A RESOLUTION OF THE CITY OF DANIA BEACH,
FLORIDA, APPROVING THE SITE PLAN REQUEST
SUBMITTED BY NICK BLOUNT, FLORIDA POWER AND
LIGHT, FOR PROPERTY LOCATED AT 2801 SW 36T"
STREET, DANIA BEACH; PROVIDING FOR CONFLICTS;
FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the
City of Dania Beach, Florida, states that a site plan is required as a condition to the
issuance of a building permit; and
WHEREAS, Nick Blount, representative for Florida Power and Light, has applied for
site plan approval for the proposed construction of an electrical substation to be located at
2801 SW 36th Street, Dania Beach; and
WHEREAS, the Planning &Zoning Board on January 26, 2000, recommended that
the City Commission grant the site plan request (SP-104-00), based upon the criteria set
forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania
Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application (SP-104-00)for site plan approval, a copy of
which is attached and made a part of this Resolution as Exhibit "A", is approved with the
following conditions:
(1) Provide written approval from the Broward County Aviation Department prior to
building permit.
(2) Applicant to dedicate 35.03 feet right-of-way for Collins Road (SW 36th Street),
by instrument to be approved by City Attorney, prior to FPL station going "on-line."

(3) FPL to provide cash bond for sidewalk construction and the bond to be used for
municipal purposes if sidewalk nor constructed at the FPL site.
(4) Provide an access easement (or reservation) to the undeveloped portion of the
FP & L parcel prior to issuance of building permit.
(5) Obtain tree removal permit prior to issuance of a building permit.
(6) Building color indicated as beige.
(7) Applicant agrees to provide the City a Declaration of Restrictive Covenants for
the back parcel with a restriction that the parcel would be used for conservation
purposes.
It is further noted that the original Site Plan (SP-104-99) is maintained in the office of
the Growth Management Department of the City of Dania Beach.
Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of
Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals
shall automatically expire and become null and void unless building permits are obtained
on or before 18 months from the date of this resolution.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

FPL COLLINS SUBSTATION
As an unmanned facility, FPL will have no employees report to the site. However, crews
(normally 2-man) will visit the site, on average, 2 times per month to perform normal
monitoring and maintenance of the electrical equipment. Crews will also be on site to
mow grass and to inspect the landscaping and stormwater management system. This
facility will not create any hazardous or solid wastes.
Collins Substation will be designed and constructed in accordance with all applicable
electrical utility industry standards and governmental regulations.
Electric power is necessary for the public safety, health and welfare of the citizens of the
City of Dania Beach. Collins Substation will improve FPL's ability to continue to provide
safe and reliable electrical service to our customers.
LEGAL DESCRIPTION
The East 400 feet of the West 700 feet of the South one-half(S 1/z)of the Southeast one-quarter(SE I/a)of
the Southwest one-quarter(SW 1/a)of Section 20,Township 50 South,Range 42 East,Said lands lying and
being in Broward County, Florida. Containing 273,308 square feet(6.2743 acres,more or less).

REQUEST: SE-103-99 — Special Exception Request to allow for the
construction and operation of an electrical substation in an
M-1 (Proposed IROM) zoning district.

Florida Power and Light proposes to construct an unmanned electrical
substation. This use is permitted as a Special Exception within the M-1 district
through pyramidal zoning to C-1 as an essential service. The City proposes to
rezone the subject property from M-1 to IROM. This use will also be permitted
as a Special Exception in the IROM district.

