Summary Explanation & Background: This originally went to the board on 9/11/00 for 1 violation. The board issued a Final Order giving the defendant 90 days to comply or a fine of$75.00 per day would be levied. The compliance date was 1/01/01 and they did not comply until 4/07/01. The fine ran from 1/01/01 through 4/07/01, 98 days at$75.00 per day for a total of$7,350.00. The fine was confirmed on 4/02/01. On 3/06/06, this was brought back to the board for an authorization to foreclose, but was continued until the next meeting. DATE: 7/11/06 This was originally heard by the code board on 9/11/00 for 1 violation. A final order was issued giving the defendant 90 days to comply or a fine of $75.00 per day would be levied. The compliance date was 1/01/01 and they did not comply until 4/07/01. The board confirmed the fine on 4/02101. The code enforcement board, after hearing testimony on 6/12/06, decided by majority vote to recommend abating the lien to $600.00 because the job had been done and the permit was pulled and closed out. DEFENDANT SUPPLEMENTAL ORDER/ CLAIM OF LIEN The City of Dania Beach Code Enforcement Board ("Board") 100 West Dania Beach Boulevard, Dania Beach, Florida 33004, having received the testimony and affidavit of Building Official, Kenneth Koch, on the City's Motion to Confirm Fine held on the 2nd day of April, 2001, and based on the evidence, the Board enters the following findings of fact and order: 1. Upon the evidence presented, the Board makes the following findings of fact: a. The board has jurisdiction of the defendant and the subject matter of this action; and b. Mr. Koch responded he would have to tie the Board's Order with the legal agreement; he would have no problem with that. Don Lampasone, the General Contractor, came forward, was sworn in, and had the following testimony. The building is ready to have the mud put on the outside of the home after the wire inspection; it is also ready for the drywall to be finished on the interior; all the doors are ready to be installed on the interior, as soon as that is inspected and the finish work is completed, it is ready to set fixtures in place, it has had the rough plumbing and electrical approved. They are now having a labor shortage, other than that, the problems of the job are behind them. The job is almost done. It was on motion of Tim McLeod, seconded by Pat Flury, to adopt the findings of fact by Building Official Ken Koch, move to find the violation exists as charged, move the violator be given 75 days to comply thereafter a fine of $250.00 per day will be imposed. Mr. Koch stated in addition to the order, he still needs the agreement, the bond, and the permits to be reissued and the inspections to take place; we will modify the agreement to take out the demolition order and put a clause in that they will go with the order of the Board from this evening. CEB00-0578 Robert Lee Williams Estate 125 NW 10 Court, rear Dania Beach, FL 33004 William Johnson, having been previously sworn in, came forward to present the case. He had the following testimony. The violation is located at 125 NW 10 Court, rear. Service was obtained by posting the property, the Affidavit of Service is on file, and a first class letter was sent out, the Affidavit for that is on file; we did not get the return receipt from the Certified Letter. The Building Official Ken Koch came forward, having been previously sworn in, and had the following testimony. This is the building located at the rear of the property, it is a separate building. The roof structure and the roof covering is collapsing, the windows are gone and boarded up. We would like this to be permitted and repaired or permitted and removed. Two pictures were given to the Board. The building in not inhabitable in this condition; it is not even suitable for storage. As of today, there has been no application for permit or work done to repair the property. Ruth Barnes Williams was sworn in and had the following testimony. She is the personal representative of the Estate and his widow. The attorneys are trying to get the property into her name. As of Friday, permits were applied for. The doors and windows were boarded up; no one has used the building in a long time. They are trying to get the building in her City of Dania Beach Code Enforcement Board 5 September 11, 2000 name so she can get financing to have the building fixed. She needs 6 months to fix the home. She identified the pictures as those of the property. Mr. Koch stated the building can be restored; if it is just to be used as storage, then the roof, windows, and doors need to be repaired, if it is to be inhabited, the interior may need to be fixed, it all depends on what the application states. He has no problem with 90 days. Mrs. Williams plans to have the whole house done, even the interior, but she does not have the money now. Tim McLeod asked if she understood that when the permits are issued, she has limited time to complete the work, so just pulling the permits is not going to solve the problems. Mrs. Williams stated she needs to do the roof first. Richard Bettor informed her she can come back to the Board and give them updates and extensions if she requests them. She asked for 90 days. Mr. Koch stated the original violation states she has 90 days to have general and roofing contractor obtain the permits, repair the work, and request to receive the inspections, so it would be 90 days to complete this repair work. Anything else would be beyond that, the 90 days is to get the permits, get the work done, and get the inspections approved. He stated it is a relatively small building, it may cost about $2,500.00 for the roof. He is only concerned right now with the roof and the structure of the roof, the windows and doors can come later; he just wants the roof to be secured. It was on motion of Judy Jensen, seconded by Jimmy Peterman, to adopt the findings of fact by Building Official Ken Koch, move to find the violation exists as charged, move the violator be given 90 days to comply thereafter a fine of $75.00 per day will be imposed. Lauderdale, FL 33312 Frank Osorio came forward, having been previously sworn in and had the following testimony. The violations are located at 4331 SW 34 Lane. It is a violation of Chapter 28, Zoning, boat stored on property with no current license, it must be on a licensed trailer. The owner is Donald J. Schmitt, 4331 SW 34 Lane. The violation was confirmed on May 30, the letter was sent on June 22, it failed inspection on June 29, we attempted to send a Certified Letter, it was returned. The property was posted and he spoke to the gentleman who is present about the boat. He had photos for the Board. This was also sent First Class mail. Donnie Schmitt, the son who resides at the property, came forward and was sworn in. Attorney Ryan asked if he had his father's authorization and if he had authority to speak on the father's behalf. Mr. Schmitt stated the father did not know he was at the meeting. He purchased the home in July 1998 from Mr. Stein who lives in Germany, the boat was left in the canal tied to the dock, the title was in the house; the City of Dania Beach Code Enforcement Board 6 September 11,2000 17. Motion to Confirm Fine — CEB00-0585 — Warren C. & Marian Davis — 226 SW 16 Street Inspector Dubisky, having been previously sworn in, came forward. Inspector Dubisky said a re-inspection of the property, located at 226 SW 16 Street, today revealed the corrective action ordered by the Board had not been taken in that the trash and debris are on the property. Inspector Dubisky said the Affidavit of Noncompliance is in the file. It was on motion of Tim McLeod, seconded by Jimmy Peterman, to confirm the fine. Motion to Confirm Fine—CEB00-0578 —Robert Lee Williams EST —125 NW 10 Court Building Official Ken Koch, having been previously sworn in, came forward. Mr. Koch said a re-inspection of the property, located at 125 NW 10 Court rear, performed today revealed that the corrective action ordered by the Board had not been taken in that a permit for repairs was issued on September 18, 2000, but the work has not been completed nor inspected and the permit was rescinded at the contractors request March 30, 2001. It was on motion of Tim McLeod, seconded by Jimmy Peterman, to confirm the fine. Mr. Koch said a re-inspection of the property, located at 4600 SW 34 Avenue, performed on January 16, 2001 revealed that the corrective action ordered by the Board had not been taken in that the permit was not issued until January 2001. Mr. Koch said he recommends dismissal due to the efforts of the respondent. It was on motion of William Sargent, seconded by Tim McLeod, to dismiss the case.
