FOR PUBLIX SUPERMARKETS SHOPPING CENTER TO BE LOCATED AT THE SOUTHWEST CORNER OF EAST DANIA BEACH BLVD. AND SE 5T" AVENUE, DANIA BEACH; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERANCE; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS, Herb Green,Avid Engineering representing Mark Sheldon of Regal Ventures, Inc., property owner, has applied for site plan approval for the proposed construction of a Publix Supermarkets Shopping Center to be located at the southwest corner of East Dania Beach Blvd. and SE 51h Avenue, Dania Beach; and WHEREAS, the Dania Beach City Commission adopted Resolution No. 2000-011.1 on January 25, 2000, approving the site plan request (SP-91-99) with extensive conditions, based upon the criteria set forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, including the condition that the revised site plan be resubmitted to the City Commission for review and approval; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That Herb Green, Avid Engineering representing Mark Sheldon of Regal Ventures, Inc. has submitted a revised site plan (SP-91-99)for the Publix Supermarkets Shopping 1 RESOLUTION NO. 2000-047 Center to be located at the southwest corner of East Dania Beach Blvd. and SE 5th Avenue, Dania 41 Beach. Section 2. That the revised site plan (maintained in the office of the Growth Management Department of the City of Dania Beach) does not meet all the conditions outlined in Resolution No. 2000-011.1 such that site plan approval can be granted solely on the basis of the revised site plan. Section 3. That the City Commission has reviewed the revised site plan for the Publix Supermarkets Shopping Center to be located at the southwest corner of East Dania Beach Blvd. and SE 51h Avenue, Dania Beach, and has approved the revised site plan provided that the Applicant (Herb Green, Avid Engineering representing Mark Sheldon of Regal Ventures, Inc., property owner) and Publix Supermarkets itself comply with the following conditions: 1. Applicant to install "S-Type" roof tile along mansard roof on north and east (5th Avenue) sides of building. 2. Applicant to provide $75,000.00 bond for traffic light signalization of East Dania Beach Boulevard/5th Avenue in a form acceptable to Broward County. For any portion of the bond which Broward County may refuse to accept, such portion shall be submitted to the City Growth Management Department in the form of a cash bond. This condition is to be completed prior to issuance of a certificate of occupancy. 3. Applicant to provide construction plans indicating a new sidewalk along SE 5th Avenue and pedestrian access from the sidewalk to the shopping center. 4. Publix to restrict truck deliveries to the time between 8:00 am and 8:00 pm, seven days a week. Publix Supermarkets agrees to provide, prior to issuance of the building permit, a letter to the City agreeing to this condition. 5. Publix to require truck drivers to turn off truck engines while loading and unloading. Publix Supermarkets agrees to provide, prior to issuance of the building permit, a letter to the City agreeing to this condition. 6. Publix to restrict pick-up/drop-off of trash compactors and dumpsters to those hours between 8:00 am and 8:00 pm, seven days a week. Publix Supermarkets agrees to provide, prior to issuance of the building permit, a letter to the City agreeing to this condition. 7. Applicant to provide south building elevation showing screening of the south side of the loading dock prior to issuance of the building permit. Building elevations are to be submitted and approved by staff prior to issuance of the building permit. 2 RESOLUTION NO. 2000-047 8. Applicant to provide south building elevation clearly showing full screening of roof top equipment from the ground floor elevation. Building elevations are to be submitted and approved by staff prior to issuance of a building permit. 9. Add a Note on Building Permit Landscape Plan: "Height of wall to be measured from grade of abutting new pavement to be installed on Publix side of wall". 10. Applicant to provide"title record"for review by the City Attorney, City Engineering consultant or both. Submission of title work and review of same to be completed prior to issuance of any building permit. 11. Applicant to provide on plan, prior to issuance of a building permit, an exclusive water and sewer easement along the south property line (away from screen wall) if so directed in writing by the City Public Works/Utilities Director. 12. Applicant to provide copy of recorded plat prior to issuance of any building permit. 13. Any outstanding Growth Management Cost Recovery Fees shall be paid in full prior to issuance of a building permit. 14. Applicant to remove (with the agreement of each affected condominium association)exotic and invasive plant species located on Meadowbrook property between the Publix and Meadowbrook Condominium parking areas. 15. Applicant to commit to a maximum difference in grade (approximately 20 inches based on the preliminary paving and drainage plan)between the existing Meadowbrook parking area and the proposed rear yard Publix pavement area. Said commitment shall be noted on the Construction Site Plan Drawings accordingly. 16. Applicant to allow the Meadowbrook Association IV to tag various Palm Trees within the exotic and invasive species area so that Meadowbrook Association IV can relocate said trees to Meadowbrook IV Property. 17. Applicant agrees to obtain a maintenance easement agreement from Meadowbrook IV and C in order for Publix to provide perpetual landscape maintenance on Meadowbrook's side of the wall. 18. Applicant to provide a ficus hedge to be interspaced between the proposed trees on the Publix side of the wall. Applicant shall revise landscape plans accordingly prior to issuance of building permit. 