HomeMy WebLinkAboutR-2001-182 ® RESOLUTION NO. 2001-182 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA AUTHORIZING THE ACTING CITY MANAGER TO CONTRACT FOR THE PURCHASE OF ENGINEERING SERVICES RELATING TO A PROPOSED FISHING PIER RESTAURANT BUILDING IN AN AMOUNT NOT TO EXCEED $25,000 WITH EDC CORP (ENVIRONMENTAL DEVELOPMENT CONSULTANTS CORPORATION), WITHOUT COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT FOR BIDS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection 0), provides that during unusual conditions or emergencies, the city commission may, by resolution, authorize the purchase by the city manager of designated supplies, services, equipment and materials in amounts in excess of fifteen thousand dollars ($15,000.00) without competitive bids and without advertisement for ® bids; and WHEREAS, the Acting City Manager has determined that it is necessary to purchase Engineering Services in connection with the design of a restaurant proposed to be located on the Dania Beach Pier; and . WHEREAS, the Acting City Manager has determined that such purchases can be made at the least cost to the City from EDC Corp (Environmental Development Consultants Corporation) in an amount not to exceed $25,000.00; and WHEREAS, the City Commission has determined that unusual conditions are present in connection with the pier restaurant project, due to the lengthy delays experienced by the City in proceeding with the project; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: 1 RESOLUTION NO. 2001-182 Section 1. That the Acting City Manager is hereby authorized to pay an amount not to exceed $25,000.00 from the general fund to EDC Corp (Environmental Development Consultants Corporation) for the purchase Engineering Services in connection with the design of a restaurant proposed to be located on the Dania Beach Pier. Section 2. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. That this resolution shall be in force and take effect immediately upon its passage and adoption. Section 3. A detail of services and fees is attached. Payment shall be made to EDC Corporation upon receipt of an invoice. Invoices not paid within thirty (30) days and not in dispute are subject to a monthly interest charge of 1.5 percent of the outstanding balance due. Invoices outstanding over ninety (90) days are subject to collection proceedings. The Owner is responsible for all collection costs, including attorney's fees, whether or not a suit is commenced or an appeal is taken. If you wish for us to provide the services outlined herein, please prepare a purchase order, which will serve as our authorization to proceed. CCCL&MT EDC will coordinate with the project team to obtain all required surveys, $3,000 Permit architectural / structural / civil plans and details, Ownership information, Permit Applications Fees, and Authorizations required for the CCCL Permit Application. • EDC will coordinate with the project team to obtain all required exterior lighting plans and details required for the MT Permit Application. • EDC will prepare and submit the required CCCL and MT permit application package to DEP. 2. Pre-Application • EDC will attend one (1) Pre-Application meeting with DEP in Tallahassee to $3,000 Meeting with introduce staff to the project, discuss the proposed siting and design as they DEP relate to DEP-CCCL permitting. • EDC will prepare a Conference Report documenting all discussions with staff. This report will be submitted to the Client and to DEP and shall become the basis for the working drawings. 3. CCCL&MT 0 EDC will establish and maintain telephone contact with DEP staff to expedite $ 15,000 Permit their review and approval of the CCCL and MT Permit Applications for this Processing project. Y EDC will coordinate with the Owner and/or project team relative to additional items, questions or revisions that may be required by DEP for either the CCCL or MT Permit Application. Y EDC will respond to all of the DEP's requests for additional information relative to the proposed project. • EDC may attend one (1) meeting in Tallahassee with staff to review details of the project and resolve any outstanding issues relative to expediting CCCL&MT approvals for the proposed project. 4. Notice To • EDC will process final construction plans with the DEP towards obtaining a $3,750 Proceed Notice to Proceed with construction. • EDC may attend one (1) additional meeting with DEP staff in Tallahassee to review final project plans and details relative to expediting issuance of a Notice to Proceed with construction for this project. • EDC will coordinate and attend one (1)on-site Pre-Construction conference, as required. 5. Additional 0 EDC may attend additional meetings with the DEP not included within the scope Hourly, Services of services outlined above.
