HomeMy WebLinkAboutR-2001-238 RESOLUTION NO. 2001-238 A RESOLUTION OF THE CITY OF DANIA BEACH,APPROVING THE VARIANCE REQUEST SUBMITTED BY THE CITY OF DANIA BEACH, FROM CHAPTER 28, ZONING, ARTICLE 6.21 SUPPLEMENTARY USE REGULATIONS, SCHEDULE OF OFF STREET REQUIREMENTS AND ALSO,A VARIANCE FROM CHAPTER 26,VEGETATION,ARTICLE IV LANDSCAPING,FOR PROPERTY LOCATED AT 803 NW 1ST STREET, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28 Zoning,Article 6.21, sets the parking requirements for the City of Dania Beach; and WHEREAS, the Dania Beach Code of Ordinances, Chapter 26, Vegetation, Article, IV Landscaping sets the Landscape requirements for the City of Dania Beach; and WHEREAS, The City of Dania Beach and Broward Sheriff's Office has applied for a variance (VA-58-01) to allow for 1) A Generalized landscape variance, in order to comply with CPTED (Community Policing Through Environmental Decision) requirement.. 2) A Parking variance to allow nine parking spaces (18 spaces required)for public safety and community offices; for property located at 803 NW 1s' Street, Dania Beach; and WHEREAS, the Planning &Zoning Board on November 28, 2001, recommended that the City Commission grant variance request VA-58-01 based upon the criteria set forth in section 10.13 of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-58-01, for a variance as described above (from requirements in Chapter 28, Zoning and Chapter 26, Vegetation), a copy of which is attached as Exhibit "A" is approved. Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. ANS RO CITY ATTORNEY R-VA-58-01-BSO.doc 2 RESOLUTION NO.2001-238 NOTICE OF PUBLIC HEARING ® CITY OF DANIA BEACH NOTICE IS HEREBY GIVEN that public hearings will be held on the following dates: Dania Beach Planning and Zoning Advisory Board Date: November 28, 2001 Time: 7:00 p.m., or as soon thereafter as possible Dania Beach City Commission Date: December 11, 2001 Time: 7:00 p.m., or as soon thereafter as possible The meetings will be held in the Dania Beach City Commission Room, Administrative Center, 100 West Dania Beach Blvd., Dania Beach, Florida 33004, for the purpose of hearing any comments that might be made to the following request: Request by the City of Dania Beach for property located at 803 NW is' Street, Dania Beach for the following: 1) RZ-57-01 - Change in zoning from RD-6000 (Duplex) to OS (Open Space and Local Government). 2) SP-04-01 - Site Plan to Expand and Convert Existing Multi-Family Residential Building to a Public Safety/Local Government Community Facility. ® 3) VA-58-01 - Generalized landscape variance, in order to comply with CPTED (Community Policing Through Environmental Decision) requirement.. 4) VA-58-01 - Parking variance to allow nine parking spaces (18 spaces required) for public safety and community offices. C1ft FROM: Laurence Leeds, AICP, Director Growth Management Department DATE: December 11, 2001 SUBJECT: Rezoning (First Reading), Site Plan, Landscape Variance, and Parking Variance to Expand and Convert and Existing Apartment Building into a Public Safety/Community Center (803 NW 1 st Street) APPLICANT: Broward Sheriff's Office/City of Dania Beach The above approvals are necessary to allow the conversion of a vacant one- story apartment building to a BSO Substation and City Community Center. The ® building is located on the southwest corner of NW 1st Street and NW 8th Avenue, across the street from Modelo Park. Rezoning from RD 8000 (Duplex) to OS (Open Space and Local Government). The zoning change is required to allow the conversion of the apartment building to local government use. Please note both City Hall and the Fire Station are currently zoned OS. Because the zoning change requires two readings, second and final reading of the rezoning will be scheduled for January 8, 2002. Commission action on the site plan and variances are effective subject to final approval of the rezoning on January 8. Site Plan: The site plan includes interior renovation for a BSO substation, city offices, and the addition of a 990 sq. ft. community meeting room. The community meeting room and city offices will have access off NW 8th Street. A separate, secure entrance for persons in custody will be provided off NW 8th Avenue. A vinyl coated chain link fence will surround the entire facility. Landscape Variance: Landscaping has been provided consistent with CPTED ("Crime Prevention Through Environmental Design') Principals. Two existing trees located along NW 8th Avenue will be removed to allow for handicap parking ® and the separate BSO "custodial" entrance. a BSO SUBSTATION and COMMUNITY CENTER CC.DOC Three black olive trees in the NW 8th Avenue swale will remain. A new paved area (next to the custodial entrance) will be provided in the swale area between the black olives. Parking Variance (nine spaces provided; 18 required): The parking requirement is based on general office use. With 9 on-site parking spaces, parking shortfalls may occur during BSO "roll call" or use of the community meeting room. City staff is working with BSO to evaluate and identify a long-term solution to parking at the facility. Notice has been provided to all property owners within 300 feet.
