HomeMy WebLinkAboutR-2001-157 RESOLUTION NO. 2001-157 A RESOLUTION OF THE CITY OF DANIA BEACH,APPROVING THE VARIANCE REQUEST SUBMITTED BY THE SOUTH FLORIDA MUSEUM OF NATURAL HISTORY, FROM CHAPTER 28 ZONING,ARTICLE 28 SIGNS, FOR PROPERTY LOCATED AT 481 SOUTH FEDERAL HWY., DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28 Zoning, Article 28 Signs, sets the signage criteria for the City of Dania Beach; and WHEREAS, The South Florida Museum of Natural History has applied for a variance (VA- 38-01) to allow for the following: Chapter 28, Zoning Article 28 Signs,Article 28.110-Restrictions in Areas Zoned Commercial- 1) Variance to allow a 110 square foot wall sign on SE 4th Terrace; (106 square feet allowed). 2) Variance to allow a five-foot high wall sign SE 4th; (4.4-foot high wall sign allowed). Chapter 28, Zoning Article 28 Signs, Article 28.180 - Monument Sign - • 3) Variance to allow a pole sign (pole sign prohibited). See also section 28.060 (29) 4) Variance to allow 50 square foot monument sign (maximum 42 square feet permitted). 5) Variance to allow 16-foot high monument sign (maximum seven foot height permitted). 6) Variance to allow 16 square foot electronic message board; (Electronic message board prohibited). See also section 28.060 (29). for property located at 481 South Federal Hwy., Dania Beach; and WHEREAS, the Planning &Zoning Board on August 15, 2001, recommended that the City Commission grant variance request VA-38-01 based upon the criteria set forth in section 10.13 of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE,'BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-38-01, for a variance as described above (from • requirements in Chapter 28 Zoning, Article 28 Signs), a copy of which is attached as Exhibit"A", is r-va-38-01 so fla museum sign variance.doc 1 RESOLUTION NO.2001-157 approved for all six variances subject to the following conditions: i a) No additional permanent wall signs, b) Changeable banner signs permitted to remain, and c) Pole sign to be setback so as to provide adequate corner clearance for vehicles turning onto Federal Highway from SE 5th Street (6 to 10 foot sign setback from Federal Highway). Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. The applicant has submitted a wall sign application consistent with code and is in the process of obtaining a permit. Pole Sign: Variances to allow a freestanding pole sign with the following variances: 1. Variance to allow a pole sign (pole sign prohibited). 2. Variance to allow a 50 square foot sign (maximum 42 square foot permitted). 3. Variance to allow a 16-foot high monument sign (maximum 7 foot height permitted). 4. Variance to allow a 16 square foot electronic message board (Electronic message board prohibited). The museum has requested the above four variances to construct a pole sign as indicated in the attached drawings. Variances 1, 2, and 3 can be supported based upon the floor area of the museum, the total land area of museum properties, the length of the museum building (building frontage), and the uniqueness of the use. Also, that portion of the sign depicting the dinosaur, if separated from rest of the sign, would be considered a "super graphic", and therefore not subject to sign area limitations.
