HomeMy WebLinkAboutR-2001-137 RESOLUTION NO. 2001-137 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO FILE A GRANT APPLICATION FOR THE ACQUISITION OF LAND FOR THE COMPLETION OF GRIFFIN MARINE PARK, UNDER THE FLORIDA COMMUNITIES TRUST PRESERVATION 2001 GRANT PROGRAM IN PARTNERSHIP WITH BROWARD COUNTY WITH A TOTAL ACQUISITION COST OF $416,000; PROVIDING FOR A CASH MATCH NOT TO EXCEED $83,200 OR TWENTY PERCENT OF THE TOTAL ACQUISITION COSTS; AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS AS THE AUTHORIZED REPRESENTATIVE OF THE CITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA; Section 1. That the application with the Florida Communities Trust Preservation 2000 grant program, in partnership with Broward County, for the acquisition of two parcels of land (folio #'s 01-096 and 01-094) for the completion of Griffin Marine Park, in substantial form as Exhibit "A", attached, is approved and made a part of this resolution. Section 2. That Jason Nunemaker, Interim City Manager, as authorized representative of the City of Dania Beach, may execute all documents and expedite a cash match not to exceed $83,200 or twenty percent of the acquisition costs through the Florida Communities Trust Preservation 2000 grant program for the completion of Griffin Marine Park. Section 3. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 4. Provide a descriptive statement of how the project will benefit the community and a statement from each local government in the jurisdiction where the project site is located that the project is consistent with the local comprehensive plan(s). The Griffin Marine Park Expansion site is located in southeast Broward County within the incorporated limits of Dania Beach. It is at the intersection of SW 49`h Street and SW 30`h Avenue, just south of the Dania Cut-Off canal in Dania Beach, Florida, as shown in many of the attached exhibits. Broward County, utilizing the Safe Parks and Land Preservation Bond funds, is prepared to pay forty percent (40%) and the City of Dania Beach will provide twenty percent(20%) of the acquisition costs for the Griffin Marine Park Expansion project. The City will manage the site after purchase. The purpose of this project is public acquisition of vital shoreline properties. These parcels abut the City-owned future Griffin Marine Park which was acquired by the City in 1998 and is slated to be developed in conjunction with the expansion parcels proposed in this application. Once developed, Griffin Marine Park will provide opportunities to access the Dania Cut-Off canal via a passive marina. The expansion lands will provide additional recreational opportunities as well as opportunities to restore and conserve the natural environment. The expansion parcels have been categorized as Green Space, defined in Broward County Resolution 2000-1230 as, "...land where only some aspects of the native vegetative community still remain; or greenway component; or land with a potential as buffer to environmental lands and conservation lands, or connector to existing protected natural lands and parks." (see Attachment 1). The sites' original natural community was likely a flood plain forest but today appears more as a remnant cypress strand succeeding to oak hammock. Invasive exotic vegetation, such as Australian pine and Brazilian pepper, will be removed to allow for natural regeneration of native species. Management of the Griffin Marine Park and expansion parcels will result in protecting adjacent habitat(the Dania Cut-Off canal) for the West Indian manatee, a listed animal species. Proposed physical improvements and recreational developments for the marine park and expansion parcels include a public access boat ramp, parking facility for trailer-able boats, picnic tables, nature trails, shoreline access, public restroom, fishing amenities, and rip-rap shoreline stabilization. This project will benefit the immediate community as well as surrounding communities by providing additional public access to the shoreline, passive recreational opportunities, and by protecting and providing open space. Since the immediate community surrounding the site is a mixed-use area that includes light industry, light commercial, transportation, and light-medium residential units, it is important that the City of Dania Beach provides open space to create livable conditions within the City. The comprehensive plans of both Broward County and the City of Dania Beach set as goals and objectives the provision of open space, recreational activities, and restoration of natural environments. The Griffin Marine Park Expansion project, as described in this application, will help achieve these goals and ultimately enhance the sustainability of the community. As described elsewhere in this application, the project sites abut the recently acquired future Griffin Marine Park(see maps in Exhibits D,E,F,G,K and Q. The City of Dania Beach purchased the 1.8-acre parcel in 1998 with the long-term vision of also acquiring the parcels proposed in this application. The vision for the entire site is to provide water- oriented/shoreline recreational opportunities as well as conservation