A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,
APPROVING THE SITE PLAN REQUEST SUBMITTED BY WILLIAM
DUFFEY, D.F. CONSULTANTS REPRESENTING MOTIVA
ENTERPRISES, LLC., FOR PROPERTY LOCATED AT NW
CORNER OF STIRLING ROAD AND "UNIMPROVED" SW 19TH
COURT — LOCATED ON THE NORTH SIDE OF STIRLING ROAD
WEST OF 1-95; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of
Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building
permit; and
WHEREAS, William Duffey,b.F. Consultants, representing Motiva Enterprises, LLC. has
applied for site plan approval for the proposed construction of a Shell Oil Service Station,
Convenience Store, and Car Wash to be located at NW corner of Stirling Road and "unimproved"
SW 19th Court— located on the north side of Stirling Road west of 1-95, Dania Beach; and
WHEREAS, the Planning & Zoning Board on June 21, 2000, recommended that the City
Commission grant the site plan request(SP-03-00), based upon the criteria set forth in Section 8.4
of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DANIA BEACH, FLORIDA:
Section 1. That that certain application (SP-03-00)for site plan approval, a copy of which is
attached and made a part of this Resolution as Exhibit"A"is approved with the following conditions:
1) Submission of the City Tree Trust Fund ($23, 429) payment prior to
issuance of a building permit.
2) Construction of SW" 19 Court abutting the site (to Public Works
Department specifications) prior to issuance of a Certificate of Occupancy.
3) Deletion of all signage from service station construction drawings
(separate sign permit required).

4) Tree #43 (Live Oak) to be relocated "on site".
r5) Canopies to be revised to provide a pitched roof.
It is further noted that the original Site Plan is maintained in the office of the Growth
Management Department of the City of Dania Beach.
Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of Chapter 8,
of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically
expire and become null and void unless building permits are obtained
on or before 18 months from the date of this resolution.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution are
repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

Store, and Car Wash (NW corner of Stirling Road and "unimproved"
SW 19th Court — located on the north side of Stirling Road west of I-
95)

VARIANCE
® The applicant is required to provide 15% window/door glass surfaces along the east
side of the building opposite SW 19th Court. Staff supports this variance because SW
19th Court is a minor local street with little exposure. Also, applicant has made a
significant effort at tree preservation and is providing in excess of the required minimum
30% pervious area.
SITE PLAN
ACCESS/LOCATION This site plan is located at the NW corner of Stirling Road
and "unimproved" SW 19th Court, west of Interstate 95. SW 19th Court must be
constructed along the east side of the site so as to permit adequate access to the site.
Both the Public Works/Utilities Director and Fire Marshal recommend approval.
Applicant has provided 20 parking spaces.
LANDSCAPING Applicant exceeds the minimum 30% pervious area requirement.
Also, the applicant has worked with City landscape consultant to preserve several trees,
either in their present location or elsewhere on the site. The site plan configuration has
been driven primarily by tree preservation.
For those trees where relocation is not cost-effective, or where trees are in poor
condition, the applicant is required to pay money to the City Tree Fund. This fee is
estimated to be between $23,000 and $26,000 and will be finalized at the Public
Hearing.

• ZONING DESIGNATION The property is zoned Broward County M-1 (Light Industry).
Because the underlying land use is "Commercial", the Shell property is not subject to
the IROM moratorium and will remain as M-1. Shell Oil initially began this project in
June 1997.
STAFF RECOMMENDATION (SITE PLAN AND VARIANCE)
Staff recommends approval of both the variance and site plan subject to:

specifications) prior to issuance of a Certificate of Occupancy.

• The following list of trees were inspected on the proposed Shell Oil site and have been
determined to be in poor condition or not be cost effective to relocate them. It is
recommended that these trees be removed and the estimated value be paid to the City of
Dania Tree Trust Fund.