19. Applicant agrees to provide a 5' walkway to be located along the east side of the out-parcel for a walkway/crosswalk. The walkway/crosswalk shall be located directly west and adjacent to the landscape strip abutting the west side of the west access driveway. The walkway shall begin at Dania Beach Boulevard, continue south adjacent to the west driveway greenbelt, and continue through the shopping center parking lot (eliminating three (3) parking spaces, if necessary) to the shopping center sidewalk. Publix agrees to also provide the original pedestrian walkway as shown adjacent to the monument sign. 3 RESOLUTION NO. 2000-047 20. Applicant agrees to continue Royal Palm trees along the landscape strip adjacent to the proposed walkway referenced in condition No. 18,with the understanding that the walkway shall be located to the west of the Royal Palm trees. 21. With the understanding that a single vehicular entrance on Dania Beach Boulevard may resolve the median cut issue, applicant agrees to jointly work with Molly Hughes, of Hughes-Hall, Inc., the operators of Dania Jai Alai, and the City of Dania Beach in resolving the median closure issue by requesting that the District Engineer, Florida Department of Transportation, continue to permit the left turn median opening that has existed for 7 years with the understanding that there will not be any change to the throat depth of the driveway for Publix. In the event that FDOT denies the request, Publix shall be allowed to go forward with the two driveways as shown on the plan with the understanding that access onto Dania Beach Boulevard would be restricted to "right-turn in/right-turn out" only. 22. Applicant agrees to pursue a plat note amendment for the median opening. In the event that FDOT denies the request, despite the best efforts of all parties, Publix would be allowed to go forward with the two driveways as shown on the plan with the understanding that access onto Dania Beach Boulevard would be restricted to "right-turn in/right-turn out" only. 21. Applicant agrees to pursue a plat note amendment for the median opening. • Section 4. That based upon the criteria set forth in Section 8-4(p) of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically expire and become null and void unless building permits are obtained on or before 18 months from the date of the adoption of this Resolution. Section 5. That if any word, clause, phrase, subsection or section of this Resolution is for any reason held unconstitutional or invalid, the holding or invalidity shall not affect the validity of the remainder of the terms of this Resolution. Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 7. Principal Arterial Commercial Design Standards Overlay — The applicant is requesting that this requirement be waived and that they be allowed to use parapet roofs Site plan request for a Publix Shopping Center LOCATION: SW Corner of Dania Beach and SE 5th Ave., Dania Beach "Dania Beach Plaza Plat" EXISTING ZONING: C-2 Commercial FUTURE LAND USE: Commercial PROPERTY SIZE: 8.86 acres (385,759 sq. ft.) SURROUNDING ZONING: C-2 Commercial to the West, East and North; R-3A to the South (Meadowbrook Lakes Condo Assn.) SURROUNDING LAND USE: Commercial to the West and East; Commercial Recreation to the North; Medium High (25) to the South Page 1 • Both the variance and site plan received preliminary approval, subject to various conditions (including the condition that revised plans are to be submitted for staff and Commission review), at the January 25, 2000 City Commission meeting. While revised plans were submitted, a number of issues still needed to be resolved prior to Commission review. As such, staff advised the applicant that this item should be continued to the March 13, 2000 City Commission meeting. Applicant continued to request that he be placed on the February 22 agenda, and with the concurrence of the City Attorney, applicant's request was accommodated. The City Commission subsequently continued this item for one month, from the February 22, 2000 to the March 28, 2000 City Commission meeting. After many plan revisions, discussions with applicant, several hours of staff review, and on- site meetings with the representatives of Meadowbrook Condo Associations "C" and "Lakes View Phase IV", staff is now ready to bring this item back to the City Commission. Landscape Plans The plans in your backup should include preliminary paving and drainage plans, landscape plan, building elevations, and a survey (staff has the signed and sealed copy). The new landscape plan shows approximately 40 new trees along or near the rear lot line (24 trees required by Code). The City landscape consultant indicates the applicant has provided the requested 10% additional site landscaping. The 40 trees are located on both sides of a six foot screen wall. The screen wall runs roughly parallel to the rear property line and extends to within 50 feet of SE 51h Avenue right-of-way. Royal Palms (10' clear trunk) are shown along Dania Beach Boulevard and adjacent to the shopping center fire lane. Trees in the proposed greenbelt will be smaller in both caliper and height, and provide considerably less canopy foliage, than the existing (prohibited) exotic tree cover. Also, the proposed greenbelt tree canopy will take at least five years to mature. However, unlike the existing exotic tree cover, Publix will have a continuing obligation to maintain the new landscaping which they install pursuant to the plan. Meadowbrook Association C is located "on an angle" south of the supermarket building. Meadowbrook Phase IV is located south of a proposed retention area and partially south of the proposed supermarket building. Page 2 Meadowbrook Association C