of open space and natural resources. The recreational amenities to be developed on the currently City-owned parcel and the expansion parcels proposed in this application are necessarily linked, according to the conceptual plan included in Exhibit K. (2) OUTDOOR RECREATION, NATURAL AND CULTURAL RESOURCES SECTION This section identifies whether acquisition of the project site furthers the provision of outdoor recreation facilities and open space and the preservation of natural and cultural resources. All proposed recreation facilities are required to be 0 designed with as minimal disturbance as possible to natural resources on the project site. (a) Outdoor Recreation and Open Space Form FF-1 (Effective 511101) Page 8 1. Will the project provide outdoor recreation areas or open space adjacent to other publicly- Yes No owned areas or facilities, such as, existing parks, museums, schools, libraries, affordable X housing units, recreational trail systems or greenways? Currently the City of Dania Beach owns the adjacent lot located at 2987 SW 45th Street, which is scheduled to become the City-managed Griffin Marine Park. The park is well into its design stage. The proposed expansion parcels will complete the envisioned development of the Griffin Marine Park by adding nature trails, benches, and provisions for fishing access and picnicking. The expansion parcels will also provide both visual and ecological buffers for the City- owned marine park property.Access to the site will be provided via a park entrance to be constructed off of SW 30th Avenue just north of SW 45th Street. Access will also be available via the canal by dockage. 2. Will the project include two or more resource-based outdoor recreation facilities, such as, a Yes No nature trail, picnic pavilion, fishing pier, wildlife observation area, canoe launch, boardwalk or X camping area? (5 points) If yes, describe what resource-based facilities will be provided and how they will be integrated into the project. Picnic areas, fishing provisions, and nature trails are all part of the site development plan for the Griffin Marine Park Expansion (see Exhibit K). These facilities will complement and be integrated with the passive marina. A nature trail will circuitously connect the park entrance to the shoreline and marina. Picnic areas will be located along the nature trail, and fishing access will be developed at the trail's northern terminus. 3. Will the project include two or more user-oriented outdoor recreation facilities, such as, Yes No playgrounds, basketball courts, tennis courts, bocci ball courts, shuffleboard courts, volleyball X courts or swimming areas? The immediate vicinity of the project includes single family, medium family, commercial, industrial, transportation, and conservation developments. (b) Recreational Trail Systems and Greenways 1. This project will include a new recreational/nature trail and various enhancements to the abutting waterway. The new trail will be approximately .25 miles in length and will be located predominately in the project's eastern parcel (see Exhibit K). 2. Additionally, the project will be a link (water trail#27) in the Broward County Greenway/Blueway Plan, as depicted in Exhibit I. Since the expansion parcels abut the Dania Cut-Off canal and are part of an addition to a marine facility, which includes a boat dock, the project will provide opportunities for water access to nearby parks and open spaces such as Boaters Park, West Lake Park and the Atlantic Ocean (see Exhibit 1). 3. Will the project enhance a local, regional or statewide network of linked greenways by Yes No connecting two or more greenways, by extending existing greenways, or by contributing to X closing gaps in existing greenways? As shown in Exhibit 1, and as mentioned in the response to the previous question, this project contributes a link in the Broward County Greenway Plan. It gives direct access to the Dania Cut-Off canal, which in turn connects the Griffin Marine Park to Boaters Park, West Lake Park, and the Atlantic Ocean. 4. Will the project further a locally adopted greenway or recreational trail system plan for the Yes No community? Additionally, the project will further City of Dania Beach Comprehensive Plan Policy 2.1 (Coastal Management; Form FF-1 (Effective 511101) Page 10 Objective II)which designates the Dania Cut-Off canal as a recreational priority (see Exhibit A). (c) Education Opportunities 1. Will the project site include interpretive signs intended to educate visitors about the natural Yes No environment or unique history of the site? This project will provide on-site educational signs interpreting the area's natural features, such as the oak hammock, cypress strand, mangroves, the West Indian manatee, and the ecological changes wrought by water channel/drainage alteration. Discuss the present condition of the habitat, the approximate size of the habitat in acres and how it will be protected and managed.West Indian manatees, a listed species, live in the brackish water of the Dania Cut-Off canal. The project site abuts the canal, and can thus impact water quality and shoreline habitat upon which the manatees depend. Developments associated with this project will be designed to help protect the manatees and their habitat. Care will be taken to prevent shoreline erosion through rip-rap construction and revegetation. If determined feasible, establishing mangroves may be part of the revegetation effort. The present condition of the habitat along this stretch of the canal is fair, with some efforts being taken to restore mangroves (e.g. at nearby County-owned Boaters Park). Approximately 350 feet of shoreline are included in the proposed expansion parcels, which add to the 150 feet of shoreline already protected by the City-owned Griffin Marine Park parcel. 