A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,APPROVING
A SPECIAL EXCEPTION REQUEST SUBMITTED BY VOICESTREAM
WIRELESS, FOR PROPERTY LOCATED AT 111 SE 3RDAVENUNE, DANIA
BEACH, FORA SPECIAL EXCEPTION USE TO ALLOW THE PLACEMENT
OF STEALTH ANTENNAS AND RELATED EQUIPMENT AT THE
MEADOWBROOK LAKES CONDO "B", AS PROVIDED FOR IN THE
ZONING APPENDIX, ARTICLE Vill, TELECOMMUNICATION TOWERS
AND ANTENNAS; SECTION 33-308 ZONING DISTRICTS, HEIGHT AND
SETBACK REQUIREMENTS, ETC.; PROVIDING FOR CONFLICTS;
FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Chapter 28, Zoning Appendix, Article Vlll, Telecommunication Towers
and Antennas; Section 33-308, Zoning districts, height and setback requirements, etc.
provides for Stealth towers or stealth rooftop and building mounted antennas as special
exceptions in districts zoned R-3A; and
WHEREAS, Voicestream Wireless has applied for a special exception use to allow
• the placement of stealth antennas and related equipment at 111 SE 3Id Avenue,
Meadowbrook Lakes Condo "B", in an R-3A zoning district; and
WHEREAS, the Planning & Zoning Advisory Board on August 15, 2001 made a
motion to recommended approval of the special exception request with conditions, which
failed on a 2-2 vote, based upon the criteria set forth in Chapter 28, Zoning, Article 6,
Supplementary Use Regulations, Section 6.40, Special Exception Uses, of the Code of
Ordinances of the City of Dania.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA, FLORIDA:
Section 1. That that certain application SE-33-01, for a Special Exception Use
allowing the placement of stealth antennas and related equipment at the Meadowbrook
Lakes Condo "B", Dania Beach, a copy of which is attached and made a part of this
Resolution as Exhibit "A", is approved subject to the Exhibit booklet provided with the

backup, which includes all statements outlining the criteria and methods of construction,
being made part of the record and attached to the Resolution as well as the following four
conditions:
a) Roof top utility cabinets not to exceed nine feet in height.
b) Land surveyor's confirmation of 500-foot residential setback.
c) Written confirmation from radio engineer that no more than eight antennas will be
located within the antenna enclosure.
d) Written confirmation that support equipment will be located on the roof.
Section 2. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

APPLICANT: VoiceStream Communications
Voicestream has submitted a special exception application to install six stealth antennas
and related utility cabinets on the roof of Meadowbrook Condo "B". Meadowbrook
Condo "B" is located directly south of the future Publix shopping center. Meadowbrook
"B" is zoned R-3A multi-family. Stealth antennas are allowed as a special exception
use, subject to conditions, in R-3A multi-family districts.
The proposed stealth enclosure is located on the northwest corner of the building, on
top of the stair tower. The proposed antenna. enclosure is 16' x 10', and will extend 9
feet above the stair tower. The utility cabinets are shown in the middle of the building.
The utility cabinets can extend no higher than nine feet above the roof. The utility
cabinets are connected to the antenna by a coaxial cable located on the roof of the
building. The building plans indicate an electrical conduit will be attached to the outside
of the east building elevation.
The submittal package includes the following:
1. July 5 letter of non-interference with radio, television, public safety, FAA, or other
wireless services operating in the City.
2. July 25 letter addressing co-location at existing cell sites (113 NW 1st Street or
600 East Dania Beach Boulevard - First Union Building).
3. Overview and. Justification addressing search for alternative cell locations on
public property (City Hall, Water Tower).
4. Letter addressing 500-foot residential setback.
5. Building elevations and roof site plan.
Applicant has also provided structural and wind load data (This has not been included in
your package).

In accordance with our agreement,Kimley-Horn and Associates, Inc. has reviewed
the site referenced above with regard to Section 33-308(3)(h)City of Dania Beach,
requiring a 500-foot setback to any property zoned for single-family residential use.
Our findings are based on the following:
1. Proposed antenna enclosure location atop western stairwell of building#111.
2. Real Estate Solutions Aerial &Maps Atlas 42❑d Edition 2001, Broward County
Volume 3.
3. Site visit July 11, 2001.
4. Various previous engineering and design drawings provided by the condominium
association.
This is to state, to the best of our knowledge and belief, that the proposed antennas
are in excess of 500 feet from any single-family residential zoning.

