Home My WebLink AboutR-2001-143 RESOLUTION NO. 2001-143 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA APPROVING THE FIRST AMENDMENT TO THE 267H YEAR FUNDING AGREEMENT BETWEEN BROWARD COUNTY AND THE CITY OF DANIA BEACH FOR SOUTHWEST NEIGHBORHOOD BEAUTIFICATION - PHASE V, UNDER THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM, TO PROVIDE AN EXTENSION OF THE PROJECT THROUGH JANUARY 31, 2002; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the First Amendment to the 26'h Year Funding Agreement between Broward County and the City of Dania Beach for Southwest Neighborhood Beautification Phase V, under the Community Development Block Grant Program, in substantial form as Exhibit "A", attached, is approved and the appropriate city officials are directed to execute same. Section 2. . That the First Amendment to the 26" Year Funding Agreement shall provide an extenstion for completion of the project through January 31, 2002. Section 3. . That all resolutions or parts of resolutions in conflict with this resolution are hereby repealed to the extent of such conflict. Section 4. WHEREAS, the Parties entered into the Agreement providing for funding and administration of community development block grant programs; and WHEREAS, SUBGRANTEE is seeking to amend the Agreement by requesting time extension to commence and complete Project construction; and WHEREAS, the requested amendment is necessary and reasonable under the circumstances set forth above; NOW, THEREFORE, IN CONSIDERATION of the mutual terms, conditions, promises and covenants set forth, the Parties agree as follows- 1. Article 9 should be amended as follows: This Agreement shall commence upon execution by COUNTY and shall terminate on Omer 31,2001 January 31, 2002 . • 2. Exhibit C is deleted and replaced with Exhibit C-1. 3. All other terms and conditions of the Agreement not inconsistent herewith shall remain in full force and effect and are to be performed at the level specified in the Agreement.