has requested that all exotic/illegal species be "removed from the area between Meadowbrook and the proposed Publix." Meadowbrook Association Phase IV appears to request the same thing, including the removal of all exotic/illegal species that may be on the Meadowbrook side of the property line. Phase IV has also requested that Publix not remove certain palm trees so that condo maintenance can reinstall said trees within the Phase IV property. It is my understanding that Publix has agreed, and the members of Phase IV are "tagging" the trees they want saved. Pavement Elevations The existing Meadowbrook parking lot elevations vary between approximately 6 and 7 feet. The proposed Publix pavement elevations (behind the store) appear to vary between approximately 6.5 and 8 feet. Based on the submitted preliminary paving and drainage plans, the back of the Publix pavement area will be higher than the Meadowbrook parking area. South of the supermarket, the pavement is shown as 4" to 20" higher the Meadowbrook • parking areas, depending on the location. Please note that this may change with final engineering plans. As such, it would be helpful if the applicant could commit to a maximum difference in grade between Meadowbrook and the pavement area to rear of the Publix store. Screen Wall The screen wall is measured from parking lot elevation on the "commercial" (Publix) side of the wall. As such, a six foot screen wall may vary from six to eight feet on the residential side (parking areas) of the wall. Please note the screen wall is not a sound proof barrier. Survey Phase IV residents are concerned that the submitted survey is not correct, affecting the location of the new landscaping and wall. While the City's engineering consultant indicates they can find no error in the survey, the survey was prepared without benefit of a title search. Page 3 ® Truck Traffic on SE 5'h Avenue With respect to truck traffic, the Commission has required Publix to provide a "channelized" rear yard truck driveway that will discourage south-bound right turns onto Fifth Avenue. This is indicated on the lower right hand side of the site plan (Applicant shows a 16' wide one-way north exit). Please note this will not prohibit trucks from using SE Fifth Avenue if drivers wish to exit by a less convenient means, or approach Publix on Fifth Avenue from the south. The channelized approach will however, discourage truck traffic from directly exiting the rear of the store onto southbound Fifth. Traffic Issues Staff has invited Ms. Hughes to attend the Commission meeting to answer any questions. Drainage Members of both Meadowbrook Associations indicate water has historically drained from the Meadowbrook into the Publix site. Residents are concerned the screen wall will cause water to back up on their property. • Staff has advised residents that the construction plans for paving and drainage will be reviewed by the Public Works/Utilities Department. Because the Meadowbrook drainage program is somewhat unique, staff has advised Meadowbrook residents to contact Public Works directly on this issue. Building Elevations Building elevations have been revised to indicate additional architectural features along the SE 5th Avenue frontage. Applicant has also wrapped the mansard roof around the east sides of the building. Mansard roofs cannot be located on the south side of the building since loading zones are located in these areas. A loading dock is indicated behind the store, as is a trash compactor. Staff has requested Publix to fully screen the loading dock. While Publix has provided a partial screen on the loading dock and what appears to be a roof, there does not appear to be an architectural feature to screen rooftop equipment from ground level view. Page 4 Public Works Copies of preliminary paving and drainage plans have been submitted to the Public Works/Utilities Department for review. Applicant is advised that additional site plan changes may be required by the Public Works Director upon reviewing working construction drawings. Please note that substantial changes may require resubmission to the City Commission. STAFF RECOMMENDATION To avoid any confusion at later date, staff recommends that proposed conditions, beyond those recommended by staff, be specifically included in the approval motion for both the variance approval and the site plan approval resolutions. We just received a revised copy of the revised Publix Site/Landscape Plans. While these plans have not yet been reviewed, we are reserving a copy for you to pick-up at our office. It is my understanding your condominium is located along the eastern portion of the Publix rear lot line. Please clarify the exact boundary. We will need a precise location where Condominium C ends and the next condominium begins in the event the adjacent condo requests existing, non-native landscaping to remain. The revised landscape plan details the new landscaping to be planted adjacent to your condominium parking area. As I explained to you, the new trees will be smaller in both caliper and height. and provide considerably less canopy foliage than the existing exotic tree cover. Also. the tree canopy will take at least five years to mature. However, unlike the existing exotic tree cover, Publix will have a continuing obligation to maintain any new landscaping which they install pursuant to the plan. Regarding the Fifth Avenue building elevation, the applicant has submitted elevation plans of all sides of the building. By the time you receive this letter, we will have a copy of said elevation for you to pick up. It is our position that all foliage should be removed from the area between the Meadowbrook Lakes property and the new Publix property, and that a six-foot concrete fence should be