The total parcel consists of approximately six (6) acres. The subject parcel is 3.1
® acres (southern part) and the proposed building is approximately 19 feet by 28
feet, or approximately 500 square feet. The property is located on the north side
of Collins Road between Southwest 30th Avenue and Southwest 26th Terrace.
Please note the following regarding this proposed use:
1) No Dumpster is provided as this is an unmanned facility.
2) Designated parking spaces are not provided (unmanned facility). The site
can accommodate up to eight parking spaces.
3) Building color indicated as "beige.
Staff Recommendation (February 22, 2000):
Special Exception: Approval subject to the following:
1) Provide written approval from the Broward County Aviation Department
prior to building permit.
2) Applicant to dedicate 35.03 feet right-of-way for Collins Road (SW 36th
Street), by instrument to be approved by City Attorney, prior to issuance of
building permit.
3) Sidewalks to be provided along Collins Road prior to issuance of a
certificate of occupancy.
4) Provide an access easement to the undeveloped portion of the FP & L
parcel prior to issuance of building permit.
5) Obtain tree removal permit prior to issuance of a building permit.
6) Building color indicated as beige.
Site Plan: Approval subject to the above conditions.
Supplemental Staff Recommendation (March 13, 2000):
The applicant has provided a tree removal plan and "environmental assessment"
that describe site conditions relative to vegetation, wetlands, etc. A "vegetation
summary" is provided on the tree removal plan. While no Royal Palms are
indicated on the tree removal plan, the environmental assessment identifies 20
of these same trees in the wetland area.
Supplemental Staff Recommendation (March 28, 2000):
The applicant has submitted revised plans, but did not provide sufficient time for
staff review. Staff will comment on the status of the environmental assessment
and tree survey at the City Commission meeting. The following

Staff does not support a sidewalk waiver in exchange for the applicant placing a
cash bond with the City for sidewalk construction.
It is difficult for Staff to allow the applicant to delay dedication of ROW until a
certificate of occupancy is issued since there is no building permitting occupancy
proposed at this location.

Dear Mr. Leeds:
The timely completion of Collins Substation due to its criticality prompts Florida Power
&Light to make two requests regarding the City's staff recommendations.
We request that we be allowed to submit a cash bond in lieu of constructing the sidewalk
at this time. We understand this has taken place with other developments in similar
situations. When the City's plans for improvements to Collins Road are finalized or when
the development of the area necessitates it, the sidewalk construction can occur.
Secondly,we request that the 35' parcel for road use be deeded to the City prior to the
issuance of a certificate of occupwicy rather than a building permit.Florida Power&
Light is in the process of condemning for the parcel. However,due to the criticality of
this project, it is imperative that construction of the substation commence as soon as
possible and as soon as the process is complete,we will deed the parcel to the City.

and are providing eight (8) copies for your use. I have also included copies of the
environmental report prepared by Cotleur Hearing, Inc. which identifies the vegetation
and the wetland condition of the parcel.
The south delineation line of the wetlands area as indicated on the drawings as "Preserve
Area" was verified on January 6, 2000 by Mr. Mark Wallace, Natural Resource
Specialist, Wetlands Resource Section, Broward County Department of Planning and
Environmental Protection(DPEP).

Revised Environmental Assessment
Introduction
Florida Power & Light Company has proposed to purchase a 5.95-acre site in Broward County,
Florida for construction of an electrical distribution substation. An additional substation is
needed to meet the growing needs of the surrounding area and the electrical power needs of
the Fort Lauderdale Airport. The purpose of this report is to evaluate the ecological resources
associated with the selected site, to identify the presence of jurisdictional wetlands and the
potential for threatened, endangered or species of special concern to exist on site.
Location
The subject site is located within Broward County within the general vicinity of the Port 95
Commerce Site. The site is located on the north side of SW 36th Street approximately 1 block
east of SW 30'h Avenue, which is the main north south corridor through the Port 95 Commerce
Park. Access to the site exists directly from SW 36`h Street. SW 36th Street is an improved right-
of-way that was upgraded with the development of the Port 95 project. Type F curb and gutter
and Live Oak street trees exist on both sides of the right-of-way. A curb cut and gated entrance
into the site currently exists.
® Surrounding Development
The area of the site is classified "Land Use" in transition. Most of the lands to the south and
west have been assembled to be a part of the Port 95 Commerce Park. Zugars, an active
ornamental nursery, exists to the immediate west of the site. To the north of the site exists
vacant land recently acquired by the Broward County Airport Authority. This land is reflected on
old aerial photography as a mobile home park. To the east exits a small "private nursery" and
homestead To the south exists Parcel C of the Port 95 Commerce Park. The Fort Lauderdale
International Airport exists approximately '/2 mile to the east. The subject site is in the glide path
of the primary east west runway. Florida Power & Light Company's Lauderdale Power Plant
exists approximately% of a mile to the southwest.
Historically;the surrounding area was dominated be agricultural, nursery, and mining uses.
Runway Growers Nursery, Zugars, and the private nursery to the east are the last of the historic
land uses to persist.
Existing Conditions
The subject property can best be described as an abandoned ornamental nursery. A
homestead, which was occupied on the date of this evaluation, continues to exist in the
southwest;quarter of the site. A chain link fence defines the western and eastern boundaries. A
distribution feeder exists along SW 36th Street within the right-of-way. It is not known if
easements exist on the subject property.