• Overview and Justification
Design and Selection of PCS Network and Sites
In order to meet the basic level of operational radio signal coverage, Voicestream radio frequency
(RF) engineers have designed a network of sites for the South Florida area. This network has
been designed for optimal and continuous coverage for the customer.
,- The applicant's RF engineers choose specific sites after lengthy analysis. Selection criteria
include: limitations imposed by surrounding topography, the intended service area of the PCS
site, and the ability of the new site to "see" other sites in the network from its proposed location.
Other selection factors include site access, availability of electrical and telephone service, and a
® willing property lessor.

Voicestream antenna sites are unmanned, passive uses having minimal impact on surrounding
properties. After the initial construction period of 10 to 15 days, traffic will be limited to routine
maintenance visits of once or twice monthly, at most. There are no activities that produce
• airborne emissions, odor, vibration, heat, glare, or noxious and toxic materials. All equipment
and materials needed to operate the site are housed within cabinets. The cabinets do not require
air conditioning and utilize interior fans, keeping noise to a minimum. Voicestream sites do not
require water or sanitary facilities and generate no waste, solid or liquid. All Voicestream
installations are required to comply with all Federal Communications Commission criteria
related to electromagnetic output and interference with existing wireless installations and
mechanical devices in the area. A copy of our FCC license is enclosed as part of this application.
Project Proposal
The subject site is located on the northwest corner of the roof of Building "B" at the
Meadowbrook Condominium complex at I I I SE 3rd Street at Dania Beach Boulevard. The
current zoning designation is R-3A. Under a recently approved Dania Beach Zoning Text
Amendment (TX-17-01), stealth antenna installations are permitted in this zone, after issuance of
a Special Exception permit. Voicestream Wireless is proposing to install a triangular tray
mounted on the top of the building. Eight antennas would then be mounted vertically onto the
tray. Each antenna is flat and is approximately 5 foot by 1 foot. For the Meadowbrook
installation, Voicestream is proposing to wrap the antenna installation in a radio-frequency
permeable stealthing material. This material would be designed to completely hide the antennas
from public view and would be designed to mirror the color and material of the existing
condominium building.

• Colocation in Commercial Corridors
Under Section 33-304 of the Dania Beach Code of Ordinances use of public property and

colocation on existing installations, is given top priority. In compliance with this requirement,

The search ring is a defined geographical area within which an installation must be located, to
serve the intended customer base. In some instances a location can be found to work just outside
this "search ring", but additional height and configuration are usually needed to accommodate for
the compromised geographical location. Only after careful analysis of many sites and successful
lease negotiations has been completed is a land use application submitted.
We had initially investigated locating along the commerically-zoned area of Federal Highway
through Dania Beach or at the Meadowbrook Square commercial center just to the north of the
condominium complex. None of the structures at these locations, provided adequate height to
install a roof-mounted installation. These sites would have required construction of 100-150 foot
monopoles and the utilization of designated parking spaces. Based on the anticipated opposition
and Dania Beach code preference for roofmounts or colocations, we did not pursue these
candidates.
Colocation on Public Property
We then investigated "colocating" our antennas on the existing city-owned tower at the Dania
' • Beach City Hall. We worked with the city to explore this option. As is common with city-
owned police towers, the Dania Beach tower was not designed to structurally accommodate
modern commercial wireless installations. We would have been required to remove the existing
tower,possibly interrupting police emergency response, and construct a new, structurally
amplified tower to accommodate our antennas. If this tower would be designed for additional
carriers, adequate space for equipment cabinets and/or equipment buildings, may prove
inadequate. Finally, after Radio Frequency investigation, it was determined that the City Hall
location would only provide 65% of the needed coverage for the area. This is due to City Hall's
location near the edge of the "search ring".
We then investigated the possibly of locating our antennas on the Dania Beach Water Tank
located at 402 SW 2nd Terrace. This location would provide the needed height for a flush-
mounted antenna system. However, the water tank has current environmental issues concerning
lead paint and would require a massive cleanup effort which would make this installation
economically unfeasible for Voicestream.
Finally, our site acquisition agent inquired about locating our antennas on the Dania Jai-Alai
facility on Dania Beach Boulevard. The site acquisition agent has confirmed that the owner will
not entertain the idea of Voicestream locating at this site.
There are no additional existing,viable, tall structures or"colocatable" antenna towers
within, or in close proximity to, our search ring.
Conclusion
This particular site was chosen as the best of many candidates for various reasons. Radio
frequency engineers have determined that the Meadowbrook site will provide the needed
coverage based on elevation, "line of sight" and geographic location. Land Use Planners have
determined that the location of these antennas at an existing high-rise structure, will allow a
completely hidden roof-mounted antenna installation and remove the need for a new monopole in
this area. Voicestream believes this new use will not result in any land use impact to the area,
but will provide a needed service in the form of wireless communication for the residents,
businesses and emergency response operations of Dania Beach.
Based on the above information, Voicestream Wireless believes the Special Exception findings
can be made for the antenna installation.
It is respectfully requested that the City of Dania Beach make the appropriate findings and
approve this project.