constructed. We understand that new foliage will replace that which is being removed from our property, and that the elevation of Fifth Avenue around the Publix loading dock will be improved and beautified. Additionally, pursuant to our previous agreement, delivery trucks serving the Publix will not use Fifth Avenue; rather, they will enter and depart via Dania Beach Boulevard. We have agreed to all of these things, however we would appreciate your intervention regarding our greatest remaining concern. Once the existing drainage area between the two properties is replaced with the concrete fence, we fear that there may not be adequate drainage on our property resulting in water backing up in the parking areas of 190 and 170 Southeast Fifth Street. We would welcome further discussion on this issue and some assurance that this potential problem can be averted. The Applicant has revised the site plan reflecting comments made for and during the January 25th Commission Meeting: the Applicant has provided a 50-foot throat for the western drive and a 38-foot throat (which in this case is adequate) for the eastern drive off of Dania Beach Boulevard. The site plan shows the requested cross-access easement to the outparcel located at the northwest corner of the site. The driveway located at the southeastern corner of the site has been curved northward to discourage right-turns onto SE 5th Avenue. The following two remaining conditions are recommended for consideration during site plan approval: • The driveway at the southeast comer of the site shall be constructed with curbing and the lane width shall be no greater than 14 feet. • The petitioner shall provide a bond for $75,000 to be used toward one half the construction of a signal at the intersection of Dania Beach Boulevard and SE 5th Avenue. The site plan continues to show two right-tum-in/right-tum-out only driveways on Dania Beach Boulevard, accompanied by the required closure of the existing median opening. Should the Commission wish to maintain the existing median opening, FDOT would only accept such a condition in combination with a single, centrally located driveway on Dania Beach Boulevard which would allow ?101 N. As you can see, 'here are a number of outstanding issues. including but not limited to. defining the contour elevations in your retention areas, non-compliance with some zoning code requirements, and resolution of landscaping and drainage issues along the south property line. We have not yet received revised architectural plans per comments transmitted to Herb Green and your architect on February 4, 2000. Issues include changes to the parapet roof. providing an architectural site plan reflecting the changes to the front of the building, and architectural features on the SE 51h Avenue frontage. These items were all discussed at the City Commission meeting of January 25. 2000. As I explained to you yesterday, there is insufficient time to resolve this many issues prior to completion of our City Commission staff report. and as such. The plans do not provide sufficient detail as to where the wall and new landscaping are to be installed relative to the drainage easement and existing drainage ditch. Information is also not provided as to how the "phasing plan". required by the City Commission. will be accommodated. No explanation is provided as to the how the wall will be constructed within the drainage ditch. Staff recommends that a landscape/drainage plan detail for the south property_ area. showing said area with all new required landscaping on both sides of the wall. i 4. The following is a summary of the current status of the plan vis a vis the conditions discussed at the January 25th Commission Meeting. • 1. The Commission requested and the Petitioner agreed to install a pedestrian friendly walkway along Dania Beach Boulevard with a centrally located "pedestrian-gateway" connection to the parking lot at the monument sign. The revised plan reflects this. 2. The Commission requested and the Petitioner agreed to bond for$75,000 toward the cost of signalizing the Dania Beach Boulevard/SE 5th Avenue intersection. 3. The Commission requested and the Petitioner agreed to restrict outbound delivery trucks to left-turns only when exiting the rear service driveway onto SE 5th Avenue. Though the site plan shows signing and markings indicating this condition, the outbound right-turn movement would still be possible_ In a conversation with the Petitioner's Engineer on February loth, an agreement was reached to reduce the driveway width and curve the driveway connection to SE 5th Avenue (northward) to physically eliminate the outbound right-turn movement. 4. The Commission requested and the Petitioner agreed to provide fifty feet of clear throat at the Dania Beach Boulevard access points. The revised plan reflects this condition at the westem access, but the eastern access provides only 42 feet. The Petitioner also agreed to provide a cross access easement from the west Dania Beach Boulevard driveway to the northwest parcel(Parcel 2). All traffic conditions listed at the January 25th Commission Meeting have been reflected on the February 3rd site plan or agreed to subsequently by the Petitioner. Consistent with Commission discussion, the site plan continues to show two driveways on Dania Beach Boulevard, both right-in/right-out only, accompanied by the closure of the existing median opening. Should the Commission wish to maintain the existing median opening, HHl has reached an agreement with the Florida Department of Transportation that would allow for its continued use. FDOT would permit a single, centrally located driveway on Dania Beach Boulevard allowing outbound left-rums but prohibiting westbound left-tums into the project driveway.
