HomeMy WebLinkAboutR-2001-165 RESOLUTION NO. 2001-165 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, ESTABLISHING THE CITY'S POLICY ON BRIDGES, UTILITY CROSSINGS OR ANY OTHER STRUCTURES AFFECTING NAVIGATION ON THE WATERS WITHIN THE CITY OF DANIA BEACH AND NOTIFYING PERMITTING AGENCIES OF SUCH POLICY AND REQUESTING NOTIFICATION AND INCLUSION IN ANY SUCH CONSIDERATIONS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach has miles of waterways crossed by a number of fixed bridges and utility crossings; and WHEREAS, the south end of the Broward County's historic New River loop is primarily made up of the Dania Cut-off Canal system; and WHEREAS, the canal system has over 37 significant marine facilities as well as hundreds of waterfront residences in this canal system that are crossed by numerous . fixed low bridges; and WHEREAS, the current system of excessively low bridges limits navigation and recreational opportunities as well as Broward County's marine industry, tax base, and marine refuge for coastal hurricanes. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City of Dania Beach requests that all permitting agencies and utility operators make every effort when replacing such overhead canal structures that the new structures be further elevated to enhance navigation and that Dania Beach be notified and included in any considerations for such bridge or utility projects; and Section 2. The City Clerk is hereby directed to forward a copy of the Resolution to all relevant permitting agencies. 1 RESOLUTION NO. 2001-165 Section 3. Commercial Boulevard, Ft. Lauderdale, Florida 33309-3421, for approval of location and plans to modify the existing low-level, fixed railroad bridges across navigable waterways of the United States. W aterwav and Location: The Dania Cut-Off Canal, mile 3.6 (5.6km) at Dania, Broward County, Florida. Project Description: In 1988 the FDOT purchased the Seaboard System Railroad (CSC ) corridor (South Florida Rail corridor) from Miami Airport to West Palm Beach, Florida. Tri-County Commuter Rail Authority (Tri-Rail), CSXT Freight Service and Amtrak passenger trains are all currently using this corridor. The Federal Transit Administration (FTA) and FDOT propose double track corridor improvements to reduce congestion and scheduling conflicts among the three users. The proposed project consists of the installation of a second mainline of track 44.31 miles long, parallel to the existing rail line. Within the rail corridor there are 13 locations where bridge construction is proposed. However, only the Dania Cut-Off Canal badge crossings will required a Coast Guard bridge permit. There are two bridges crossing the canal. The bridge on the east side will be removed and replaced with a new bridge carrying the double track for train traffic. Existing train traffic will remain on the west structure during construction and will be rerouted onto the new east bridge so that repairs could be made on the existing west structure. The overall length of the new bridges will be 179.75 feet (53.57m) between end bents. Both bridges will have an out to out width of 20 feet (6.09m) consisting of a 4.69 feet track in each direction. All parts of the existing bridges not utilized in the modified bridges will be removed. The environmental documentation is available for review in the office of the Commander (obr), Seventh Coast Guard District, Brickell Plaza Federal Building, Room 406, 909 Southeast 1 st Avenue, Miami, Florida 33131, Monday through Friday from 7:30 a.m. to 5:30 p.m. The project is considered an encroachment, but not a significant encroachment on the 100-year floodpla.in, The 100-year flood elevation is 7.0 feet above mean sea level, while elevation of the low member of the bridge over the Dania Cut-Off Canal is 12.21 feet above mean sea level. Modification of the existing bridges across the Dania Cut-Off Canal will not affect desirable wetland communities or critical wildlife habitat. Impacts will be restricted to the open water portions of the canal and the riparian fringe of the canal slopes. Dominant vegetation consists of Brazilian pepper (Schinus terebinthifolius). The South Florida Water Management District (SFWMD) concluded that all affected jurisdictional areas (ditches and canals) are classified as "other surface water" pursuant to Chapter 62-340 F. A. C. The U. S. Army Corps of Engineers has stated that the proposed project may not require a permit under Section 404 criteria. Both the SF�%'NID and the Corps have indicated that impacts to surface waters will not require mitigation. The proposed project will have no adverse affect on wetlands in the project vicinity. • The bridge project is located in Florida's designated coastal zone. The FDOT has made application to the South Florida Water Management District for water quality certification and coastal zone consistency certification. The project would not take land from nor significantly effect any parks, recreation areas, wildlife or waterfowl refuges, historic, or archaeological sites. The proposed bridge project will have no impact on minority and low-income populations and is in compliance with Executive Order 12898 on Environmental Justice. Comments: Our final decision about whether to issue or deny a permit for the proposed bridge project will be based on the effects of the project on navigation and the environment. Interested agencies, organizations, and individuals are invited to express their views, in writing, giving specific reasons for support of, or opposition to, the work. We especially encourage comments ,�n the adequacy of the proposed clearances, the need for a fender system, and the need for navigational lighting. Boat owners in the project vicinity are requested to provide information a'rout their vessels including type of vessel, length overall, draft, beam, and height from the ,waterline to the highest fixed point and to appurtenant structures (e.g. tuna towers, flying bridges, nixed antennas and radar units).
