A RESOLUTION OF THE CITY OF DANIA BEACH,
FLORIDA, APPROVING THE SITE .PLAN REQUEST
SUBMITTED BY MICHAEL SIMMONS, PRESIDENT, PORT
PETROLEUM, FOR PROPERTY LOCATED ON THE WEST
SIDE OF SW 14T" AVENUE NORTH OF ELLER DRIVE,
DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the
City of Dania Beach, Florida, states that a site plan is required as a condition to the
issuance of a building permit; and
WHEREAS, Michael Simmons, President of Port Petroleum has applied for site
plan approval for the proposed construction of a an "unattended" card lock fleet fueling
facility to be located on the West side of SW 141h Avenue, North of Eller Drive, Dania
Beach; and
WHEREAS, the Planning &Zoning Board on July 19, 2000, recommended that the
City Commission grant the site plan request(SP-05-00), based upon the criteria set forth in
Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application (SP-05-00)for site plan approval, a copy of
which is attached and made a part of this Resolution as Exhibit "A" is approved and it is
further noted that the original Site Plan is maintained in the office of the Growth
Management Department of the City of Dania Beach.

Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of
Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site Ian approvals

shall automatically expire and become null and void unless building permits are obtained
on or before 18 months from the date of this resolution.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

REQUEST: SP-05-00 — Site Plan Request by Port Petroleum
LOCATION: West side of SW 14th Avenue north of Eller Drive
ZONING: M-3 (Reviewed pursuant to PEDD regulations — see below)
LAND USE: Transportation
PROPERTY SIZE: Approximately 0.5 acres (A portion of a 2.65 acre parcel)
The subject parcel is located within the Port Everglades jurisdictional area.
• Although the site is zoned M-3, the City review of the site plan is based on the
Port Everglades Development District ("PEDD") regulations. Because the City of
Dania Beach contractually agreed in the 1980's that all port property should be
zoned PEDD, the City Attorney concurs that staff should apply PEDD criteria.
The proposed use is an "unattended" card lock fleet fueling facility. The use is
permitted under PEDD as a "service station" or "petroleum processing,
transmission, or storage". Only one parking space has been provided, as this
does not appear to be a retail facility.
The use complies with PEDD requirements relative to building height, setbacks,
lot size, and landscaping. As per the PEDD, no loading space is required, and
sufficient landscape area is provided (10% required, 15% provided).
Separate sign regulations are provided in the PEDD. While a sidewalk is
required along 14th avenue, the Public Works/Utilities Director has recommended
that it be waived (see attached letter).
Please note attached correspondence from Port Everglades Authority staff dated
respectively March 6 and 8, 2000. These letters have been forwarded to both
the Public Work/Utilities Director and Fire Marshall.
STAFF RECOMMENDATION
Approval, subject to property owner providing a 24-foot vehicular access
reservation to the rear of the property (reservation to provide vehicular access to
property behind the fueling facility). Reservation document to be approved by
the City Attorney and recorded prior to issuance of a Building Permit.
PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION
Approval, subject to property owner providing a 24-foot vehicular access
reservation to the rear of the property (reservation to provide vehicular access to
property behind the fueling facility). Reservation document to be approved by
the City Attorney and recorded prior to issuance of a Building Permit.

After carefully reviewing the request from Port Petroleum to not install sidewalks at SE 14 Ave (inside
the Port Everglades). I feel this is a reasonable request, since there are no sidewalks in Port
Everglades, and no pedestrians conducive for the need of sidewalks, that I could find.

1 have enclosed a copy of the Planning and Zoning Board meeting of May 17,2000. Our project
is listed under new busui a s.Included are some staff recommendations. We are being asked to
pi ovide a sidewalk along,S.E. 14'Avenue(inside Port Everglades). We would like this item
removed, basically.because there arc no other sidewalks along 14t° avenue, in fact there are no
sidewalks.in Port Everglades.This is a well traveled road by heavy trucks and we do not have
any pedestrian traffic now and do not wish to encourage any.If you look at the surrounding
businesses,FP&L to the east,and major of I companies to the north you can see that this area
does not generate any pedestrian traffic.Please send me a letter with your recommendation for
removal of the sidewalk provision. If there are any questions please call me directly. Your
assistance in this matter is greatly appreciated.

Re: SP-05-00 Proposed Site Plan and Application for Port Petroleum
Dear Mr. Leeds:
Port Everglades planning staff has reviewed the above site plan and found it consistent with the
Port Everglades Master Plan and the Deepwater Port Component of the Broward County
Comprehensive Plan. Port environmental staff has expressed concern regarding the impact the
proposed project will have on the drainage structure on the west side of S.E. 14th Avenue. Both
the planning and environmental staff are concerned about the traffic impacts resulting from the
® proposed project and how it will affect Port operations.
Port Everglades is the water, and sewer service provider within the Port Jurisdictional Area. It is
recommended that the developer of this project coordinate water and sewer tie-ins with John
Foglesong, P.E., Port Everglades Project Manager IV. He can be contacted at 523-3404,
Extension 3667.

RE: SP-05-00 Port Petroleum
Thank you for the opportunity to review the above cited site plan for Port Petroleum. I
have listed my comments below concerning this project as follows:
1. Water for fire protection is required. Two additional fire hydrants located on the
north side of each driveway exit / entrance is required. The fire hydrants shall be
installed on a minimum 12"water main. Currently, there is a 6"water main located
on the west side of SE 14 Avenue. The Port's water main improvement project will
include the installation of a 12"water main on the east side of SE 14 Avenue in the
future. The property owner shall tie the new fire hydrants into the new water main
when it is installed. The hydrants shall be noted on the site plan with the
appropriate comment.
2. Construction permits issued by Port Everglades will be required. Please contact
Captain Richard Cavanaugh at 954i468-3533.
3. The traffic pattern on sheet TT-1 indicates tractor-trailers entering the site
from the south, heading northbound on SE 14 Ave. and exiting southbound on
14 Ave. Please note that future security plans for Port Everglades may include a
security gate on SW 14 Ave. at Eller Drive prohibiting traffic from Eller Drive
access to 14 Ave. The proposed security plan calls for two way traffic on 14
Ave., but access only from the north. Southbound traffic will be able to access
Eller Drive through the security gate.
