HomeMy WebLinkAboutR-2000-035 RESOLUTION NO. 2000-035 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN REQUEST SUBMITTED BY THE BOARD OF REGENTS FLORIDA ATLANTIC UNIVERSITY / & THE DEPARTMENT OF THE NAVY, FOR PROPERTY LOCATED AT 101 NORTH BEACH ROAD, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS, The Board of Regents- Florida Atlantic University&the Department of the Navy have applied for site plan approval for the proposed construction of an additional 6,000 square foot building to be located at 101 North Beach Rd., Dania Beach; and • WHEREAS, the Planning &Zoning Board on January 26, 1999, recommended that the City Commission grant the site plan request (SP-92-99), based upon the criteria set forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application (SP-92-99)for site plan approval, a copy of which is attached and made a part of this Resolution as Exhibit "A" is approved and it is further noted that the original Site Plan is maintained in the office of the Growth Management Department of the City of Dania Beach. 1 RESOLUTION NO. 2000-035 • Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically expire and become null and void unless building permits are obtained on or before 18 months from the date of this resolution. Section 3. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 4. SP-92-99 — Site Plan request by Michael Flattery, of Gee & Jenson representing The Board of Regents Florida Atlantic University & The Department of the Navy for a proposed 1 story - 5,780 square foot building addition to the Sea Tech building located at 101 North Beach Road, Dania Beach. Leigh Kerr, AICP, Planning Consultant addressed the Board describing the Site Plan request. The City has an lease agreement with FAU for the Sea Tech property which is a sub-lease proposed by the US Navy to build a 6000 sq. ft. structure with the entrance located on the eastern portion of the site. The lease agreement allows the City to review Site Plan elements including but not limited to signage, parking, elevations and landscaping. Mr. Kerr concluded his summation by recommending approval subject to the conditions listed in staffs report. Board questioned staff on the reason why they do not have to comply with City building codes. Attorney Ansbro stated that there are levels of preemption for building codes for Federal and State government. Mike Flattery of Gee & Jenson addressed the Board concurring with Mr. Kerr and will comply with the recommendations prior to Commission Meeting. Chairman Lohmann stated that the building does not look like the existing site architecturally. Mr. Flattery stated that they would use the same colors and evaluation as the existing buildings. Further stated that they meet South Florida Building Code. Discussion on the criteria for the roof. Chairman Lohmann opened the item for public comment. Hearing and seeing no one, the chairman closed the public hearing. • Jason Dubow supports the project by feel the elevation could be enhanced. Victor Lohmann stated that he could not support this project with the current elevation and need to have a great elevation. Richard Seay stated that he is in favor of the elevation. Chairman Lohmann discussed the appearance of the roof structure from the bridge. Motion made by Jason Dubow to approve SP-92-99 with the condition that all the recommendations are complete prior to Commission Hearing, seconded by Richard Seay. FAU subsequently entered into a sublease with the US Navy on a portion of this property. The Navy intends to construct a 6,000 +/- square foot building on approximately five (5) acres. As this is a joint venture between the City, Florida Atlantic University and the Department of Navy, the traditional zoning and site plan regulations do not apply in this case. The subject property is zoned open • space and the land use designation is commercial. CMMEMO SEATECH SP-92-99.doc The proposed signage on the site was reviewed against the sign requirements for commercial and office uses. (Section 28.110). In this case the office sign regulations limit the height of the wall sign to 2 feet 4 inches and the area to thirty (30) square feet. Excluding the logo proposed on the building, the height of the proposed wall sign is 3 feet 8 inches and the area is approximately 27 square feet. Therefore, with the inclusion of the area of the logo, the proposed signage does not comply with the applicable criteria. Applicant has complied with staff and Planning and Zoning Advisory Board recommendations regarding irrigation and sign notes. SUPPLEMENTARY STAFF REPORT: FEBRUARY 22, 2000 This item was continued from the last City Commission meeting with direction to staff to confirm compliance with the parking requirements. Review of applicant's usage data, "cross-checked" against construction drawings, indicates Sea Tech is an educational/research facility. Required parking based on existing and new uses is as follows: CLASS ROOM AREA: 5,200 square feet of classroom area (1 parking space for each 60 sq. ft. of classroom area) requires 87 spaces. RESEARCH LAB: 6,200 feet of existing research area plus 5,700 sq. ft. proposed research lab area for a total of 11,900 sq. ft. (1 space for each 500 sq. ft. of gross floor area) requires 24 spaces. COMMISSION COMMENTS 10.1 Commissioner Cali-no comments 10.2 Commissioner Etling announced that the Broward League of Cities Millennium Time Capsule celebration has been rescheduled for Monday, February 28, 2000, at 11:00 a.m. at the Nyberq/Swanson House across the street from City Hall. Commissioner Etling clarified that this is not a City function, rather, a Broward League of Cities event which will include contributions in the capsule from other cities in Broward County. 10.3 Commissioner Mikes requested an update on the U-Haul case. City Attorney Ansbro reported that he has been contacted by an attorney for U-Haul who is processing a Special Exception/Text change through the Planning & Zoning Board for outdoor storage. City Attorney Ansbro mentioned that U-Haul lost the case in circuit court and that they had 30 days to file an appeal and the Code Enforcement Lien is still running. Commissioner Mikes directed City Attorney Ansbro to review the possibility of bringing back an Ordinance addressing regulating motor scooters. Commissioner Mikes requested more code enforcement in the southwest Griffin Road, area and mentioned the need for people to be cited for dumpster overflow. City Attorney ;. Ansbro advised that a repeat violator could be brought back before the Code Enforcement Board and the fine could be increased to $500.
