RESOLUTION NO. 2000-123 • A RESOLUTION OF THE CITY OF DANIA BEACH FLORIDA, APPROVING THE ZONING APPEAL REQUEST SUBMITTED BY ATTORNEY ALAN KOSLOW REPRESENTING BUKKEHAVE INTERNATIONAL CORP, FOR A 15 ACRE PARCEL LOCATED BETWEEN DANIA BEACH BLVD. AND STIRLING RD., WEST OF UNIMPROVED SOUTHWEST 12TH AVE., DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Article 10.30 of Chapter 28 Zoning of the Code of Ordinances of the City of Dania Beach, Florida, states that the City Commission shall hear and decide appeals where it is alleged there is error in any order, requirement, decision or determination made by an administrative official in the enforcement of this chapter; and WHEREAS, Attorney Alan Koslow, representing Bukkehave International Corp, for a 15 acre parcel located between Dania Beach Blvd. and Stirling Rd., west of unimproved southwest 12th Ave., has requested a zoning appeal from the decision of Growth Management Director on July 7, 2000, where it was determined that a "Vehicle Staging Component" of the proposed office /warehouse use is not permitted as either an "accessory use" or a "special exception use" in the IG zoning district. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application letter dated July 7, 2000 (ZA-008-00) for a zoning appeal request, a copy of which is attached and made a part of this Resolution as Exhibit "A", is approved with the following conditions: a) Uses shall be limited to office, warehouse, research, repair, assembly, fabrication and marina and/or enclosed dry stack buildings with no overhead doors on Dania Beach Boulevard side and buildings on north wall will be architecturally acceptable for abutting residential neighborhoods; b) Sales, Leasing, rental, service, repair, or storage of automobiles, aircraft, trucks, boats, motorcycle, tractor-trailers, recreational vehicles, construction r-za-008-00 bukkehave.doc 1 RESOLUTION NO. 2000-123 equipment or mobile homes shall be specifically prohibited; c) No loading area or parking lot shall be permitted within the 30 foot setback area from Dania Beach Boulevard; d) Vehicular access to Dania Beach Boulevard (including access via SW 12'h Avenue to Dania Beach Boulevard) shall be prohibited; e) Recording of deed restrictions prior to the issuance of building permit. Section 2. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. Koslow, representing Bukkehave International Corp. The subject parcel is located in the southwest corner of a vacant, unplatted 15 acre parcel bound by Dania Beach Boulevard on the north, SW 12'h Avenue (unimproved) on the east, the Stirling Industrial Park on the south, and the C-10 Canal on the west. The proposed use consists of: 1) Vehicle customization for overseas and out-of-country use, 2) Vehicle parts supply, and 3) Outdoor vehicle storage. The property is zoned General Industrial ("IG"). While IG zoning allows medium-to- heavy industrial uses, IG zoning does not allow "service and storage of automobiles and trucks". Auto and truck service and storage is listed as a special exception use in the Industrial Restricted ("IR") District (see attached). Applicant indicates the outdoor vehicle storage is short-term staging of vehicles awaiting modification. Nevertheless, the site plan is typical of uses devoted primarily to automotive service due to the following: 1) The "vehicle staging area" is larger than the combined office/warehouse. As such, the vehicle-staging component cannot be "accessory" to the office/warehouse use. 2) Office/warehouse buildings generally occupy between 30% and 35% of a site. In this case, the office/warehouse building occupies less than 14% of the site. Specialty automotive uses often construct a much smaller building (generating less tax revenue) than conventional office/warehouse use. • 8ukkehave Appeal 080800.doc • Planning issues include: 1) Noise impact (from auto/truck transport tractor trailers) upon the adjacent residential community to the north, and 2) Lack of adequate vehicular access (Staff recommends against any access from Dania Beach Boulevard, limiting Bukkehave and the remainder of the larger parcel to Stirling Road via SW 12th Avenue). Applicant has proposed that the remainder of the larger 15-acre parcel be developed for office/warehouse use. The City cannot require the property to be developed as proposed. However, if the City Attorney agrees, it is our understanding the applicant can voluntarily deed restrict the property in accordance with the proposed master plan. RECOMMENDATION Alternative 1: Deny the appeal. Alternative 2: Approve the- appeal for the Phase I Bukkehave Parcel, with the understanding that the applicant will voluntarily deed restrict the remainder of the 15 acre parcel (with the concurrence of the City Attorney) in accordance with the following ® criteria: All buildings shall be set back at least 50 feet from the property line abutting Dania Beach Boulevard. b) Uses shall be limited to office, warehouse, "research, repair, assembly and fabrication. Since incorporating in the United States in 1996, Bukkehave has °• expanded its global presence with locations on all continents, maintaining headquarter offices in Denmark and Florida. as Honorable Mayor and City Commissioners City of Dania Beach City Commission July 7, 2000 Page 2 Bukkehave's proposed Master Plan for the 15 acre site in Dania Beach located generally between West Dania Beach Boulevard and Stirling Road, along unimproved Southwest 12`h Avenue envisions a 4 Phase build-out (see attached site plan) that will exceed over$9.5 million in construction costs that will include the Bukkehave U.S. Headquarters site, as well as additional office and warehouse developments that will serve a total of an estimated 230 new employees for the City of Dania Beach at build-out. Phase 1 of the proposed Master Plan will serve as the Bukkehave headquarters on 4.5 acres with a 26,000 plus approximately 30 full time sq. ft. building and will house Bukkehave employees. Phases 2, 3 and 4 would each be developed with office warehouse components ranging in size from approximately 36,006 to 50,000 s .ft.Phase and each Phase would accommodate between 55 to 75 new employees. q p When Bukkehave's engineering and architectural consultants first approached the City's Zoning Department with the proposed project, it did not include the 4 Phase Master Plan, but was only presented as with respect to Phase 1, i meeting with the C .e., the Bukkehave headquarters development. After ity Zoning Director, Mr. Leeds, he was of the opinion Bukkehavethat since the headquarters also required a vehicle staging component for its worldwide vehicle distribution operations that such a staging area would be considered "vehicle storage" and therefore did not constitute an "accessory use and/or special exception" to the current IG zoning classification for the property. Bukkehave respectfully disagrees with that decision by the CityZoning Department and is therefore filing this appeal to the City Commission. However, in an effort to bring to the City of Dania Beach a project that will have more of a positive economic impact to the City, while at the same time allowing the Bukkehave vehicle staging component fit more readily into the "accessory use and/or special exception" category. Bukkehave has now master planned the entire 15 acre parcel, as described above and more particularly set forth on the site plan exhibit hereto. We believe that with the proposed Master Plan, the City Commission will recognize the uniqueness of the Bukkehave project and its potential value to the City and grant the required "accessory use and/or special exception" status to a relatively small, but critical component to the overall project. Due to the uniqueness of the proposed Bukkehave headquarters'facility contemplated in Phase 1, with its vehicle staging component adjacent to its headquarters building, it is our opinion that the City zoning Code does not specially and/or special exception"but thusfar, City staff has categorized he componentstaging com onent as "vehicle use an storage". Accordingly, we respectfully request that the City Commission grant the Bukkehave appeal to permit the vehicle staging component as either "accessory use and/or special exception" in an IG zoning category.
