A RESOLUTION OF THE CITY OF DANIA BEACH, APPROVING THE SIGN
ADJUSTMENT REQUEST SUBMITTED BY COZY COVE MARINA INC., FROM
CHAPTER 28, ZONING, ARTICLE 28, SIGNS, SECTION SIGN REGULATIONS, FOR
PROPERTY LOCATED AT 300 NORTH FEDERAL HIGHWAY, DANIA BEACH;
PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances Chapter 28 Zoning, Article 28, Signs, sets the
signage criteria for specific zoning districts within the City of Dania Beach; and
WHEREAS, John Skinner, owner Cozy Cove Marina, Inc./Dockers Cafe, has applied for a sign
adjustment(SA-50-01)to allow for signage which is in excess of the allowed regulations in the Downtown
Redevelopment District for property located at 300 North Federal Hwy., Dania Beach; and
WHEREAS, the Planning & Zoning Board on November 28, 2001, recommended that the City
Commission grant the sign adjustment request SA-50-01 based upon the criteria set forth in Article 28,
Section 28.200. "Relief from requirements; Sign Adjustment; Variances", of Chapter 28, Zoning, of the
Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA:
Section 1. That that certain application SA-50-01, for a sign adjustment from Chapter 28 Zoning,
Article 28, Signage, Section Sign Regulations, a copy of which is attached as Exhibit "A" is
approved subject to:
(a) Applicant removing all other existing projecting wall signs within 90 days of City
Commission approval;
(b) Applicant completing attached cosmetic improvements within 90 days of City
Commission approval.
Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are repealed
to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its passage and
adoption.

Cozy Cove Marina
• Application for Sign Adjustment
1. The three sign adjustments we are requesting will be similar in nature to other
signs in the downtown area. Cozy Cove will be improving the appearance of the
property. Also, the signs will not be obtrusive since there is over 300' of highway
frontage and the large buildings are set back from the highway. The changes
will help the signs blend in with the structures.
2. Cozy Cove Marina is a large parcel almost 5 acres and the businesses within are
either set back from the highway or are not visible from the highway. Buildings
to the south of Cozy Cove are located directly next to the sidewalk just feet from
the highway and obstruct visibility from the south.
3. There are four items which make our site unique:
1. Property has been lost due to the widening of U.S. 1 through the years,
this has placed a hardship on the property to provide adequate parking,
traffic flow and landscaping. Changing the location of the signs would
place further constraints on traffic flow and parking.
2. The location of the handicap parking at Dockers, does not allow for
changing the setback of the Dockers sign as it would impede access for the
handicapped.
3. The backflow preventer for Dockers is located directly underneath
and between the poles of the Dockers sign. The Dockers sign base protects
this device and the water pipes from being damaged and hides this ugly thing
from public view. Moving the backflow preventer or the sign would be an
aesthetic mistake exposing it to the public and would be an unnecessary
financial hardship.
4. The location of the Dockers sign prohibits the use of a monument sign
in that location because the structure would obstruct the view of vehicles
and trucks attempting to exit the parking lot.

4. The Cozy Cove Marina site has several tenants and uses. Placing a monument
sign on the only available location at the southwest corner of the property would be
ineffective because it is blocked from view to the south by buildings and because it
would be the southernmost location it would not be adequately visible to the north
to give drivers time to react to safely turn into the property.
Cozy Cove Marina, Dockers and the other tenants receive a traffic flow of
approximately 400 to 600 cars and trucks per day. These drivers need sufficient
time to maneuver this busy intersection and highway. Providing clear and visible
signage will help to prevent many traffic accidents.
The uses on this site include three major dealerships Jupiter Boats, Phoenix Boats
and Yamaha Outboard Service. It also includes boat repair, used boat sales,
dockage and yacht brokerage all of which would receive no identification or
advertising under the current code. This places a great economic hardship and loss
of income when you consider the extremely high property taxes and fire assessments
placed on this site along with the additional expense of other advertising needed to
® compensate for the loss of advertising exposure on U.S. 1 afforded to businesses
in other cities along US 1.
5. The pole sign at Dockers is 35 years old and is not set back ten feet from the lot
line. The Changeable copy sign at Cozy Cove is 20 years old and extends more than
18 inches from the building face.

SUBJECT: SA-50-01 — Request by the Cozy Cove Marina and Dockers Cafe (300
North Federal Highway) for the following sign adjustments:
a) Sign Adjustment to allow a "projecting wall sign" (6' x 8') containing 48 square
feet. (The sign code does not permit a projecting wall sign at this location).
b) Sign Adjustment to retain an existing pole sign in present location, said sign
measuring approximately 4' x 6', containing approximately 24 square feet in
area, approximately 13 feet high, and setback approximately 1.5 feet from the
front lot line (The sign code permits a 25 square foot monument sign, up to
seven feet in height, with a five foot setback).
• Sign Adjustment (a) would allow the applicant to retain an existing "projecting wall sign"
that extends out perpendicular to the marina building. Please note that the "flat wall
sign"mounted flush with the marine building does not require a variance.
Siqn Adjustment (b) would allow the applicant to retain their existing pole sign with
cosmetic improvements. The existing pole sign, because it provides some visibility
between 2 and 6 feet above the parking lot, provides more visibility than a monument
sign built to current code requirements.
PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION
Sign Adjustment (a): Approval pursuant to Section 28.200 (1) (a) and (b) of the Sign
Code. The projecting wall sign is appropriate based on the building (marina)
architecture, setback, parcel size, and parcel configuration. This approval is subject to
applicant removing all other existing projecting wall signs within 90 days of commission
approval.
Sign Adjustment (b): Approval pursuant to Section 28.200 (1) (a) and (b) of the Sign
Code. The existing pole sign is appropriate based on the parcel size, parcel
configuration, and proposed cosmetic improvements (see attached drawing). This
approval is subject to applicant completing attached cosmetic improvements within 90
days of City Commission approval.
