HomeMy WebLinkAboutR-2000-093 • RESOLUTION NO. 2000-093 A RESOLUTION APPROVING THE VARIANCE REQUEST SUBMITTED BY UDO WEIDAUER, AS PRESIDENT FOR DERECKTOR GUNNELL, INC., FROM CHAPTER 28,ZONING,ARTICLE 4.20 SCHEDULE OF LOT,YARD AND BULK REGULATIONS, FOR PROPERTY LOCATED AT 775 TAYLOR LANE, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, Zoning, Article 4.20, sets the Lot, Yard and Bulk requirements for the City of Dania Beach; and WHEREAS, Udo Weidauer, President of Derecktor Gunnell, Inc. has applied for a variance (VA-22-00)to allow for a 55 foot high"Marine Membrane Tent"structure to be permitted where the height requirement for the I-G zoning district is limited to 35'feet, for property located at 775 Taylor Lane, Dania Beach; and WHEREAS, the Planning & Zoning Board on May 17, 2000, recommended that the City Commission grant variance request VA-22-00 based upon the criteria set forth in section 10.13 of ® Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-22-00, for a variance as described above (from requirements in Chapter 28, Zoning, Article 4.20 Schedule of lot, yard and bulk requirements), a copy of which is attached as Exhibit "A" is approved and the appropriate city officials are directed to execute same. Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. STAFF REPORT ® GROWTH MANAGEMENT DEPARTMENT TO: Michael Smith, City Manager FROM: Laurence Leeds, AICP, Director Growth Management RE: Variance To Allow A 55 Foot High "Marine Membrane Tent" Structure (Maximum Permitted Height: 35 Feet) LOCATION: 775 Taylor Lane DATE: June 27, 2000 City Commission Meeting APPLICANT: Derecktor Gunnel ("D-G") In 1998, D-G submitted a site plan for a number of additions to their property. One of the additions included a 55 foot membrane tent. The Commission approved the tent, ® among other items, but did not grant a variance to allow the 55 foot height (The existing zoning limits maximum height to 35 feet). The tent was erected without a permit. As part of bringing the tent into compliance with building, fire, zoning code requirements, the applicant has submitted a request for a height variance. Subsequent to the Planning and Zoning Advisory Board Hearing, staff received the attached correspondence from the Broward County Aviation Department ("BCAD") relative to compliance with Federal Aviation Administration ("FAA") height restrictions. RECOMMENDATION Staff has no objection to approval of the height variance subject to FAA/BCAD approval.
