RESOLUTION NO. 2005-CRA-001
A RESOLUTION OF THE BOARD OF COMMISSIONERS OF THE DANIA
BEACH COMMUNITY REDEVELOPMENT AGENCY AUTHORIZING THE
ACQUISITION IN FEE SIMPLE TITLE BY GIFT, PURCHASE OR EMINENT
DOMAIN OF THAT CERTAIN PROPERTY HEREINAFTER DESCRIBED;
FINDING THAT SUCH PROPERTY IS NECESSARY FOR THE PUBLIC
PURPOSE OF REDEVELOPMENT IN ACCORDANCE WITH THE
COMMUNITY REDEVELOPMENT PLAN; AUTHORIZING THE
EMPLOYMENT OF APPRAISERS, LAND PLANNERS, AND SPECIAL
COUNSEL TO ASSIST IN THE ACQUISITION OF THE PROPERTY;
PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Dania Beach, Florida, made certain
findings and declarations as set forth in Resolution No. 2001-15, adopted June 26, 2001, the
"Resolution of Necessity", as required by Chapter 163, Florida Statutes; and
WHEREAS, the City Commission of the City of Dania Beach, Florida established by the
adoption of Ordinance No. 2002-032 (adopted on June 25, 2002), the "Dania Beach Community
Redevelopment Agency" to, among other things, cause to be prepared a Community
Redevelopment Plan; and
WHEREAS, the Dania Beach Community Redevelopment Agency approved the
Community Redevelopment Plan and submitted the Plan to the City Commission of the City of
Dania Beach for approval, which Plan was approved pursuant to Resolution No. 2002-163,
adopted on September 24, 2002;
WHEREAS, the Dania Beach Community Redevelopment Agency has duly adopted the
Community Redevelopment Plan for the area within its jurisdiction; and
WHEREAS, as part of its Community Redevelopment Plan, the Community
Redevelopment Agency has established goals and objectives such as eliminating slum and
blighted conditions; and
WHEREAS, the Community Redevelopment Agency possesses the power of eminent
domain by virtue of the provisions of Chapter 163.330, et seq., Fla. Stat., the Community
Redevelopment Act of 1969, Broward County Resolution 2004-423 and City of Dania Beach
Ordinance No. 2002-032, as amended; and
WHEREAS, the City Commission of the City of Dania Beach has authorized, by
Resolution No. 2005-178, the acquisition by gift, purchase or eminent domain, of the property
described below; and
WHEREAS, the Community Redevelopment Agency has determined that the property
described below, contained within the Community Redevelopment Area, constitutes a slum or
blighted area, in which there is a shortage of housing affordable to residents of low or moderate
income, including the elderly, and in which the rehabilitation, conservation or redevelopment, or
a combination thereof, of such area or areas, including, if appropriate, the development of
housing which residents of low or moderate income, including the elderly, can afford, is
necessary in the interest of the public health, safety, morals or welfare of the residents of the City
of Dania Beach; and
WHEREAS, the Community Redevelopment Agency finds that there are within the
property described below, conditions detrimental to the sound growth of the City of Dania Beach
or which impair or arrest the growth of the City, and present conditions and uses detrimental to
the public health, safety, morals and public welfare; contain defective or inadequate street layout;
contain lots faulty in relation to their size, adequacy, accessibility or usefulness; unsanitary and
unsafe conditions; deterioration of site and other improvements; inadequate and outdated
building density patterns; and other deteriorated or hazardous conditions; and
WHEREAS, the Community Redevelopment Agency has considered the financial
feasibility, social and economic impacts, long term benefits, and other factors relevant to the
proposed acquisition and redevelopment of the property described below; and,
WHEREAS, the Community Redevelopment Agency has retained consultants,
conducted studies of the CRA area, obtained appraisals of the property described below and
solicited input from residents during public meetings; and
WHEREAS, the Community Redevelopment Agency finds that it is necessary, for the
aforesaid reasons, to acquire the real property described below for the public purpose of
proceeding with the redevelopment of the property commonly referred to as, and adjacent to, the
Dania Beach Hotel and that the property described below is necessary for that purpose;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
COMMISSIONERS OF THE DANIA BEACH COMMUNITY REDEVELOPMENT
AGENCY, THAT:

