HomeMy WebLinkAboutR-2000-131 ® RESOLUTION NO. 2000-131 A RESOLUTION APPROVING THE SIGN ADJUSTMENT REQUEST SUBMITTED BY RONALD OWENS, PRESIDENT/CEO, REPRESENTING RESTAURANT GROUP OF SOUTH FLORIDA, LLC (CHURCH'S CHICKEN), FROM CHAPTER 28,ZONING,ARTICLE 28, SIGNS, FOR PROPERTY LOCATED AT 141 SOUTH FEDERAL HWY., DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances Chapter 28 Zoning, Article 28, Signs, sets the signage criteria in areas within the Downtown Dania Beach Redevelopment District in the City of Dania Beach; and WHEREAS, Ronald Owens, President/CEO representing Restaurant Group of South Florida LLC (Church's Chicken), has applied for a sign adjustment (SA-13-00) to allow for a signs which are in excess of the allowed signage regulations in the Downtown Dania Beach Redevelopment District for property located at 141 South Federal Hwy., Dania Beach; and WHEREAS, the Planning & Zoning Board on July 19, 2000, recommended that the City Commission grant the sign adjustment request SA-13-00 based upon the criteria set forth in Article 28, Section 28.200. "Relief from requirements; Sign Adjustment;Variances", of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That certain application SA-13-00, for a sign adjustment from Chapter 28 Zoning,Article 28, Signage, Section Sign Regulations, a copy of which is attached as Exhibit"A" is approved with the understanding that the petitioner will work with staff and Main Street to develop a sketch enhancing the landscaping at the corner of Federal Highway and Stirling Road, seal coat the parking lot , and that the sketch will be brought back to the City Commission as a discussion item. iSection 2 . That all resolutions or parts of resolutions in conflict with this resolution are RESOLUTION NO. 2000-131 ® repealed to the extent of such conflict. Section 3. Downtown Dania Redevelopment District sign regulations. Applicant requests: 1) Existing wall signs (box signs) to remain on three sides of the building. Existing signs are located on north, south, and west building facade. Existing wall signs are located on three sides of the building. While only two signs are permitted by Code, the three existing signs are relatively small and unobtrusive. Based on Code, the applicant could construct up to a 31 square foot sign on U.S. 1 and up to an 8-foot square foot sign on Stirling Road. None of the existing signs appear any larger than 8 or 9 square feet. 2) New monument sign to be located on U.S. 1 (Preexisting pole sign removed by property owner). Applicant proposes a "V" shaped monument sign in place of the old pole sign. The monument sign: a) Is located 4 feet from front lot line (minimum 5 feet required), b) Is 7 feet high by 6.5 feet wide (maximum 7' x 6' sign permitted), c) Consists of two separate sign faces, "V" shaped with interior angle of 65 degrees ("V" shaped signs permitted if interior angle less than 60 degrees). Although the proposed two-face monument sign requires three separate variances, the variances are minimal in nature (The proposed sign complies with the maximum sign face size of 25 square feet). It should also be noted that the applicant removed the pole sign at the request of staff, without the ® need for any enforcement action. Church Chicken Signldoc The following impact both wall and monument sign visibility: 1) The International House of Pancakes restaurant (for northbound traffic), 2) The Church's Chicken 60 foot building setback, and 3) The location of existing utility poles on U.S. 1 in front of Church's Chicken. STAFF RECOMMENDATION New W" Shaped (65 degree) Monument Sign: Approval. The new monument sign can be supported under Sign Adjustment Criteria Section 28.200 (1)(a) {".... signs cannot be adequately viewed due to physical site distinctions..."}. Existing Wall Signs: Approval. The existing wall signs can be supported under: 1) Sign Adjustment Criteria Section 28.200 (2) {".... for existing signs, the age of the sign and the extent to which the sign deviates from the existing code shall also be considered}, and 2) Sign Adjustment Criteria Section 28.200 (1)(a) {".... signs cannot be adequately viewed due to physical site distinctions..."}. As noted earlier, the existing wall signs appear to be as small or smaller than what is currently allowed by the Sign Code. PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION Approval.