"(d) EXCEPTtONs.—Nothing in this section prohibits a tele-
communications carrier from using, disclosing, or permitting access �n,.
to customer proprietary network information obtained from its cus-
tomers,either directly or indirectly through its agents—
' "(1) to initiate, render, bill, and collect for telecommuni-
cations services;
"(2) to protect the rights or property of the carrier, or
to protect users of those services and other carriers from fraudu-
lent, abusive, or unlawful use of, or subscription to, such serv-
ices; or
"(3) to provide any inbound telemarketing, referral, or
administrative services to the customer for the duration of
the call, if such call was initiated by the customer and the
customer approves of the use of such information to provide
such service.
"(e) SUBSCRIBER LIST INFORMATION.—Notwithstanding sub-
sections (b), (c), and (d), a telecommunications carrier that provides
telephone exchange service shall provide subscriber list information -
gathered in its capacity as a provider of such service on a timely
and unbundled basis, under nondiscriminatory and reasonable
rates, terms, and conditions, to any person upon request for the
purpose of publishing directories in any format
"(f) DEFINITIONs.—As used in this section:
"(1) CUSTOMER PROPRIETARY NETWORK INFORMATION.—The
term'customer proprietary network information'means—
"(A) information that relates to the quantity, technical
. configuration, type, destination, and amount of use of a
telecommunications service subscribed to by any customer
of a telecommunications carrier, and that is made available
to the carrier by the customer solely by virtue of the
carver-customer relationship; and
"(B) information contained in the bills pertaining to
telephone exchange service or telephone toll service
received by a customer of a carrier;
except that such term does not include subscriber list informa-
tion.
"(2) AGGREGATE LZIFOMMATION.—The term 'aggregate cus-
tomer information' means collective data that relates to a group
or category of services or customers, from which individual
customer identities and characteristics have been removed.
"(3) SUBSCRIBER LIST INFO RsLA=N.—The term 'subscriber
list information'means any information—
"(A) identifying the listed names of subscribers of a
carrier and such subscribers' telephone numbers,addresses,
or primary advertising classifications (as such classifica-
tions are assigned at the time of the establishment of
such service), or any combination of such listed names,
numbers, addresses, or classifications; and
'(B► that the carrier or an af'ftliate has published,
caused to be published, or accepted for publication in any
directory format.'.
SEC.703.POLE ATTACH-NtE.YTS.
Section 224 (47 U.S.C. 224) is amended—
(1) in subsection (axl), by striking the first sentence and
inserting the following: "The term -utility, means any person

steam, or other public utility, and who owns or controls poles,
ducts, conduits, or rights-of-way used, in whole or in par,,
for any wire communications.".
(2) in subsection (aw by inserting after "system"
following "or provider of telecommunications service"; the
(3) by inserting after subsection (a)(4) the following:
"(5) For purposes of this section, the term 'telecommuni-
cations carrier' (as defined in section 3 of this Act) does no
include any incumbent loca, exchange carrier as defined i t

section 251(h).";
(4) by inserting after "conditions" in subsection (c)(1) a
comma and the following: "or access to poles, ducts, conduits,
and rights-of-way as provided in subsection(f),";
(5) in subsection (c)(2XB), by striking°cable television sere.

