HomeMy WebLinkAboutR-2001-237 10 RESOLUTION NO. 2001-237 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA AWARDING THE BID FOR STREET RESURFACING TO WEEKLEY ASPHALT IN THE AMOUNT OF $736,305.00-1 AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN AGREEMENT WITH WEEKLEY ASPHALT PAVING, INC. AND THE CITY OF DANIA BEACH FOR STREET RESURFACING IMPROVEMENTS AT VARIOUS LOCATIONS WITHIN THE CITY OF DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection (J), authorizes that contracts for the purchase of supplies, services, equipment and materials for the city government in excess of fifteen thousand dollars ($15,000.00) shall not be entered into or let except by authorization and approval of the city commission, after advertisement for bids in a newspaper published in Broward County, Florida, with such publication to be published weekly for two (2) consecutive weeks with the first publication to be not less than fifteen (15) days prior the reception of bids; and WHEREAS, in order to reduce maintenance costs and provide better level of service, the City of Dania Beach has been working to resurface streets in the City, and WHEREAS, bids and specifications for street resurfacing were advertised and received on November 19, 2001; and WHEREAS, the city manager has determined, after review of the bids received, that such purchase can be made at the least cost to the city by awarding the bid to Weekley Asphalt in the amount of Seven Hundred Thirty-Six Thousand, Three Hundred Five and 00/100 dollars ($736,305.00); NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the contract and bid documents received from Weekley Asphalt in the amount of $736,305.00 for labor and materials necessary to complete the 1 RESOLUTION NO. 2001-237 street resurfacing within the City of Dania Beach, in substantial form as Exhibit "A", • attached, is approved and the appropriate city officials are authorized to execute it. Section 2. That the City Manager is authorized to pay Weekley Asphalt an amount not to exceed $736,305.00 from the Utility Public Works Budget. Section 3. That the City Manager and City Attorney are authorized to make minor revisions to such Agreement as are deemed necessary and proper for the best interests of the City. Such Agreement and award of the bid shall not be deemed accepted by the City unless and until the City has completed its execution of the Agreement. Section 4. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 5. WITNESSETH: The parties hereto, for the considerations hereinafter set forth mutually agree as follows: Article 1. Scope of Work: The CONTRACTOR shall furnish all labor, materials, and equipment and perform all work in the manner and form provided by the attached Bid Documents, for the construction of: 2001-2002 ROAD RESURFACING FOR DANIA PW 01-02 Article 2. The Contract Sum: The CITY shall pay to the CONTRACTOR, for the faithful performance of the Contract, in lawful money of the United States of America, and subject to additions and deductions as provided in the Contract Documents, as follows: • Based upon the Unit Price shown in the Proposal heretofore submitted to the CITY by the CONTRACTOR, a copy of said Proposal being a part of these Contract Documents, the aggregate amount of this Contract (obtained by the application of such Unit Prices to the quantities shown in the Proposal) being the sum not to exceed U.S.Dollars $736,305.00 (actual quantities and corresponding total amount payable under the contract to be set by City based upon unit price set forth in the bid) Article 3. Partial and Final Payments: In accordance with the provisions fully set forth in the "General Conditions" of the "Specifications and subject to additions and deductions as provided, the CITY shall pay the CONTRACTOR as follows: a) On a monthly basis, the CITY shall make partial payments to the CONTRACTOR on the basis of a duly certified and approved (by City Utilities/Public Works Director) estimates of work performed during the • preceding calendar month by the CONTRACTOR, less ten percent (10%) of the amount of such estimate which is to be retained by the CITY until all work has been performed strictly in accordance with the Agreement and until such work has been accepted by the CITY. 5/92 EXHIBIT "Ale b) Upon submission by the CONTRACTOR of evidence satisfactory to the CITY that all payrolls, material bills and other costs incurred by the CONTRACTOR in connection with the construction of the WORK have been paid in full, and also, after all guarantees that may be required in the Specifications have been furnished and are found acceptable by the CITY, final payment on account of this Agreement shall be made within sixty (60) days after completion by the CONTRACTOR of all work covered by this Agreement and acceptance of such work by the CITY. Article 4. Time of Completion: Throughout the year, the City will provide a "Notice to Proceed" with a list of roads and other areas to be paved. The Contractor shall commence work on said list within 10 days of the date of each notice. Work shall be done in a timely manner and each street or other area must be completed before Contractor moves to another location or area of work. Article 5. THE REPORT SHALL INCLUDE A PENETRATION TEST ON THE ASPHALT(GRADE 60- 70); A LOS ANGELES ABRASION TEST ON THE COARSE AGGREGATE AND ALL TEST PROPERTY CURVES OUTLINED BY THE MARSHALL METHOD COST OF THIS REPORT SHALL BE PAID BY THE CONTRACTOR. THE MATERIAL AND CONSTRUCTION OF THE ASPHALT SURFACE SHALL CONFORM WITH APPLICABLE SECTIONS OF T14E LATEST EDITION OF THE FLORIDA D.O.T. SPECIFICATIONS FOR TYPE III ASPHALT. • m. MINIMUM JOB MINIMUM JOB SIZE TO BE ORDERED PURSUANT TO THIS CONTRACT WILL 13L FIFTY(50)TONS. 4 INSTALLER'S INSURANCE REQUIREMENTS Proof of the following insurance will be furnished by the successful bidder's installer to the City of Dania Beach by Certificate of Insurance within ten (10) days of notification of award. Such Certificate must contain a provision for notification to the City thirty (30) days in advance of any material change in coverage or cancellation. The City of Dania Beach shall be named as an additional insured under the general liability policy including product liability. The bidder will provide complete copies of any insurance policy for required coverage within seven (7) days of the date of request by the Purchasing Division. In addition, the bidder shall be responsible for any policy deductibles and self-insured retentions. 1. General liability insurance, including products, complete operations and blanket contractual liability with bodily injury limits of not less than $1,000,000.00 per occurrence combined single limit for bodily injury and property damage. 2. Auto liability insurance with limits not less than $500,000.00 per occurrence for bodily injury and property damage for owned, hired and non-owned vehicles. J. Workers' Compensation and Employers' Liability Insurance with a limit of $500,000.00 with not less than $100,000.00 per occurrence. Weekly Asphalt is a • well known established company and should have no problems completing the work we need done. We are requesting spending authority of $700,00.00 to resurface the roads in the newly annexed area and to finish the service alleys that are badly in need of resurfacing. This amount includes the $500,000.00 the County will give us to do this work and $200.000.00 from our gas tax money which has already been budgeted.
