A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA APPROVING
THE VARIANCE REQUEST SUBMITTED BY ANTHONY AND BENNIE MAE
MOULTRY, FROM CHAPTER 28, "ZONING", ARTICLE 4, "SCHEDULE OF
LOT, YARD AND BULK REGULATIONS", FOR PROPERTY LOCATED AT
220 SW IITH AVENUE, DANIA BEACH; PROVIDING FOR CONFLICTS;
FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 4,
"Schedule of lot, yard and bulk regulations", prescribes the setback and lot coverage requirements
within the RS-6000 zoning district in the City of Dania Beach; and
WHEREAS,Anthony and Bennie Mae Moultry are requesting a variance associated with the
proposed construction of two (2) carports at a single family home located at 220 SW I Ith Avenue
and have applied for a variance(VA-80-06)from Chapter 28,"Zoning",Article 4, "Schedule of lot,
yard and bulk regulations", to allow:
1) A two(2)foot front yard setback(Chapter 28,"Zoning",Article 4,"Schedule of Lot,
yard and bulk regulations"requires a minimum of 25 foot front yard setback in a RS-
6000 zoning district);
2) A 2.42 foot south side yard setback. (Chapter 28, "Zoning",Article 4, "Schedule of
Lot,yard and bulk regulations" requires a minimum of 7 foot side yard setback in a
RS-6000 zoning district); and
3) 56% of lot coverage. (Chapter 28, "Zoning", Article 4, "Schedule of Lot, yard and
bulk regulations", allows a maximum 40% lot coverage in a RS-6000 zoning
district);
and
WHEREAS,the Planning&Zoning Board on November 15,2006,recommended approval
of the variance request with the condition that the request be modified "to allow a canvas carport
constructed of material consistent with Florida Building Code standards",based upon the criteria set
forth in Chapter 28,"Zoning",Article 4,"Schedule of lot,yard and bulk regulations",of the Code of
Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-80-06, from requirements in Chapter 28,
"Zoning",Article 4, "Schedule of lot,yard and bulk regulations",of the City Code of Ordinances is
approved with the condition that the two carports will not be enclosed to turn them into a garage.
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

SUBJECT: VA-80-06: The applicant, Anthony Moultry is
requesting a variance for the installation of two
carports at 220 S.W. IIth Avenue, Dania Beach,
Florida.
VARIANCE: Installation of two carports:
a) Setback 2.0 feet from the front lot line (25 feet
required).
b) Setback 2.42 feet from the south lot line and 5.5 feet
from the north lot line (7 foot setback required on
each side).
c) Increase in lot coverage to 56% (47% permitted on
based on existing building coverage).
PROPERTY INFORMATION:
ZONING: Single Family (RS-6000)
LAND USE DESIGNATION: Low Residential (L-5)
The home is located in a residential neighborhood south of Stirling Road and
west of Phippen Road. The front yard of the home faces east toward the
intersection of SW 2"d Terrace and SW 11th Avenue.
Carports are defined as a structure in the Zoning Code and as such, must
comply with single family setback requirements. The applicant desires to
construct two carports in the required front yard. Each carport encroaches
into a required 7 foot side yard. Both carports encroach into the 25 foot
front yard and are setback two feet from SW 11th Avenue. Building material
appears to be wood or concrete block, with the roof of each carport
matching the house.
PLANNING AND ZONING BOARD RECOMMENDATION:
On November 15, 2006 the Planning and Zoning Board recommended the
installation of two "canvas covered" carports in lieu of two permanent
carport structures.
STAFF RECOMMENDATION:
Historically, staff has not supported carports within single family front yards.

During hurricane Katrina, we encountered devastating damage to both of our cars by
fallen debris.
I am applying for a variance in order to install a carport and a swale. The carport will
help protect our home and cars, the swale will beautify our home as well our
neighborhood. Our property will increase in value where by more revenue for the city of
Dania will be enhanced.
Enclosed is a check in the amount of$500.00 dollars for the variance fee.
