HomeMy WebLinkAboutR-2000-096 RESOLUTION NO. 2000-096 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN REQUEST SUBMITTED BY JEFF FALKANGER, ARCHITECT REPRESENTING LEO LANDAU, PROPERTY OWNER, FOR PROPERTY KNOWN AS STIRLING BUSINESS PARK, LOCATED AT 1155 SW 1ST STREET, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS, Jeff Falkanger, representing property owner Leo Landau, property owner for property known as"Stirling Business Park", has applied for site plan approval for the proposed construction of 2 buildings, 29,380 sq. ft. each, for light industrial and warehousing uses to be located at 1155 SW 1st Street, Dania Beach; and WHEREAS, the Planning &Zoning Board on April 1.9, 2000, recommended that the City Commission grant the site plan request(SP-02-00), based upon the criteria set forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application (SP-02-00)for site plan approval, a copy of which is attached and made a part of this Resolution as Exhibit "A" is approved with the following conditions: 1) Roadway development plan as Architect's correspondence dated June 12, 2000 and approved by the Fire Marshal and the Public Works/Utilities Director; 2) Delete all signage from permit construction drawings (separate permit required); R-sp-02-00 stirling business park.doc 1 RESOLUTION NO. 2000- 096 3) Site lighting shall not exceed 20 feet in height nor be directed toward residential areas; 4) Prior to building permit, applicant to pay all outstanding recovery fees; 5) applicant to provide a bond representing 70% of the cost of constructing a public road to City specifications on SW 12 Avenue; 6) The access points on Dania Beach Boulevard and 1st Street shall be limited to emergency access only as approved by the Fire Department. It is further noted that the original Site Plan is maintained in the office of the Growth Management Department of the City of Dania Beach. Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically expire and become null and void unless building permits are obtained on or before 18 months from the date of this resolution. Section 3. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 4. Leeds,AICP, Director Date 06/20/2000 Growth Management Department City Manager Date STAFF REPORT GROWTH MANAGEMENT DEPARTMENT TO: Michael Smith, City Manager FROM: Laurence Leeds, AICP, Director, Grcwth Management RE: Stirling Business Park (NE corner of SW 1st Street and SW 12th Avenue) DATE: June 23, 2000 (City Commission Meeting of June 27, 2000) ACCESS/LOCATION This site plan is located at the NE corner of SW 1st Street and SW 12th Avenue, directly northeast of the Stirling Industrial Park. Both SW 1s' Street and SW 12th Avenue abutting the site are currently "unimproved". Both streets must be improved, either as a private driveway or a public street, to the Public Works Department's requirements. This site can be accessed from Stirling Road, heading north on SW 12th Avenue to the intersection of SW 12th Avenue and SW 1st Street. While SW 12th Avenue north of Stirling is a public street, it is frequently blocked by tractor trailers loading and unloading at dock-high bays at the Stirling Industrial Park. This situation, though it will create some difficulty for some tenants, cannot continue if the subject parcels and other sites in this area are to be developed. . Staff will be contacting the operators of the Stirling Industrial Park and advising them that all obstructions on SW 121h Avenue should be corrected. This memo is being copied to the Police Chief and Fire Chief since their assistance will be necessary for any enforcement action. The subject parcel is potentially accessible from Dania Beach Boulevard to the north and SW 1st Street to the east. Staff does not support vehicular access at these locations since it will permit industrial truck traffic through residential areas. Staff supports only emergency vehicle access at these locations. Based on discussions with the Public Works/Utilities Director and Fire Marshall, staff proposes that SW 12th Avenue between SW 1st Street and Dania Beach Boulevard be constructed to public street specifications to within approximately 25 feet of Dania Beach Boulevard (the north 25 feet is intended to permit only emergency vehicle access). This portion of SW 12th Street will be constructed when the property west of 12th Avenue (behind the Stirling Industrial Park) is developed. Until that time, the subject parcel will have access off a "private driveway" along the SW 1st Street right-of-way. The subject parcel developer will be the only use of that portion of SW 1st Street east of SW 12th Avenue. As such, SW 1st Street will be constructed as a private driveway providing emergency vehicle access only from the east. A summary of the applicant's road development proposal (approved by both the Public Works/Utilities Director and the Fire Marshall) is attached. Page 1 stirlingbuspark062700.doc LANDSCAPING: • The applicant complies with all landscaping requirements except the minimum 30% pervious area requirement (28.5% pervious area required). In lieu of complying with the 30% pervious area, applicant has provided in excess of the minimum number of trees, and focused much of his landscaping program along the residential lot lines. As such, staff recommends approval of the reduction in pervious area based on the submitted landscape plan. The Zoning Code permits the Commission to approve the reduction without a-variance. ZONING DESIGNATION The City zoning map shows the south half of this property to be IG Industrial and the north half to be RM Multi-Family. The applicant has submitted a 1987 zoning ordinance. The City's Engineering Consultant (Calvin Giordano and Associates) indicates that all of the subject property is currently zoned IG (See attached letter). The applicant has provided sufficient parking to accommodate a building that is 10% office, 50% industrial, and 50% warehouse. This is a reasonable estimate for an industrial incubator building where the tenants are not known until the development is well into construction. SUBJECT: Parcel "A" Stirling Industrial Park as recorded in P.B., 131, P. 4 Vehicular Access and Public Road Construction Agreement The purpose of this memo is to reiterate and confirm our voluntary agreement to post a cash bond for 65% of the cost to construct a public road to City specifications on SW 12th Avenue between SW 1 st Street and Dania Beach Boulevard,with the following agreed conditions. 1. There will be a temporary driveway to SW 1st Street, located at the southwest corner of the subject property as indicated in Exhibit A. 2. The existing 30 foot dedicated right-of-way located on the west side of the subject property (along SW 12th Avenue between SW 1st Street and Dania Beach Boulevard) will be combined with the abutting parcel's required 30 foot right-of-way dedication to provide a total 60 foot right-of-way. See Exhibit B. 3. Within 30 days of the completion of SW 12ih Avenue between SW 1st Street and Dania Beach Boulevard, we voluntarily agree to: c) construct a new driveway, to City specifications, providing access from the subject property to SW 12t Avenue (See Exhibit B,) and d) close the temporary driveway to SW 1st Street, reference above in Paragraph 1 (See Exhibit B.) 4.
