FOR PUBLIX SUPERMARKETS , FOR PROPERTY LOCATED AT THE SOUTHWEST CORNER OF DANIA BEACH BLVD. AND SE ST" AVENUE, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS, Herb Green,Avid Engineering representing Mark Sheldon of Regal Ventures, Inc. for Publix Supermarkets, property owner has applied for site plan approval for the proposed construction of a Publix Supermarket to be located at the southwest corner of Dania Beach Blvd. • and SE 5'h Avenue, Dania Beach; and WHEREAS, the Planning &Zoning Board on January 5, 2000, recommended that the City Commission grant the site plan request(SP-91-99), based upon the criteria set forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 4. SURROUNDING LAND USE: Commercial to the West and East; Commercial Recreation to the North; Medium High (25) to the South Paae 1 The Publix site is situated at the southwest corner of Southeast 5`h Avenue and East Dania Beach Boulevard and will be situated on the Frosty's driving range site. The site is proposed to be utilized for a retail shopping center with Publix supermarket as the anchor. The site has a total of 66,211 square feet of building and the Publix facility will contain 44,265 square feet. Also they have identified a Parcel 2 which is proposed as a future outparcel and is not part of the subject approval. This proposed Parcel 2 is situated at the northwest corner of the site. Generally, they have provided for two (2) access points on East Dania Beach Boulevard and two (2) access points on Southeast 5`h Avenue to serve the facility. The Publix supermarket is situated on the rear of the site, more or less centered in that location. The balance of the proposed retail extends east and west from the Publix facility. Also included is a request for a variance from the roof type which is a parapet roof rather than a pitched roof as required by Code. VA-90-99 As part of the project, the applicant has requested a parapet roof in lieu of a peek roof. They indicate this request is because of the compressors, motors and fans on the roof area. They indicate that the Fire Code limits motors and compressors within enclosed roofs and that is their hardship. They indicate that this is unique to this type of facility. The proposed roof is similar to the roof at the ® Publix being constructed on Griffin Road. The staff has reviewed the variance request per the Code and we do not concur with the applicant's proposal. We believe that interpreting the Code to provide relief for rooftop structures in this manner is something that could easily be applied to any proposed facility within the City of Dania Beach and is not unique to this facility. We do not believe that special conditions or circumstances apply that distinguish this applicant from other applications in the community. We believe that it would provide a special privilege to this applicant and we do not believe the literal interpretation of the provisions of this Code would deprive the applicant. The staff recommends denial of the variance request. SA-91-99 Staff has conducted a review of the site plan in accordance with the City standards. As you are aware this parcel is also the subject of the Dania Beach Plaza Plat which was recently approved by the City Commission and is currently under review by Broward County. v TRAFFIC/ACCESS 1. PLAN REVIEW COMMENTS Since the December Planning and Zoning Board meeting, the applicant has provided several revisions to the plans in response to our previous comments. These include enhanced landscaping; reduction of the southeast opening to out bound only traffic; explanation on the handling of solid waste and loading (see attached memo from Avid Engineering ) and provision of building elevations. The following identifies the remaining conditions: 1. Signage in accordance with the City Code will need to be provided prior to building permit. �. A lighting plan must be provided in accordance of Code prior to issuance of a building permit. 3. Building elevations have been provided but must depict colors. 4. Re-label the City name to read "Dania Beach" 3. Tree removal license in accordance with Code prior to building permit. D. LANDSCAPE PLAN 1. Trees to be installed per Section 26-50(b)(2) and(3) - Trees on a frequency of one (1) per every forty (40) feet on the residential side of the wall and one (1) per eighty (80) on the commercial side; shrubs one (1) per every three (3) feet on both sides of the wall. 2. An irrigation plan shall be submitted prior to building permit issuance. 3. All landscape areas interfacing with vehicular areas will be curbed. 4. The type of stock will be Florida Number One or better. Staff recommendation: VA-90-99 - Variance: Denial as the applicant has not demonstrated sufficient hardship. Sp-91-99 - Site Plan: Approval subject to the above comments and recommendations. SRAVA-90 PUBLIX w Paae 4 January 4, 2000 Lou Ann Cunningham Growth Management Department City of Dania Beach 100 W Dania Beach Boulevard Dania Beach, FL 33004 RE: Publix Supermarket HHI Project No. 99023.05 Dear Lou Ann: HHI has reviewed the most recently submitted revised site plan, dated December 28, 1999, and traffic study, dated December 27, 1999, for the proposed Publix Supermarket on Dania Beach Boulevard. An updated summary of our findings and recommendations follows: • Regarding the Number of Driveways on Dania Beach Boulevard To demonstrate the need for two Dania Beach Boulevard access driveways to adequately serve the proposed project, the Applicant submitted projected driveway volumes based on the following trip orientation. 