A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,
FLORIDA, VACATING CERTAIN PORTIONS OF THE 30 FOOT
INGRESS/EGRESS EASEMENT LOCATED ALONG THE EAST PROPERTY LINE
OF TRACT A, SWEDE LAND PLAT ALONG WITH THE VACATION OF A 10 FOOT
WIDE UTILITY EASEMENT WHICH RUNS NORTH AND SOUTH OF THE ENTIRE
SWEDE LAND PLAT ON THE EASTERN SIDE ADJACENT TO THE 30 FOOT
INGRESS/EGRESS EASEMENT, SUCH PROPERTY BEING LOCATED IN THE
CITY OF DANIA AND LEGALLY DESCRIBED IN EXHIBIT"A",A COPY OF WHICH
IS ATTACHED TO THIS RESOLUTION; PROVIDING THAT ALL RESOLUTIONS
OR PARTS OF RESOLUTIONS IN CONFLICT WITH THIS RESOLUTION ARE
REPEALED TO THE EXTENT OF SUCH CONFLICT; FURTHER, PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, Section 3, Article 3, Part IX, as amended, of the Charter of the City of Dania
Beach, sets forth the procedure for vacating and abandoning streets, alleys, and utility easements
or other property dedicated to the public use; and
WHEREAS, Kevin Guthard, representing Trafalgar Associates, Inc,duly petitioned the City
Commission of the City of Dania Beach, Florida, for the vacation of certain ingress/egress and
utility easements legally described in exhibit "a", a copy of which is attached to this resolution.
WHEREAS, the City Commission referred the petition (No. VC-26-00)to the City Planning
and Zoning Board for its recommendation; and
WHEREAS, at the meeting of the Planning and Zoning Board held on June 21, 2000, the
Planning and Zoning Board unanimously voted to recommend that the ingress/egress and utility
easements be vacated and abandoned;
WHEREAS, after publication of notice as required by Section 3, Article 3, Part IX of the
Charter of the City of Dania Beach, a public hearing was held before the City Commission at its
regular meeting held on July 25, 2000;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DANIA BEACH, FLORIDA:
Section 1. That the City Commission of the City of Dania Beach, Florida, vacates,
abandons, renounces and disclaims all of the right, title and interest of the City of Dania Beach in
and to the following ingress/egress and utility easements,to-wit, subject to the following conditions:
1) Applicant to provide (prior to adoption of resolution) letter from an
attorney, professional engineer, or professional land surveyor indicating that the
Publix easement has not been vacated.
2) Applicant to provide (prior to adoption of resolution) documentation that a

• utility easement be retained in the same location as the 30' road access
easement..
3) Prior to issuance of a certificate of occupancy for Sheridan 400, Fire
Rescue to verify that emergency access driveway has been constructed at the
location of the Publiz access easement.
Section 2. That the City Commission finds and determines that the procedure for the
vacation and abandonment of the subject ingress/egress and utility easements have been in strict
conformity with the requirements of Section 3, Article 3, Part IX of the Charter of the City of Dania
Beach.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution are
repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

particularly described as follows: Beginning at the Northeast corner of said Tract "A";
Thence on the North line of said Tract"A", south 88031'17"West 30.00 feet to the Point of
beginning and the intersection with a line lying 30.00 feet West of and parallel with the East

DATE: July 25, 2000 City Commission Meeting
The applicant proposes to waive a 30-foot wide ingress/egress easement (and adjacent
10-foot utility easement) located along the east lot line of the above referenced property.
The "referenced property" is the site of the Trafalgar Apartments.. The easement abuts
a common property line "shared with the Publix store immediately to the east.
Emergency access to Sheridan 400 requires that the adjoining easement at Publix
(West 30 feet of Tract A, Sandpiper Bay Commercial) be maintained in perpetuity.
® Staff has received comments (attached) from Bud Palm, Utilities/Public Works Director,
Ed Tarmey, Fire Marshall, Comcast Cable, People's Gas, BellSouth, and FPL. FPL
and BellSouth. have requested that an easement be retained for there benefit to install
electric and phone lines underground.
STAFF AND PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION
Staff has no objection to the easement vacation subject to:
1) Applicant to provide (prior to adoption of resolution) letter from an attorney,
professional engineer, or professional land surveyor indicating that the Publix
easement has not been vacated.
2) Applicant to provide (prior to adoption of resolution) documentation that a utility
easement be retained in the same location as the 30' road access easement.
3) Prior to issuance of a certificate of occupancy for Sheridan 400, Fire Rescue to
verify that emergency access driveway has been constructed at the location of
the Publix access easement.