The site's existing condition is extremely disturbed. Old abandoned nursery equipment, trailers,
abandoned trucks and other debris can be found throughout but predominantly in the south half
of the site. Several piles of vegetative debris mixed with construction materials were identified.
For the most part the debris observed included vegetative debris, old tires, concrete rubble, and
old nursery pots. The Geotechnical firm of Ardaman and Associates excavated a number of
these piles during exploratory activities on Saturday, July 10, 1999. No items of additional
concern were identified.----------,-,,
The north half of the site contains extremely disturbed jurisdictional wetlands. The wetland
persists due to the low elevation of the site in comparison to surrounding lands and the
presence of Okeelanta Muck soils. Two elongated excavations containing open water exist
iwithin the general boundaries of the wetland area. The largest of these exists just to the
i northeast of the existing homestead. This area is approximately 60' wide by 100-200' long.
Another open water approximately 30' wide extends along the eastern property boundary. No )
environmentally significant vegetation exists within either of these open water areas, which
I appear to have been excavated to support the previous nursery operation. It is the opinion of
the geotechnical engineers that these areas are likely 10' deep, although no soundings have
been performed.
The wetland area in the north half does include fingers of upland fill areas, which extend from
the south. The predominant vegetation within the wetland area is common sugar cane. The little
canopy vegetation that was observed consists of ornamental palms, exotic trees, and few
scattered laurel oaks and a single red bay tree. Approximate 20 large royal palms were 1
identified with the general confines of the wetland area. The ground cover observed was not the
\ typical wetland vegetation. This stratum was dominated by sugar cane with alligator weed and
Hydrocotyle. A few small and widely scattered leather fem and coastal plain willow were
observed.
The wetland area is estimated to cover approximately 1.5-2.5 acres of the site. The wetland will
need to be delineated to minimize the extent of wetland area to be claimed. After the wetlands
are flagged they will require confirmation by the jurisdictional agencies.
On December 16-17, 1999 Florida Power and Light provided a revised Collins substation site
plan and requested that an evaluation of only the southern half of Parcel. H be undertaken. The
newly defined area contains 3.45 acres and is 400.49 feet wide by 375.37 feet deep. The
northern extent of this area was defined by an abandoned mobile home which occurs to the
north of the new proposed fence line.
The south portion is an upland area that contains a diverse mixture of ornamental, native and
exotic vegetation. No natural upland vegetation communities as defined by the Broward County
Comprehensive Plan exist on site. The dominant canopy vegetation consists of royal palm,
ficus, strangler fig, live oaks, coconut palms, eadeaf acacia, bananas, black olive and tropical
almond. The shrub and ground covers consisted of crotons, Heliconia, pothos vine, ragweed,
Wedelia, and nut grass. A more detailed inventory will be included in the final report. Much of
the ornamental vegetation is considered suitable for relocation and could be sold or
incorporated into the project's landscape scheme. One large live oak located in the southeast
quadrant is worthy of preservation. Two other large live oaks exist, however are in poor health,
overgrown with vines and believed to have heart rot. A few small cypress trees exist near the
ornamental pond located proximate to the existing homestead in the southwest comer of the
site.