40% oriented to and from the west 40% oriented to and from the east 20% oriented to and from the south From this data, the Applicant estimated driveway volumes as follows: 40% inbound from Dania Beach Boulevard (84 peak hour trips) 45% outbound onto Dania Beach Boulevard (95 peak hour trips) 60% inbound from SE 5th Avenue (123 peak hour trips) 55% outbound onto SE 5th Avenue (117 peak hour trips) Since the quantitative basis for the Applicant's estimated trip orientations was existing intersection traffic counts, HHI obtained the number of dwelling units within the approximate service area of the site (approximately one mile to the north, 1.5 miles to the east and west, and .5 mile to the south). CL JJ 1 1 -3949 a `9.7 - 3D � 2 1 � 1 3\ )74/3 1) 9790 ® Lou Ann Cunningham January 4, 2000 Page 2 35.39% oriented to and from the west 15.53% oriented to and from the east 49.08% oriented to and from the south From this data, HHI estimated driveway volumes as follows: 35% inbound from Dania Beach Boulevard (72 peak hour trips) 16% outbound onto Dania Beach Boulevard (36 peak hour trips) 65% inbound from SE 5th Avenue (134 peak hour trips) 84% outbound onto SE 5th Avenue (188 peak hour trips) Using the data-based driveway projections developed by HHI, approximately 65% of all traffic entering and 84% of all traffic exiting the site would do so by way of the driveway connection to S.E. 5th Avenue. The reasons for such a heavy use of the S.E. 5th Avenue driveway are two-fold: most nearby shoppers live south of the site, and those who do come from the east or west must use S.E. 5th Avenue to either enter or exit due to the inability to make left-turns into or out of the site on Dania Beach Boulevard. ® The Applicant obtained a letter from the Florida Department of Transportation providing preliminary approval (which has expired) for two driveways on Dania Beach Boulevard. This letter was provided without the benefit of projected traffic volumes, which the Department will require later for final approval. HHI's discussions with the Department indicate that the data will not be adequate to support the Applicant's request. Further, Chapter 14-97 F.A.C., Rules of the Florida Department of Transportation, requires a 245-foot separation between driveways on a Class 5 Arterial such as Dania Beach Boulevard. Although the driveways proposed by the Applicant do not satisfy this criteria, a single, centrally-located driveway would. Regarding Driveway "Vehicle Reservoir" Length Broward County's Land Deuelopment Code has specific requirements for the lengths of vehicle reservoirs on driveway connections to County Trafficways such as Dania Beach Boulevard. Using the applicant's projected driveway traffic, a single driveway connection to Dania Beach Boulevard would require a 100-foot-long vehicle reservoir (Saturday peak hour greater than 200 vehicles). However, using HHI's projected driveway traffic, a single driveway connection to Dania Beach Boulevard would require only a 50-foot-long vehicle reservoir (Saturday peak hour greater than 50, but less than 200 vehicles). Lou Ann Cunningham January 4, 2000 Page 3 Regarding Signalization of Dania Beach Boulevard at S.E. 5th Avenue In October 1998, the Florida Department of Transportation conducted a Signal Warrant Study and determined that a traffic signal is warranted at the Dania Beach Boulevard/S.E. 5th Avenue intersection. Department staff noted that, in order to implement signalization of the intersection, the two existing driveways on the north approach must be combined into one driveway which aligns with S.E. 5th Avenue to the south. The two north side driveways serve the Dania Jai-Alai and the Danian Condominiums. Both access driveways should be combined into one, joint-use signalized driveway when the Dania Jai-Alai property is redeveloped. Miscellaneous Sheet Ll, the landscape plan contained in the latest site plan package, shows desirable landscape improvements in the Dania Beach Boulevard median. Sheets 2 and 3 of the same site plan package do not reflect the median revisions and accompanying landscaping. ® Summary Given the analysis presented above, we recommend that • only one Dania Beach Boulevard driveway be permitted, with a vehicle reservoir length of 50 feet, • the Applicant bond for one half of the estimated cost of design and construction of a traffic signal at the intersection of Dania Beach Boulevard and S.E. 5th Avenue (total estimated cost of $150,000) Should you have any questions or comments regarding these conclusions or our recommendations, please do not hesitate to contact me. The delivery trucks would enter the site from Dania Beach Boulevard and make way to the back of the