HomeMy WebLinkAboutR-2000-074 RESOLUTION NO. 2000-074 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO FILE A GRANT APPLICATION FOR THE ACQUISITION OF LAND FOR THE COMPLETION OF GRIFFIN MARINE PARK, UNDER THE FLORIDA COMMUNITIES TRUST PRESERVATION 2000 GRANT PROGRAM IN PARTNERSHIP WITH BROWARD COUNTY; PROVIDING FOR A CASH MATCH NOT TO EXCEED $240,000; AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS AS THE AUTHORIZED REPRESENTATIVE OF THE CITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA; Section 1. That the application with the Florida Communities Trust Preservation 2000 grant program, in partnership with Broward County, for the acquisition of two parcels of land (folio #'s 01-096 and 01-094) for the completion of Griffin Marine Park, in substantial form as Exhibit "A", attached, is approved and made a part of this resolution. Section 2. That Michael Smith, City Manager, as authorized representative of the City of Dania Beach, may execute all documents and expedite a cash match not to exceed $240,000 through the Florida Communities Trust Preservation 2000 grant program for the completion of Griffin Marine Park. Section 3. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 4. A SBRO CITY ATTORNEY RESOLUTION NO. 2000 -074 FLORIDA COMMUNITIES TRUST PRESERVATION 2000 PROGRAM GENERAL INSTRUCTIONS FOR APPLICATION FORM FCT/P2000-4 (Effective 2-10-98) Use the attached application form to apply for funding from the Florida Communities Trust's Preservation 2000 Program. The instructions provided here are general instructions. Carefully read Rule Chapter 9K-4, Florida Administrative Code, for complete details about types of projects that may be funded, criteria by which proposals are evaluated, schedule of submissions and review, and other important information. ELIGIBLE APPLICANTS All local governments are eligible to apply for funding from the Trust. Prior to receiving final project approval and acquiring the site, the local comprehensive plan of an applicant, and the applicant's partner(s) if any, must either be found in compliance, as defined in Rule 9K-4.002(18), Florida Administrative Code, or the local government(s) must have executed a stipulated settlement agreement with the Department to resolve all of the issues raised by the Department in a statement of intent to find a plan not in compliance issued pursuant to Section 163.3184(8), Florida Statutes. PREPARING THE APPLICATION PACKAGE Type the answers to all questions as completely as possible. Include all information requested. Follow all Ostructions. The application form is available on computer diskette in WordPerfect 8.0 software. Contact the Florida Communities Trust to order the diskette. For information requested on pages 1-4, type responses directly on the application form. For information requested on page 7 "Project Information," type the headings of the sections on separate paper using as much space as needed to fully respond. Do not change or delete any part of the application form. Do not repaginate pages 1-4. For guidance in drafting a conceptual management plan, refer to Florida Communities Trust Technical Bulletin #1—Drafting a Conceptual Management Plan. Label each exhibit as directed on page 8,prepare a Table of Exhibits, and insert the table and exhibits at the end of the application. If an exhibit is not provided or is "not applicable"to the project, include a typed response explaining the omission in place of the exhibit. Consider inserting tabs to separate the exhibits. For the "Project Evaluation Criteria" information requested on pages 10-16, type the headings, the number/letters, and questions on separate paper, using as much space as needed to fully reply. When answering criterion questions in Section (1)(b) "Local Comprehensive Plan Provisions..." (pages 10-12 of the application), rovide a citation of all relevant plan objectives and policies that relate to that criterion and are furthered by e acquisition of the project site. EXHIBIT "All Where a criterion does not apply to the proposed project, type "Not Applicable" in the response to the criterion. Criterion that are missing or not answered will not be evaluated,will not be considered incomplete in the Notice of Completeness, and no points will be awarded. OUBMITTING THE APPLICATION Submit ten complete sets of materials. One set must contain original text and non-text items. The remaining nine sets may contain legible first generation copies of text and non-text items. Only one set of original photos are required for Exhibit N. The Trust requests that applications be submitted in l0l/z inch by 11'/2 inch three ring binders, deep enough to hold all the application materials. Set up each notebook in the same order as the application form, except the Exhibits, which should be placed with a Table of Exhibits in back of the application materials. Transmit the application with an original signature cover letter on local government letterhead, signed by the appropriate local government official