A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,
APPROVING THE SITE PLAN REQUEST SUBMITTED BY
DAVE MARTINO, AGENT FOR FLORIDA POWER AND
LIGHT, FOR PROPERTY LOCATED DIRECTLY NORTH
AND ADJACENT TO THE DANIA CUT-OFF CANAL, DANIA
BEACH; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the
City of Dania Beach, Florida, states that a site plan is required as a condition to the
issuance of a building permit; and
WHEREAS, Dave Martino, Agent for Florida Power and Light, has applied for site
plan approval for the proposed construction of an electrical substation to be located directly
north and adjacent to the Dania Cut-Off Canal, Dania Beach; and
• WHEREAS, the Planning &Zoning Board on March 21, 2001, voted to move the site
plan forward to the City Commission, with the recommendation that the City Commission
first make a "finding" on the special exception use before ruling on the site plan request
(SP-10-01), based upon the criteria set forth in Section 8.4 of Article 1 of Chapter 8 of the
Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application (SP-10-01) for site plan approval, a copy of
which is attached and made a part of this Resolution as Exhibit "A" is approved, subject
to the following conditions being resolved immediately prior to issuance of the building
permit for the substation:
a) FPL shall submit a Declaration of Restrictions relating to use of the South 60 feet

• of the development parcel subject to final approval of the city attorney. The
Declaration would provide that no substation equipment would be installed in the
south 60 feet of the development parcel (not the canal Right-of-Way). This
would not preclude FPL, at a later date, from expanding transmission lines
through the same development parcel as transmission lines currently exist on the
parcel.
b) FPL shall submit a Declaration of Restrictions relating to the use of the North 100
feet of the Dania Cutoff Canal, including the canal itself and shoreline, subject to
the approval of the city attorney, reflecting that FPL would have no intention of
developing or seeking permission from the South Florida Water Management
District to develop land immediately south of and adjacent to the development
parcel, which includes all the FPL property within the canal right-of-way.
c) FPL would have to verify the adequacy of the vehicular access to the new
substation site.
d) FPL agrees that this approval is subject to the landscaping as identified in the
substation landscaping plan dated April 16, 2001, including, but limited to, a
double row of Areca Palms in the 60 foot buffer area.
• It is further noted that the original Site Plan is maintained in the office of the Growth
Management Department of the City of Dania Beach.
Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of
Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals
shall automatically expire and become null and void unless building permits are obtained
on or before 18 months from the date of this resolution.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

Application for Site Plan Approval
Florida Power & Light
The site plan and landscape plan for this project, represent our plans as submitted
and reviewed at the Community Outreach Meeting held on January 10t', 2001. The
plans propose. the construction of an electrical distribution substation east of the
existing switchyard.
This proposed facility would consist of an approximately 1-acre fenced gravel
surfaced area containing a 561 square foot relay vault. Contained within this fenced
area will be electrical equipment used to step-down and distribute electricity to the
local service area.
A major concern to the residents attending the January 10th meeting was the
provision for adequate landscape buffering of this facility. As designed this facility
will not be visible from US-1 when viewed looking east due to the existing Areca
Palm buffering of the switchyard. Due to the safe clearance requirements from the
existing overhead lines limiting species suitable for landscape buffering, we have
proposed an alternate buffer planting which has been endorsed by the residents
attending the Outreach Meeting. Dense buffering consisting of Areca Palms planted
at a minimum height of 10' would be installed to buffer the views from the north. No
tree removals within the limits of the Dania Cut-Off canal are planned, however this
property is not FPL owned and as a back up to the existing buffering, Areca Palms
will be installed along the south property line. Attached is a photograph of the
existing buffering along US-1 which we propose to install on the north and south
sides of this project.
This proposed facility would take advantage of the limited use nature of this parcel
of land and permit us to construct this necessary essential service facility on land
unsuitable for other development.
