HomeMy WebLinkAboutR-2000-059 RESOLUTION NO. 2000-059 A RESOLUTION APPROVING THE SIGN ADJUSTMENT REQUEST SUBMITTED BY ROBERT FRONEK, DANIA BEACH FLORIST, FROM CHAPTER 28, ZONING, ARTICLE 28, SIGNS. DOWNTOWN DANIA REDEVELOPMENT DISTRICT SIGN REGULATIONS, FOR PROPERTY LOCATED AT 64 SOUTH FEDERAL HWY., DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances Chapter 28 Zoning, Article 28, Signs, sets the signage criteria for specific zoning districts within the City of Dania Beach; and WHEREAS, Robert Fronek, Dania Beach Florist, has applied for a sign adjustment (SA- 101 B-99) to allow for signage which is in excess, not permitted or prohibited from the allowed signage regulations in the Downtown Dania Redevelopment Zoning District for property located at 64 South Federal Hwy., Dania Beach; and WHEREAS, the Planning &Zoning Board on March 15, 2000, recommended that the City Commission grant the sign adjustment request SA-101 B-99 based upon the criteria set forth in Article 28, Section 28.200. "Relief from requirements; Sign Adjustment; Variances", of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application SA-101 B-99, for a sign adjustment from Chapter 28 Zoning, Article 28, Signage, Downtown Dania Redevelopment District Sign Regulations, a copy of which is attached as Exhibit "A" is approved with the following conditions: A. Robert Fronek, Dania Beach Florist, agrees to plat a hedge on the east and south side of the building, except where window glass exists; B. Robert Fronek, Dania Beach Florist, agrees to place two(2)trees on the east side of the building (one tree between the awnings and one tree on the corner). fkl� C. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. That this resolution shall be in force and take effect immediately upon its passage and adoption. Downtown Dania Beach Redevelopment District sign regulations. Applicant requests: 1) two wall signs on U.S. 1 be allowed to remain (only one wall sign allowed under code, one sign must be removed), and 2) wall sign on SW First Street be allowed to remain (wall sign on SW First must equal 25% of the permitted wall sign on U.S. 1) • STAFF RECOMMENDATION: The requested sign adjustments do not meet the Sign Adjustment Criteria indicated on Section 28.200 (1) of the Dania Beach Zoning Code. Two Wall Signs on Federal Highway: Denial. Applicant is allowed only one wall sign per code. Wall ("Box") Sign on SW First Street: Denial. Applicant is allowed one sign equal to 25% of the sign permitted on Federal Highway. PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION: Two Wall Signs on Federal Highway: Approve the "Florist" sign. Deny the "Dania Flower Shoppe" sign, removing said sign within 60 days of City Commission action. Wall ("Box") Sign on SW First Street: Approval (Applicant to be allowed change copy).