or administrator, binding the local government to fulfill the commitments made in the application, and identifying the local government employee that will act as the key contact between the Trust and the applicant local government(s). If using US Postal Service, mail complete application packages to the Executive Director, Florida Communities Trust, 2555 Shumard Oak Boulevard, Tallahassee, FL 32399-2100. DEADLINES Florida Communities Trust strictly adheres to deadlines. Deliver or mail applications to the locations given above by the deadline for the application period published in the Notice of Application Period in the Florida Administrative Weekly. Applications received after the deadline shall not be considered by the Trust, except as provided in Rule 9K-4.007(2), Florida Administrative Code. COMPLETENESS REVIEW Rule 9K-4.007, Florida Administrative Code, describes the procedures to determine application completeness. Prior to transmitting the application package, be sure that the application is complete. EVALUATION OF APPLICATION Applications shall be evaluated as submitted by the application deadline. No additional information shall be accepted after the application deadline, unless specifically requested by the Trust staff for clarification purposes during the evaluation of the application. Applications will be evaluated in the context of the information submitted (e.g., maps and photos), site visits and technical review comments from relevant state agency staff. CONCEPTUAL MANAGEMENT PLAN AND SOURCE OF FUNDING FOR MANAGEMENT [Rule 9K-4 . 004 (5) (d) , F.A. C. ] Lands acquired using Preservation 2000 funds shall be managed to make them available for public recreational use, provided that the recreational use does not interfere with the protection of natural resource values . FCT/P2000-4 (Effective 2-10-98) 9 PROJECT EVALUATION CRITERIA Answer the following questions, where applicable to the proposed project ite . Where appropriate, the applicant is to reference any materials ubmitted, including the portions of the local comprehensive plan, technical support documents, and Exhibits A-N. Note: Retype the question, including headings and numbers-letters on separate paper, using as much space as needed to fully reply. Where a question does not apply to the proposed project, type "Not Applicable. " Any criterion which is not addressed or is left blank will be considered to be "Not Applicable" and will not be evaluated. (1) Furtherance of Growth Management and Comprehensive Plan Implementation [Rule 9K-4 . 008 (1) (a-b) , F.A. C. ] (a) Growth Management Objectives . The project supports and furthers growth management objectives as they relate to natural resource conservation, coastal protection, and outdoor recreation. 1 . Does the proposed project assist the applicant in ensuring the proper location and distribution of development by redirecting development away from a coastal or other high hazard area or a 100-year flood plain? Discuss how the antiquated subdivision or the vested land use is in conflict with the adopted comprehensive plan. Cite the specific objectives or policies in the comprehensive plan or the specific land development regulations that are in conflict with subdivision or vested land use . (10 points) ; 3 . Does the proposed project provide additional outdoor recreation opportunities within the existing urban service area? If so, provide a copy of the Future Land Use Map showing the designated Urban Service Area or other similar designations that have been formally adopted by the local government on its Future Land Use Map or provide documentation that the project site is located in a built-up area where public facilities and services such as sewage treatment system, roads, schools, and recreation areas, are already in place . (10 points) . (b) Local Comprehensive Plan Provisions for Conservation, Coastal Management, and Outdoor Recreation and Open Space . Acquisition of the project site will assist the local government in furthering the local comprehensive plan directives set forth in the objectives and policy statements contained in the plan elements that provide for conservation, coastal management, and outdoor recreation and open space . When used in this part, the term '-furthered' ' means that proposed projects will FCT/P2000-4 (Effective 2-10-98) 10 assist the local government in realizing goals, objectives, or policy directives of the comprehensive plan. For each criterion that is furthered by an objective or policy of the local government comprehensive plan, the objective or policy number is to be cited in the response to the criterion and a copy of the objective or policy, and any associated exhibits or documents, shall be included as an exhibit as described in 9K-4 . 004 (4) (b) 4 . , F.A. C. If a copy of the entire objective or policy that is cited in response to a criterion is not included in the exhibit, that objective or policy will not be evaluated as to whether it is furthered by that criterion. 1 .
