HomeMy WebLinkAboutR-2000-036 RESOLUTION NO. 2000-036 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN REQUEST SUBMITTED BY JACK STUDIALE, OWNER TROPICAL ACRES RESTAURANT, FOR PROPERTY LOCATED AT 2500 GRIFFIN RD., DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS, Jack Studiale, owner Tropical Acres Restaurant, has applied for site plan approval to expand and renovate the site's parking and landscaping areas for the restaurant located at 2500 Griffin Rd., Dania Beach; and WHEREAS, the Planning &Zoning Board on January 26, 2000, recommended that the City Commission grant the site plan request (SP-99-99), based upon the criteria set forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application (SP-99-99)for site plan approval, a copy of which is attached and made a part of this Resolution as Exhibit"A" is approved subject to the applicant, Jack , Studiale, owner of Tropical Acres Restaurant, adding three Washingtonian Palms in front of the billboard with 6 feet of clear trunk for the parcel across the street and a 24" Ficus or Coco Plum hedge adjacent to the fence along Griffin R-SP-99-99 tropical acres.doc 1 RESOLUTION NO. 2000-036 Road/25" Avenue for the purpose of screening cars in the lot on the north side of Griffin Road. It is further noted that the original Site Plan is maintained in the office of the Growth Management Department of the City of Dania Beach. Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically expire and become null and void unless building permits are obtained on or before 18 months from the date of this resolution. Section 3. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 4. That this resolution shall be in force and take effect immediately upon its • passage and adoption. Smith and Associates for Jack Studiale, Owner, Tropical Acres Restaurant. The request is for a Variance from Section 26- 43, Parking Lot Landscaping. (see also RZ-88-99 and SP 99-99) SP-99-99 - Site Plan request by Craig A. Smith and Associates for Jack Studiale, Owner, Tropical Acres Restaurant. The request is to expand and renovate the site's parking and landscaping areas. LOCATION: 2500 Griffin Road EXISTING ZONING: R-1 C/Commercial B-2 FUTURE LAND USE: RESIDENTIAL (5) PROPERTY SIZE: 1.66 ACRES +/- The applicant submitted an application to use additional property located south of the existing Tropical Acres Restaurant in order to expand the amount of restaurant parking. The property is currently being used for unpaved parking. No additional building square footage is proposed on the site. The applicant has submitted several applications in order to implement the development plan as follows: 1. Rezoning of the north 1.31 +/- acre portion of the existing restaurant site from County B-2 to C-2. (Approved) Page 1 2. Rezoning of the proposed parking from County B-2 and R-1 C to C-2 is using the 5% commercial flexibility rule. Variance from Section 26-43 related to existing nonconforming parking areas. (Approved) 3. VA-99-99 - Variance from Section 26-43 4. Site plan approval. Staff Recommendation (February 22, 2000): While staff supports approval of the variance and site plan in concept, staff requires additional time to finalize details on the landscape plan. As such, staff recommends that the variance and site plan be continued to the next regularly scheduled City Commission meeting so staff can work out these details with the applicant. Supplemental Staff Report (March 13, 2000): This supplemental staff report addresses the variance (#3) and site plan (#4). Variance: The applicant has attached a 8 '/2" x 11" planting detail for the site located across Griffin Road. The Commission required 4 to 5 Palm Trees (6 to 8 foot of clear trunk), a hedge, sod and/or other landscaping to obscure the sign base at the parcel on the opposite side of the street. The plan indicates three Washingtonians (4' clear trunks) and additional landscaping underneath the sign. The plan is acceptable as long as the palms provide at least six feet of clear trunk. Site Plan: The applicant has revised his site plan by adding additional landscaping along the residential perimeter of the new parking area, particularly along the east and west lot lines. The applicant has agreed to fill in the gaps in the hedge along the east lot line, and to provide a coco plum hedge on the residential side of the fence along the south and west lot lines. Supplemental Staff Recommendation (March 13, 2000): Approval of both the site plan and variance, subject to the three Washingtonian Palms in front of the billboard to provide 6 feet of clear trunk. 9918frROPICAL ACRES-1-13-00 Page 2
