A RESOLUTION APPROVING A SIGN ADJUSTMENT REQUEST SUBMITTED
BY PHIL GLASSMAN, REPRESENTING DANIA SHOPPING CENTER, FROM
CHAPTER 28, ZONING, ARTICLE 28, SIGNS, SECTION 28.160—DOWNTOWN
DANIA BEACH REDEVELOPMENT DISTRICT SIGN REGULATIONS, FOR
PROPERTY LOCATED AT 126 SOUTH FEDERAL HWY., DANIA BEACH;
PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the Dania Beach Code of Ordinances Chapter 28 Zoning, Article 28, Signs,
sets the signage criteria for specific zoning districts within the City of Dania Beach; and
WHEREAS, Phil Glassman, representing Dania Shopping Center, has applied for a Sign
Adjustment(SA-VA-25-98)to allow for a sign which is in excess of the allowed signage regulations
in the Downtown Dania Beach Redevelopment Zoning District for property located at 126 South
Federal Hwy., Dania Beach; and
WHEREAS, the Planning & Zoning Board on June 16, 1999, recommended that the City
Commission grant the Sign Adjustment request SA-VA-25-98 based upon the criteria set forth in
Article 28, Section 28.200. "Relief from requirements; Sign Adjustment; Variances", of Chapter 28,
Zoning, of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DANIA BEACH, FLORIDA:
Section 1. That that certain application for a Sign Adjustment(SA-VA-25-98)from Chapter
28 Zoning, Article 28, Signage, Section 28.160—Downtown Dania Beach Redevelopment District
Sign Regulations, a copy of which is attached as Exhibit "A" is approved for the following two (2)
signs subject to the following conditions:
1. The City approves a "Jackson's Ice Cream" sign (50 square feet for sign
copy with a maximum height of 10 feet)with the following conditions:
(a) Phil Glassman, representing Dania Shopping Center, agrees to install five
(5) Palm trees in the swale area along Federal Highway in accordance with Florida
Department of Transportation and City requirements;
(b) Phil Glassman, representing Dania Shopping Center, agrees to install a

• silver buttonwood hedge and underground irrigation system within the 3-foot Swale
area along federal highway;
c) Phil Glassman, representing Dania Shopping Center, shall be responsible
for maintenance of the swale area including underground irrigation and swale area
plantings.
2. The City approves a 112 square foot sign (16 foot height: 2 foot base/14 foot
copy) with the following conditions:
a) Phil Glassman, representing Dania Shopping Center, agrees that the color
of all tenant's names will be consistent on the sign;
b) Phil Glassman, representing Dania Shopping Center, agrees that the sign
and lettering will be limited to three colors (yellow, white, hunter green);
c) Phil Glassman, representing Dania Shopping Center, will pay the City of
Dania Beach all recovery fees;
d) Phil Glassman, representing Dania Shopping Center, will install five(5)Palm
Trees in the swale area along Federal Highway as per Florida Department of
Transportation and City requires;
e) Phil Glassman, representing Dania Shopping Center, will install a Silver
. Buttonwood hedge and underground irrigation system within the 3-foot swale area
along Federal Highway;
f) Phil Glassman, representing Dania Shopping Center, shall be responsible
for maintenance of the swale area including underground irrigation and swale area
plantings.
Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are
repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its passage
and adoption.

At it's July 13, 1999 regular meeting, the City Commission deferred this item so the
applicant could submit a full site plan for the center.
The applicant has submitted a site plan but it is not a full site plan as requested by the
commission at it's July 13, 1999 and December 14, 1999 meeting.

Dear Mr. Glassman:
At the December 14. 1999 regular commission meeting, the City Commission discussed _
the progress being made regarding your request for sign adjustment and the action taken at
their meeting on July 13. 1999. (Minutes from both meetings are attached, as well as the letter sent to
You on October 6. 1999 regarding this matter.)
Please be advised that you have until January 10. 2000 to submit a full comprehensive
site plan to the Growth Management Department so that it may be reviewed by Mr. Leigh Kerr,
the city's Planning Consultant, and heard at the February 16, 2000, Planning and Zoning Board
• meeting. The City Commission will then act on the recommendations made at that meeting at
their March 14, 2000 Regular Commission meeting.
I would also like to confirm that a total of $75.00 towards cost recovery fees for the
public hearing notice was received on December 14, 1999, in addition to the $165.00 received
for the sign adjustment on March 18, 1998. The City will require that an additional $500.00 be
submitted relating to the additional site plan review and hearing notice fees. Please remit this
amount as soon as possible.

NOTICE IS HEREBY GIVEN that a public hearing will be held before the City Commission on Tuesday,
December 14, 1999, at 7:30 p.m., or as soon thereafter as possible, in the City Commission Room,

any comments which might be made to the following requests:

located at 4611 SW 341h Avenue, Dania Beach, Florida. Property is legally described: Lot 6, Block 2 Avon Isles,
according to the plat thereof, as recorded in Plat Book 40, Page 31 of the public records of Broward County, Florida.
5) Petition VC-89-99— Request by the City of Dania Beach to vacate 1,650 sq. ft. of alley easement located at the rear of
333 South Federal Hwy. Property is legally described: The "Alley" as shown on the Plat of"Hollywood Center Court"
according to the plat thereof, as recorded in Plat Book 25, page 42, of the public records of Broward County, Florida.
Copies of the proposed petition are available for viewing in the Growth Management Department, 100 West Dania Beach
Blvd., Dania Beach, Florida between the hours of 8:00 a.m. and 4:00 p.m., (954) 924-3645, Monday - Friday. Interested
parties may appear at the public hearing and be heard with respect to the proposed petition.
In accordance with the Americans With Disabilities Act, persons needing assistance to participate in any of these

Any person who decides to appeal any decision made by the City Commission with regard to any matter considered at this