Section 1. That the above WHEREAS clauses are ratified and confirmed as being
true and correct and are made a specific part of this Resolution.
Section 2. That the Board of Commissioners of the Dania Beach Community
Redevelopment Agency authorizes the acquisition of the real property legally described as
follows:
PARCEL NO. 1:
All of Block 1 of DANIA BEACH SUBDIVISION, according to the Plat thereof,
as recorded in Plat Book 8, at Page 1 of the Public Records of Broward County,
Florida.
PARCEL NO. 2:
All of Lot 25, and Lot 26 less the North 5 feet and less the following described
property:
Commencing at the Southwest corner of said Lot 26, run North 02 degrees 20' 20"
West along the West line of said Lot 26 a distance of 14.88 feet to the PONT OF
BEGINNING; thence continue along the West line of said Lot 26 a distance of
24.12 feet to the Northwest corner of said Lot 26; thence North 87 degrees 49' 32"
East along the North line of said Lot 26 a distance of 64.10 feet to the beginning
of a curve concave southerly and having a tangent bearing of South 87 degrees 49'
32" West through said point; thence Westerly along said curve having a central
angle of 03 degrees 13' 42.1" and a radius of 630.10 feet an arc distance of 35.50
feet to a point of compound curvature; thence Southwesterly along said
compound curve having a central angle of 20 degrees 18' 17.5" and a radius of
46.44 feet an are distance of 16.46 feet to a point of compound curvature; thence
Southwesterly along said compound curve having a central angle of 66 degrees
37' 52.1" and a radius of 21.00 feet an are distance of 24.43 feet to the POINT OF
BEGINNING;
in Block I of ESKILSEN'S ADDITION TO THE TOWN OF DANIA, according
to the Plat thereof recorded in Plat Book "B", page 78 of the Public Records of
Dade County, Florida; said lands situate, lying and being in Broward County,
Florida.
PARCEL NO. 3:
Lots Twenty-Three (23) and Twenty-Four (24) of Block One (1) ofESKILSEN'S
ADDITION TO THE TOWN OF DANIA, according to the Plat thereof recorded
in Plat Book `B", page 78, of the Public Records of Dade County, Florida; said
land situate, lying and being in Broward County, Florida.

and being in Broward County, Florida.
PARCEL NO. 5:
The North 5 feet of Lot 20 and all of Lot 21, Block 1 of ESKILSEN'S
ADDITION TO THE TOWN OF DANIA, according to the Plat thereof; as
recorded in Plat Book B-D, Page 78 of the Public Records of Dade County,
Florida; said lands lying, situate and being in Broward County, Florida.
PARCEL NO. 6:
The North 10 feet of Lot 19, and Lot 20, less the North 5 feet thereof, in Block 1
of the ESKILSEN'S ADDITION TO THE CITY OF DANIA, as recorded in Plat
Book `B" at Page 78 of the Public Records of Dade County, Florida; said land
situate, lying and being in Broward County, Florida.

Community Redevelopment Act of 1969, and Chapters 73 and 74, Fla. Stat. The Dania Beach
Community Redevelopment Agency shall acquire fee simple title to the properties.
Section 3. That the Board of Commissioners of the Dania Beach Community
Redevelopment Agency determines, as more fully set forth above, that it is necessary to acquire
the property described above for the public purposes set forth in this Resolution, and in and
pursuant to its Community Redevelopment Plan, including more particularly the redevelopment
of the property commonly referred to as, and adjacent to, the Dania Beach Hotel. The
acquisition of the property is in conformance with the Community Redevelopment Plan and in
conformance with the Comprehensive Plan of the City of Dania Beach. When acquired, the
property shall be utilized for redevelopment in conformance with the Community
Redevelopment Plan.
Section 4. That General Counsel for the Community Redevelopment Agency is
authorized to retain the services of appraisers, land planners and experts in other disciplines
whom he deems are necessary for the adequate preparation of this case.
Section 5. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.

