HomeMy WebLinkAboutR-2000-105 RESOLUTION NO. 2000-105 r A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE ACCEPTANCE OF THE CONVEYANCE OF LAND BY USE OF A QUIT CLAIM, DEED FROM PUBLIX SUPERMARKETS, INCORPORATED; AUTHORIZING THE RECORDING OF THE QUIT CLAIM DEED IN THE PUBLIC RECORDS OF BROWARD COUNTY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Publix Supermarkets has proposed to execute and deliver to the City of Dania Beach ("City") a Quit Claim Deed in favor of the City, in connection with a portion of right-of-way known as a portion of the west side of Southeast Fifth Avenue in the City in connection with the development of a Publix store adjacent to East Dania Beach Boulevard and Southeast Fifth Avenue; and WHEREAS, the City Commission finds it to be in the best interest of the City to accept the conveyance identified in the Quit Claim Deed; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "Whereas" clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution upon its adoption. Section 2. That the City Commission of the City of Dania Beach accepts the conveyance included in the Quit Claim Deed from Publix Supermarkets, Incorporated in a form as shall be approved by the City Attorney. Section 3. That the City Manager is authorized to do all things necessary and expedient in order to carry out the provisions of this Resolution, including arrangements for recording the Quit Claim Deed in the Public Records of Broward County. Ansbro, City Attorney DATE: July 6, 2000 RE: Proposed Conveyance of a portion of Southeast Fifth Avenue to City from Publix Supermarkets, Incorporated Attached is a recommended Resolution authorizing the City to accept a conveyance of a portion of Southeast Fifth Avenue in connection with the development of the Publix Store recently approved by the City Commission at the East Dania Beach Boulevard location. Broward County has required the developer to proceed with the conveyance to resolve remaining platting and right-of-way issues. Mr. Palm has been contacted and confirmed that the area involved is the same area sought by the City to ensure that rights-of-way and drainage are sufficient for the City's needs in connection with the store's development. Passage of the Resolution and acceptance of the conveyance is recommended. TJA:ldc Attachment •