Store. The trucks then back into the track pd. The pit is approximately 4 feet below the surrounding elevation. The pit also includes a solid masonry wall as a second wall barrier to the proposed masonry wall at the property limits. Upon backing into position, the trucks are turned off during the off loading operation. The dumpster system is a fully seated hydraulically operated system for a no smell and noise. The chute system takes refuse directly from the store into the sealed dumpster. During the public hearing process for the Griffin Road Publix, the residents from Oakbridge took opportunity to go by the Boca Publix to observe and sniff oust the dumpster in full operation_ They came back to the public hearing to report that they could not smell nor hear the dumpster and was pleased at the overall cleanliness of the system. • F:kfoc1i850o8\verta trans7..dCC AVID ENGINEERING, INC. Per our discussions with the City's Consultants, we have revised various aspects of the project including the following: • Add greenspace within the center median at Dania Beach Boulevard. This revision is under review by the FDOT approval, but we understand that the City would assist the applicant in requesting the greenspace versus the continous concrete curb. • Dumpster detail per City Standards has been included within the plans. • Loading areas has been identified on the site plan. • Revisions per Mr. Leigh Kerr's comments regarding plan deficiencies have been addressed, including proper City name, directional signage, parking tabulations,and easements to the existing corner commercial parcel. • The landscaping plan has been revised to include the tabulations and alternate landscaping plan per Mr. Kerr's comments for the southern border of the project. The only justification for the palm tree counts was that the palm trees were used as supplemental trees and not replacement trees. Thank you for your prompt attention to this project. The proposed Publix Shopping Center will contain approximately 56,265 square feet of gross leaseable area. The trip generation estimates associated with the Publix Shopping Center were determined based on the trip generation equations contained in the 61h Edition of the 1TE Trip Generation Manual, for Land-Use 820. December 27, 1999 Dania Beach Boulevard at S.E. 5"'Avenue - Publix The site traffic was assigned to the site access driveways based upon the following directional distribution estimates: Direction Percentage To/From the West on Dania Beach Boulevard 40 % To/From the East on Dania Beach Boulevard 40 % To/From the South on S.E. 5" Avenue 20 % 100 % The directional distribution estimates were developed based on the distribution of the existing traffic in the vicinity of the site and the location of the areas residential developments. The traffic volumes utilized to estimate the distribution of site traffic were obtained from FDOT. The counts were conducted by FDOT in July of 1998. The counts were adjusted to reflect peak season conditions. The two access driveways planned on Dania Beach Boulevard will function as right in/out driveways. In connection with this project we will be closing the median opening on Dania Beach Boulevard, located west of S.E. 5`h Avenue. Right turn deceleration lanes will also be constructed at both of the proposed Publix driveways to enhance traffic flow into the site. The design and location of the two right in/out access driveways have received preliminary FDOT approval. Based on the trip generation and directional distribution estimates presented above the following traffic volume projections were developed for the two site access driveways proposed for Dania Beach Boulevard. The county requires a throat depth (measured from the ultimate ROW line) to be a minimum distance of 50 feet, unless a traffic study is submitted that supports a reduced distance. 4 2 Molly Hughes, Principal, Hughes Hall Inc. December 27, 1999 Dania Beach Boulevard at S.E. 5"' Avenue - Publix If the site access plan were to be consolidated to have only one driveway on Dania Beach Boulevard, based on the Broward County guideline the driveway would fall into a Major Driveway Classification, which requires an additional 50 feet of throat depth. The consolidation to one right in/out driveway on Dania Beach Boulevard promotes congestion and which could lead to spill back problems on Dania Beach Boulevard. Based on the trip generation characteristics of the proposed development, the Broward County design standards for Intermediate Driveways, and the FDOT's acceptance of this plan as proposed (see attached FDOT Letter), are requesting your approval of the site access plan that reflect the following: ➢ Construction of Two Right In/Out Driveways on Dania Beach Boulevard Closure of the Existing Median Opening on Dania Beach Boulevard (West of S.E. 5" Avenue) ➢ Construction of One Full Access Driveway on S.E. 5`h Avenue ➢ Construction of One"Out-Only" Driveway on S.E. 5`' Avenue Please contact us if you have any question or comments related tit the contents of this memorandum or, if you need additional information to approve the requested access plan.
