SPECIAL MEETING
MAY 1, 2000

Mayor Mc Elyea called the meeting to order at 7:00 p.m.

3. PRESENTATIONS ON PIER RESTAURANT
Pier Pointe, Inc.
Joseph Stadlen, Vice President of Intertech Construction Corp. explained
that Pier Pointe, Inc. was a joint venture comprised of himself and the
following people: Andrew Vaz of Try My Corp (d/b/a Try My Thai in
Hollywood & Try My Thai Too in Ft. Lauderdale); Darius Zubrowski project
manager of Quincy Johnson Architects of Boca Raton; Benjamin Wohl,
real estate investor and manager with offices in Dania Beach.
Their proposed design and construction would consist of a restaurant,
observation tower, public bathrooms, bait/tackle shop and pier
admissions. The restaurant would be approximately 5,000 square feet
with a capacity of 250 patrons. It would include both indoor and outdoor
seating and sun deck. The observation tower is an aesthetic and
utilitarian concept. The 36' tower would provide a panoramic view of the
Atlantic Ocean, John U Lloyd State Park, Port Everglades and all points
south. The public restrooms would be ADA compliant and constructed
with maintenance and heavy use in mind. The bait/tackle shop would be
designed to effortlessly control the egress/regress of the pier, security,
retail sales and pedestrian traffic flow.

Dania Beach
All construction, design and materials selected would be chosen on the
basis to satisfy the following criteria: South Florida Building Code,
resistance to salt water corrosion, wind storm product testing, durability,
minimal maintenance and low replacement cost. The proposed
construction would be a structure consisting of double steel reinforced
CBS. The roof would be standing seam uni-joint coated metal and the
windows are proposed to be high impact resistant glass with accordion
shutters. Construction work schedules, material delivery and labor
coordination would be sensitive to the protected environment (sea turtles
and natural foliage), city planned events, recognized holidays and
neighboring residences.
In exchange for a 20-year lease, Pier Pointe offered a lease payment of
$60,000 for the restaurant, $72,000 for the pier and $50,000
supplementary, which is 10% of net profit from the restaurant at an
estimated amount of$2,000,000 for the first year, with annual increases
adjusted based on the CPI index not to exceed 3%.

The Group consists of the following: Paul Hugo, General Operating
Partner; Tom Zanucci, General Financial Partner; Miguel F. Sanchez,
Architect.
Louis Randazzo, concept restaurant developer, proposed a pier restaurant
with a casual dining environment with a full liquor bar, which would lend
itself as that of an entertainment facility by creating events such as reggae
bands on a cool summer afternoon.
The construction of the project would be done to meet or exceed current
building codes. The engineering and architectural plans would be such
that it would not require large maintenance concerns for the future. The
group feels that the structures built should not have high maintenance cost
or problems just to create a theme. With unpredictable weather and
adverse conditions such as hurricanes and salt water, the group is
focused on using technology that is proven to withstand these types of
elements.
The group felt that the current operating fishing pier interest would be
served with the renovation of the bait and tackle shop to include the
addition of a water sports rental facility. Given the usable space left, the
group encouraged the construction of a restaurant to coincide with the
idea of a new "Hot Spot" in Dania Beach that would enhance the pier and
also generate additional amenities for beach lovers:

® The group proposed the following:
Lease term - 50 years
Estimated cost of the project - $600,000
Liquor License —to include wet zoning and the ability to serve until 5 a.m.
Signage: landlord to approve reasonable signage request subject to
governmental approvals
Exclusivity: The Pier Development Group to be granted standard
exclusive clause for all food and beverage or any other type of business to
include bait shop and also water sport rentals
Compensation to City - $150,000 per year for management of the entire
pier with an annual increase based on the CPI index.
Tarpon Bend Food & Tackle
The project would be created, constructed and operated by the Restaurant
® People Inc. with the following operating partners: Tim Petrillo, President;
Peter Boulukos, Vice President; Alan Hooper Secretary and William Ivan,
Treasurer.
The group proposed the following:
Construct a two-story 7,000 square foot "Tarpon Bend Food & Tackle"
restaurant with a 2,000 square foot sun deck/bar. The first floor would
consist of a 4,350 square food kitchen/dining/bar area. The second floor
would be a 2,600 square foot mezzanine/bar with panoramic views. In
addition, a 2,000 square foot roof sundeck would be incorporated into the
design.
Construct a 900 square foot bait and tackle store with an ADA compliant
restroom facility for pier users.
Modify landscaping as shown on the site plan to better promote the beach
recreational area.
Create an illuminated gravel walkway from restaurant to Whisky Creek
dockage, and construct marina style huts (150 square feet) along the
walkway.

Sponsor a beach festival once a month.
Invest $1,630,812.15 to develop and construct the project.
Compensation to City - $98,000 per year in exchange for a 20-year lease
with two (2) additional 10-year options. Rent would increase based upon
the CPI, up to a maximum of 3% per year. As additional participation of
risk, the group requested a rent abatement of$50,000 per year for the first
8 years.
4. Possible action directing staff to negotiate contract with #1 Proposer
determined by City Commission.
The Commission agreed to allow any revisions to be submitted up to the
upcoming Friday. The City Attorney and City Manager were directed to
present a recommended ranking of the proposals at a Special Meeting to be
scheduled May 16, 2000. The City Manager was also directed to invite the
Marine Advisory Board to the Special Meeting for their input.