A small, excavated pond is present in the south central portion of the site, to the east of the
existing asphalt driveway. A few small bald cypress trees are present in this pond. This pond
appears to be maintained by water from a 2-inch well and is used to irrigate nursery/landscape
vegetation.
Threatened Endangered and Listed Species of Special Concern
The only wildlife observed on site included a night heron, a great egret and raccoon tracks. The
project surveyors indicated siting of several 2-3' exotic iguanas. Based on the extreme disturbed
condition there is a very low potential for the site to be utilized for the nesting or denning of
listed species.
Transmission Line Tie In
This distribution substation will be energized from the Sistrunk - Lauderdale transmission line
that exists to the east along SW 26 h Street. It is proposed that a double circuit line be extended
from the transmission line to the west within the Airport Authority property to the north of the
site. There are no special environmental considerations that have been identified with this
activity. Some consideration has been given to extending a single circuit line along the north
side of SW 36t' Street overbuilding the existing distribution line within road right-of-way. This
alignment may require the trimming of several large trees east of the site.
Soils
The Soil Conservation Service Soils Atlas for Broward County depicts the site as containing
Basinger fine sand and Okeelanta Muck, map symbols Ba and Ok respectively. The Basinger
fine sand is located on the south half or upland portion of the site. The Okeelanta Muck is
confined to the wetland areas in the north half of the site.
Basinger fine (Ba) sand is a nearly level, poorly drained, sandy soil found in broad sloughs or
flats. Under natural conditions these soils support myrtle, slash pine and native grasses.
Scattered cypress exists in lower inclusions. Under natural conditions ground water is close to
the surface during the wet season and between 10 and 40 inches during the dry season.
Okeelanta Muck (Ok) is a nearly level, poorly drained, organic soil underlain be sand at a depth
of 16 to 40 inches. This soil is found in large and small freshwater marshes, sloughs and
drainage ways east of the Everglades. This soil type remains saturated most of the year.
Okeelanta Muck is a hydric soil type. The soils were saturated with standing water above the
surface within lower elevations at the time of this evaluation. This soil type largely corresponds
with the wetland area on the site. Disturbed areas of higher elevation no longer exhibit wetland
characteristics.
Permits
Development of the northern portion of the site will require an Environmental Resource Permit
from the FDEP and a 404 Nationwide 26 Permit from the USACOE. Additionally, a Broward
County Fill License will be required. Development in the northern wetland area will require
compensatory mitigation. It is acknowledged however, that the quality of the wetland area is of
low functionality. It is estimated that the northern wetland area would achieve a WBI or WRAP
assessment score ranging between 0.25 and 0.40.

The southern portion of the property is a heavily disturbed upland with the exception of the small
excavated pond mentioned above. This pond could be avoided and left intact or incorporated
into a stormwater management pond. By simply modifying the southwest corner of the
proposed substation fence line this pond can be left without impact. Leaving the pond intact
without impact eliminates the requirements of obtaining an environmental resource permit from
the Florida Department of Environmental Protection and a 404 permit from the Corps of
Engineers. It also eliminates a fill license from Broward County and expensive mitigation costs.
Along the eastern side of the property there are several large trees, live oaks, schefflera, mango
and other species, which will require removal in order to bring the transmission conductors into
the substation. No wetlands were found in this area.
The wetland on the northwest side of the north portion of the site extends an estimated 30-40
feet below into the mid-point of the entire parcel. The soils are muck soils (hydric) but all
vestiges of native wetland vegetation are gone. The area is vegetated by sugarcane, wedelia
and numerous weed species.
Compensatory Mitigation:
Impacts to the northern wetland area will require compensatory mitigation. Due to the disturbed
and isolated condition of the wetland on-site preservation or mitigation is not recommended.
Offsite mitigation at a regional mitigation bank or regional offsite mitigation area will provide the
most sustainable benefits in the long term.
Special Considerations:
1. A Phase I and Phase II environmental audit is recommended due to the known levels of
contamination within the Port 95 area and the past use of the site.
2. Functional assessments will need to be conducted to verify the required mitigation for the
project. (WBI -Wetland Benefit Index) (WRAP —Wetland Rapid Assessment Technique)
Conclusion:
The southern portion of the site is considered suitable for the development of an electrical
distribution substation, subject to the above special considerations. Based on the existing land
use, zoning and adjacent properties this site may be suitable for mixed used development.