Dania Beach CRA Zoning Code
Scope of Services
I1-21-05
Purpose
Prepare draft zoning and design regulations (districts) applicable to CRA lands
designated for Commercial and Local Activity Center(LAC) land use on the Future Land
Use Map (FLUM). The project also includes consultant support in the actual rezoning of
said lands to the appropriate CRA zoning districts created as part of this project.
Task 1. Project Kick-off: Consultant will meet with City staff to discuss the project
goals, milestones, and coordination. Background documents and other materials will be
obtained and a field trip conducted.
Task 2. Visioning Workshop #1: Consultant will conduct a community visioning
workshop to obtain public input.
Task 3. Draft Zoning and Design Regulations. Consultant will prepare the CRA
zoning districts and design standards. Up to 3 new CRA zoning districts will be created.
One (1) set of urban design standards covering the new zoning districts will be
developed. Following internal team, the draft will be submitted to City staff and the City
Attorney for review. A meeting will be held to review the draft and record staff
comments. Staff has represented that no Comprehensive Plan amendments will be
necessary to implement the proposed CRA zoning districts.
Completion timeframe: 6 months from notice-to-proceed.
Task 4. Visioning Workshop #2: Consultant will conduct a second community
workshop to present the proposed regulations and obtain public input.
Task 5. P&Z and City Commission Presentations. Revisions will be made to the first
draft. The revised draft will be presented to the P&Z Board (1 meeting) and City
Commission (1 meeting).
Task 6. Final Ordinance Approval. Revisions will be made based on prior comments
and a hearing draft of the regulations produced suitable for inclusion in an ordinance
format The City Attorney will prepare the zoning ordinance. The proposed zoning
ordinance will be presented to the P&Z Board (1 meeting) and City Commission
(2 meetings).
Completion timeframe: 9 months from notice-to-proceed
Estimated CRA Code Cost(Tasks 1-6): $97,500

Task 7: Parcel Rezonings. Consultant will assist the City in researching the subject
parcels and preparing the staff reports necessary for the P&Z Board and City
Commission to consider the rezoning of the CRA properties currently with Commercial
and LAC land use. Two meetings with staff are anticipated. Meetings with property
owners and/or their representatives are not included in the fee for this task. The City
Attorney will prepare the zoning ordinance(s). Consultant will also attend, and participate
in, I P&Z Board meeting and 2 City Commission meetings for the purpose of adopting
the proposed zoning ordinance(s). No zoning map revisions will be made by the
consultant.
Completion Timeframe: 12 months from notice-to-proceed.
Estimated CRA Rezoning Cost(Task 7): $17,500
Consulting Team
The proposed consultant team for this project is Her Planning Group (IPG) as the prime
consultant and EDSA as the urban design subconsultant and Dickey Consulting as the
community involvement subconsultant.
Reproduction
Consultant will provide 3 copies of each work product. City is responsible for additional
copies.
Public Notice
City is responsible for all public notice requirements associated with the all public
meetings/hearing including the workshops.

Dear Mr. Poto:
Thank you for inviting us to participate in your selection process for Planning
Consultant Services for the Dania Beach CRA. We enjoyed presenting our
qualifications to the City Commission and are excited by the opportunity to work
with the CRA to create a new zoning code and architectural design guidelines.
Zyscovich Inc. is the preeminent urban design firm in South Florida. We have a
reputation as a leader in implementing master plans and zoning codes which
attract appropriate development projects and enable our clients to meet their
redevelopment goals. In the City of Hollywood, Zyscovich developed strategies
to influence development in the downtown by requiring buildings to mimic the
curve of Young Circle Park and create a pedestrian friendly environment. By
working with each developer who owned property on the Circle, we ensured
that each development reinforced this important park space to help strengthen
the downtown's image. Zyscovich has had similar experience with our work in
South Miami Beach and the City of Miami. In both examples Zyscovich identified
catalytic development projects which have, in turn, garnered a flurry of related
development projects.
Dania Beach has tremendous development potential much like our municipal
clients described above. With nearly 3000 potential new residential units, the
CRA is poised for a major development boom. It will be the responsibility of the
CRA's planning consultant to craft zoning and architectural regulations which
will protect the City's character while encouraging a mix of good development.
Zyscovich understands the complexities of building design, developer interests,

