, our consultants have addressed these issues in seminars for a number of
organizations including: The Florida Trial Lawyers Academy (FTLA), the Public
Risk Management Association (PRIMA), the Florida Education Risk Managers
Association (FERMA), and the Florida School Board Attorneys Association.
Continuing Education-Consulting personnel are continually involved in formal and
informal education. Continuing education activities include enrollment in various
formal courses offered by the Florida Bar Association, the Insurance Institute of
America, the American Institute for Property and Liability Underwriters, Inc., and
the American College of Life Underwriters. In addition, all consulting personnel
attend seminars throughout the year.
In-Depth Experience - Because of our special expertise and the firm's ability to
simultaneously deal with both insurance issues and legal issues, and because of the
often complex needs of our sophisticated clientele, our consulting staff has had the
opportunity to provide consulting services of a range and depth not typically
provided by other consulting firms. The experience of working with these issues
makes all of our consultants, including those without specialized legal training, more
knowledgeable and prepared to deal with the legal aspects of our clients' risk
management and insurance needs. These particularly complex consulting services
which Siver has offered, and continues to offer, to its clients include, but are not
limited to, the following:
Self-Insured Ordinances& Manuals - When a government elects to become
self-insured, the scope of coverage and various procedures are no longer
dictated by insurance policies or procedures. We have assisted a number of
clients in establishing formal scopes of coverage and procedures both as
ordinances and as manuals.23
23
SIVER INSURANCE CONSULTANTS
® Governmental Status-The Siver staff has worked extensively with our Florida
governmental clients' legal counsel on many issues which arise because of their
status as a Florida political entity. These issues include special problems which
arise due to the sovereign immunity granted to Florida governmental entities
under Florida Statute §768.28, various problems which arise out of statutory
limitations on the types of contracts governmental entities can enter into, and
problems which arise in the insurance marketing process due to laws and local
ordinances dealing with procurement and disclosure processes.
Manuscripted Insurance Provisions - In many instances, the standard policy
provisions are not appropriate for our clients. We have developed for many of
our clients a number of provisions and, in fact, entire policies to meet their
specific needs.
Development and Negotiation of Risk Management Contract Provisions -
We have provided substantial assistance to counsel for many of our clients in the
development and negotiation of risk management provisions including
insurance, indemnification, risk of loss, bonding, and warranties. In recognition
of our experience and training in such issues, we are typically asked by our
clients' legal counsel to take a leadership role for such issues.
® Claims Assistance-We have provided assistance with the adjustment of major
claims and losses such as property, business interruption, boiler and machinery,
public officials, directors and officers, general liability, etc. Our claims
assistance activities have enabled our clients to recover very substantial sums
over the settlements initially offered by insurers.
® Litigation Support -We have provided litigation support and expert witness
services. These services have included the interpretation of insurance coverages
and explanations of insurance conventions. The consulting services performed
in Siver's litigation support practice constantly expose the Siver staff to
emerging and complex insurance and legal issues. Among the clients for whom
we have provided such services are various law firms and clients throughout
Florida and the United States.
® Organization, Staffing, and Procedures - We have performed a number of
formal and informal audits of the organization, staffing, and procedures of risk
management departments. As an example, for the Department of Insurance of
the State of Florida, Siver performed a Workers' Compensation claims handling
performance audit of the Bureau of State Employees'Workers' Compensation
Claims of the Division of Risk Management.