4. Does the project site contain critical habitat typically suitable for one or more listed animal Yes No Form FF-1 (Effective 511101) Page 11 species and is the habitat located in a Strategic Habitat Conservation Area, as identified by the X Florida Fish and Wildlife Conservation Commission? Management plans include restoring and maintaining the natural vegetation. This will entail the removal of exotic species, such as Australian pine, Brazilian pepper, bischofia, and tropical almond, from the remnant oak hammock. Removal of these plants should allow for natural succession of the native community. However, where areas are completely devoid of vegetation (primarily along the shoreline), landscaping with native species will be undertaken, as discussed in more detail in the response to question 3 below. 2. Will degraded or altered upland communities on the project site be restored to a natural Yes No community? As mentioned in the response to the question above, areas along the shoreline have experienced the greatest degradation as evidenced by lack of vegetation and soil compaction. Most of the damage is on the City-owned marine park parcel. Revegetation with native species along the landward embankments may include species such as bald cypress and pond apple. Waterward, lower embankment areas may be revegetated with species such as leather fern, Spartina and, if feasible, mangroves. (f) Water Quality 1. Will the quality of surface waters occurring on or adjacent to the project site be improved by the Yes No elimination of pollution sources, removal of impervious surfaces, or other means? X (5 points) If yes, discuss the proposed water quality improvement and the expected results. The proposed shoreline revegetation in this application will stem the current rate of soil and water run-off(due to soil compaction discussed previously in Section (e), Landscaping or Restoration) into the Dania Cut-Off canal. In addition, development of the public park facility will prevent the current illegal use of the site which has created soil compaction and excess run-off into the canal. Should the properties proposed in this application remain in private ownership, the likelihood that they will be developed to their full zoning potential for residential housing is quite high. Under this scenario, the installation of lawns and associated fertilizer and biocide applications, the removal of pervious surfaces Form FF-1 (Effective 511101) Page 12 due to home construction and associated driveways, patios and roads, and in sundry home construction and maintenance activities would result in chemical pollution and increased water run-off into the canal. The Griffin Marine Park Expansion project would eliminate these likely sources of water quality degradation to the Dania Cut-Off canal. 2. Also, providing additional access to the Dania Cut-Off Canal will enable boaters to access other nearby water-oriented parks (such as West Lake Park and Boater's Park) and waterways including the Atlantic Ocean. 4. Due to the presence of manatees and natural vegetation along the canal, the South Florida Management District has placed various regulatory requirements on use of the canal, such as Manatee Protection Zones. Thus, the control, management, and protection of on-site surface water will be a priority for the City in the management of this site. 9. On September 23, 1997, the Board of County Commissioners adopted a resolution supporting the development of a local mitigation strategy. Broward County has since established a countywide mitigation strategy which received Commission approval on March 7, 2000 (see Attachment 2). The Mitigation Strategy Initiative was developed to lessen the impacts of disasters to the residents and businesses in Broward County by reducing the number of deaths, injuries, property damage, economic losses, and human suffering. The project site has been designated a mitigation priority by the Broward County Emergency Management Division. The project was ranked and received a score of 28 out of a possible 35 points. Projects are scored based on issues such as the percentage of population benefitted, health and safety considerations, and a positive benefit to cost ratio. The project was determined to be a high priority because it will benefit a large population of the County. 3. Designated Brownfield Area. It will provide rare public opportunities for(relatively)freshwater shoreline access and fishing amenities for this part of Broward County.