1 .1 Review CRA Plan
The CRA Plan will be evaluated in terms of how it has achieved its goals, and
how it has faltered. Our team will ask the following questions:
What aspects of the CRA were implemented?
Did the projected growth match the actual growth?
Does the community agree with the CRA's vision? Should it be refined?
1 .2 Update Existing Conditions
Zyscovich will assess the CRA Plan's impact on development, circulation, land
use, and the overall perception of the downtown by the local community and
visitors. More specifically our work will include:
• A review of planned development projects
• A reconnaissance visit
• An urban form analysis: height, density, massing, land use, zoning, open
space
• A photographic survey
Historical data research
Reviewing of other existing studies
• Reviewing current and planned developments
• Understanding traffic circulation patterns and planned FDOT
improvements
• Locating existing open space and street sections
• Understanding development patterns and trends
• Identifying cultural institutions and public property
1 .3 Update Project Accomplishments
The design team will identify and evaluate the CRA's achievements since it's
inception including:

• The LAC
• Potential and planned development projects organized by the CRA
• Efforts for parcel assemblage
• Grant and loan requests to the County
1 .4 Public Forum Visioning Session
Organize a public workshop lead by a panel of planning and development
experts, moderated by Bernard Zyscovich. The workshop will focus on issues of
specific interest to the City relating to zoning and architectural guidelines.
TASK Z: UPDATE AND VERIFY OVERALL CONCEPT

2.1 Update Overall Concept
The design team will update the overall design concept presented in the City's
CRA Plan according to the information collected in Task 1 and as a result of
meetings with key stakeholders in the community. This will also be an opportunity
to meet with the County to understand their ability to work with the CRA. The
information collected in this task will inform the recommendations for the final
zoning code and architectural guidelines.
2.2 Analyze Parcels
The parcel analysis will provide strategies for:
• Maximizing building potential on smaller parcels typical in the CRA
• Aggregating parcels
• Attracting appropriate development for these parcels
2.3 Verify and Refine Districts
As part of the zoning code recommendations, the design team will revisit the
zoning districts created for the CRA Plan. There are opportunities to expand
these boundaries based on their development potential.
2.4 Analyze Zoning Recommendations

Zyscovich will layer the information collected in Task One, with the zoning
recommendations in the CRA Plan for compatibility. In this phase, the design
team will resolve outstanding issues related to:
• Key needs of the CRA area
• Opportunities for public/private sector initiatives
• Appropriate uses and feasibilities
• Opportunities for open space and public plazas
• Street sections
• Traffic patterns and conflicts
2.5 Public Workshop and Presentation
Zyscovich will make a formal presentation to the community in the City
Commission Chambers. The City may want to use the panel format similar to the
first Public Forum, or may choose to have the design presentation as the focus of
the workshop.
TASK $: PRELIMINARY ZONING AND GUIDELINES

3.1 Preliminary Zoning Recommendations
The third phase of the project is developing urban design scenarios and
recommendations to the zoning code. This is a result of work from Task Two. It
includes:
• Examining capacities of site/viability of uses
• Examining programming opportunities
• Preparing a program statement
• Testing urban design scenarios
• Examining massing and stacking
• Plan sketches and renderings
3.2 Preliminary Architectural Guidelines
The guidelines will support the recommendations for the zoning code. Items to
be addressed will include:
• Building Design
• Streetscape
• Ornamentation

4.1 Draft Zoning Code
The Draft Zoning Code will reflect recommendations set forth in Task Three. The
draft will provide language which can be adopted by the CRA Board and the
City Commission as part of their zoning code.
4.2 Draft Architectural Guidelines
Similar to the Draft Zoning Code, the Draft Architectural Guidelines will be
incorporated into the City's zoning code. The Architectural Guidelines will
provide a checklist of requirements which each new building must meet, and will
be designed to simplify the approval process.
4.3 Final Zoning Code and Design Guidelines
The Final Zoning Code and Design Guidelines will be a result of public input from
both the residents and the Commission and CRA Board. The final documents will
be adopted into the City Zoning Code and will be easy to implement by staff
planners without excessive oversight by senior staff.
4.4 Presentations to P&Z and City Commission
As required as part of the approval process.