date of enactment of the

telecommunications services, when the parties fail to resolve a
dispute over such charges. Such regulations shall ensure that a
utility charges just, reasonable, and nondiscriminatory rates for
pole attachments.
"(2) A utility shall apportion the cost of providing space one
a pole, duct, conduit, or right-of-way other than the usable space
among entities so that such apportionment equals two-thirds of
the costs of providing space other than the usable space that would
be allocated to such entity under an equal apportionment of such
costs among all attaching eatities.
"(3) A utility shall apportion the cost of providing µsable space
among all entities according to the percentage of usable space
required for each entity.
Erreedve data. "(4) The regulations required under paragraph (1) shall become ;
effective 5 years after the date of enactment of the TeIecommuni-
cations Act of 1996. Any increase in the rates for pole attachments
that result from the adoption of the regulations required by this
subsection shall be phased in equal annual increments over a
period of 5 years beginning on the effective date of such regulations.
"(f)(1) A utility shall provide a cable television system or any
telecommunications carrier with nondiscriminatory access to any
pole, duct, conduit,or right-of-way owned or controlled by it.
"(2) Notwithstanding paragraph (1), a utility providing electric
service may deny a cable television system or any telecommuni-
cations carrier access to its poles, ducts, conduits, or rights-of-

' "(g) A utility that enga;es in the provision of telecommuni-
cations services or cable services shall impute to its costs of provid-
ing such services (and charge any affiliate, subsidiary, or associate
company,engaged in the provision of such services) an equal amount
to the pole attachment rate for which such company would be
o liable under this section.
"(h) Whenever the owner of a pole, duct, conduit, or right-
of-way intends to modify or alter such pole, duct, conduit, or rignt-
of-way, the owner shall provide written notification of such action
to any entity that has obtained an attachment to such conduit
or right-of-way so that-such entity may have a reasonable oppor.
tunity to add to or modify its existing attachment. Any entity
that adds to or modifies its existing attachment after receiving
such notification shall bear a proportionate share of the costs
incurred by the owner in making such pole, duct, conduit, or right•
of-way accessible.
"(i) An entity that obtains an attachment to a pole, conduit,
or right-of--way shall not be required to bear any of the costs
of rearranging or replacing its attachment, if such rearrangement
or replacement is required as a result of an additional attachment
or the modification of an existing attachment sought by any other
entity (including the owner of such pole, duct, conduit, or right-
of-way).".
SEC. 704. FACILITIES SITING; RADIO FREQUENCY EMISSION STMIM.
ARDS.
(a) NATIONAL WIRELESS TELECOMMUNICATIONS SITING POL.
ICY.—Section 332(c) (47 U.S.C. 332(c)) is amended by adding at
the end the following new paragraph: __

"(B)LIMITATIONS.—
"M The regulation of the placement, construction,
and modification of personal wireless service facilities
by any State or local government or instrumentality
thereof—
"(I) shall not unreasonably discriminate among
providers of functionally equivalent services; and --
"M) shall not prohibit or have the effect of
prohibiting the provisioa of personal wireless serv-
ices.
"(ii)A State or local government or instrumentality
thereof shall act on any request for authorization to
place, construct, or modify personal wireless service
facilities within a reasonable period of time after the
request is duly filed with such government or
instrumentality, taking into account the nature and
scope of such request.
"(iii) Any decision by a State or local government Remrds.

shall be in writing and supported by substantial evi-

"(i) the term 'personal wireless services' means
commercial mobile services, unlicensed wireless serv-
ices, and common carrier wireless exchange access
services;
"(ii) the term 'personal wireless service facilities'
means facilities for the provision of personal wireless
services; and
"(iii) the term 'unlicensed wireless service' means
the offering of telecommunications services using duly
authorized devices which do not require individual
' licenses, but does not mean the provision of direct-
to-home satellite services (as defined in section
Ues. (b) RADIO FREQUENCY E.rclssloxs.—Within 180 days after the
enactment of this Act, the Commission shall complete action in

the environmental effects of radio frequency emissions.
President (c) AVAILABILITY OF PROPERTY.—Within 180 days of the enact-

be charged to providers of such telecommunications services for
use of property, rights-cf•way, and easements. The Commission
shall provide technical support to States to encourage them to
make property, rights-of-way, and easements under their jurisdic-
tion available for such purposes.

VoiceStream Wireless system transmits in the E&F frequency bands as defined by the FCC (1965 - 1975
MHz).
By transmitting only in the designated spectrum VoiceStream will not cause interference to any other
Communication Carrier or Emergency Communications facilities. The frequency range and the power
levels of the Base Station are 500 to 600 W EIRP, well below the maximum of 1640 W EIRP outlined in
' the PCS FCC Rule Part 24. Exposure in the near field (defined as less than 10 Meters directly in front of
the antenna)of a PCS site is less than 1 microW/cm2, again, below the established standards.
The entire VoiceStream installation including the antennas are well within the most conservative safety
recommendations of the National Council on Radiation Protection and Measurement (NCRP), the
Institute of Electrical and Electronic Engineers(IEEE), the American National Standards Institute
' (ANSI)and therefore meet all FCC safety rules for PCS transmission standards including the Non-

VoiceStream Wireless transmits in the E&F PCS frequency band as defined by the FCC(1965-1975 MHz).
The power levels of the proposed base station installation will not exceed 1640 W EIRP,the power level outlined in the PCS FCC
Rule Part 24. Typical General Public Exposure in the near field(defined as less than 10 Meters directly in front of the antenna)of a
PCS site is less than I uW/cm2,again,below the established standard of 1 mW/cm2. At the present time, VoiceStream is in the
process of annually measuring our RF Electro-Magnetic Energy on both towers and building installations.Presently all tower and
building locations were we have antennas have not exceeded the FCC Uncontrolled/Controlled Environment Maximum Permissible
posure level. In the case that such situation arises and VoiceStream was transmitting at levels above the FCC Uncontrolled/
ntrolled Environment MPE levels,VoiceStream would initiate our RF Energy Safety and Health policies and procedures programs
to remedy the situation.

VoiceStream's PCS system design has determined that a site is required near 3rd Ave. and Dania Beach Blvd. in the Broward County
region for the following reasons:
o Provide enhanced coverage to the City of Dania.
' O Provide In-car and/or In-building coverage along US1, Dania Beach Blvd. and surrounding roadways.
® Allow all VoiceStream customers in the region to make and complete a call at the highest quality level attainable.
A search ring was defined by RF Engineering and provided to Site Acquisition to conduct a search for strictures where we may be able
to collocate with another Carrier. In the event that site acquisition can't find a suitable co locatable site then the search will include
Raw Land sites and rooftops. In total,3 candidates(including the site FB 1043F Meadowbrook Condo)were reviewed.
ere were two antenna facilities identified by the city of Dania, one was the northwest corner of NW I". Street and NW I'`.Avenue
ower)and the second was 600 Block of Dania Beach Boulevard(First Union Bank Building—Rooftop Stealth Facility. These
locations are approximately 0.5 mile north from the search ring. They do not provide the needed In-Building coverage for the South
and South-East area.
VoiceStream RF Engineering decided to use candidate FB1043F as a suitable candidate. This location is very important for
VoiceStream coverage objectives both to provide In-building penetration and In-car coverage along such important roads like US1 and
Dania Beach Blvd. The antennae will be mounted on top of the penthouse, as follows:

prediction of the signal levels in dBm that will exist in the indicated geographical areas with and without the candidate site. The
design criteria adopted by VoiceStream are the following:
A signal level of-70 dBm or greater(represented by the color red in the plots) is required for a high probability of providing a
mobile telephone service within industrial buildings.
' A signal level of-76 dBm or greater(represented by the color yellow in the plots) is required for a high probability of
providing a mobile telephone service within residential buildings.
A signal level of-85 dBm or greater(represented by the color green in the plots) is required for a high probability of
providing a mobile telephone service within cars and a low probability of providing a mobile telephone service within
buildings.
' Our design model showed that the inability to locate on Meadowbrook Condo site would be unfavorable for our coverage footprints
affecting the In-Building and In-Car coverage levels in city of Dania.Not only would this impact the level of service that VoiceStream
' offers its subscribers,but it will also render a mobile phone useless at the time of an emergency.
In my expert opinion, as an RF Engineer applying sound RF engineering principles to VoiceStream's technology,design and
engineering requirements,this site is necessary to provide VoiceStream's customers with a sufficient level of service to comply with
the minimum engineering requirements for its networks and is essential to completing it's coverage and service needs within this
community.
