WHEREAS, the Dania Beach Code of Ordinances Chapter 28 Zoning, Article 28, Signs, sets the signage criteria for specific zoning districts within the City of Dania Beach; and WHEREAS, Robert Fronek, Dania Beach Florist, has applied for a sign adjustment (SA- 101 B-99) to allow for signage which is in excess, not permitted or prohibited from the allowed signage regulations in the Downtown Dania Redevelopment Zoning District for property located at 64 South Federal Hwy., Dania Beach; and • WHEREAS, the Dania Beach City Commission adopted Resolution No. 2000-59 on April 25, 2000, approving the sign adjustment request (SA101 B-99) with conditions, a copy of which is attached as Exhibit "A"; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA- Section 1. That Robert Fronek has requested a re-hearing of the sign adjustment, removing the conditions for installation of in-ground landscaping and substituting, in it's place, potted plants in excess of what is indicated on the sketches which are attached as Exhibit"B", and subject to staff review; Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. From: Laurence Leeds, AICP Growth Management Department Date: September 12, 2000 Subject: Reconsideration of Sign Adjustment: Robert Fronek - Dania Beach Florist 64 South Federal Highway— SA-101 B-99 On April 25, 2000, the Dania City Commission approved sign adjustments for Dania Beach Florist, granting: 1) Approval to maintain two existing wall signs on U.S. 1 (only one wall sign is allowed), and 2) Approval to maintain one existing wall sign on SW First Street (wall sign on SW First must equal 25% of the permitted wall sign on U.S. 1). • The approval was granted subject to installation of landscaping as indicated in Resolution No. 2000-059 (attached). Mr. Fronek has requested a rehearing, indicating why he cannot comply with the landscaping conditions contained in the resolution (see attached letter). Mr. Fronek indicates that he will install potted plants (as indicated in the sketch attached to his letter) as an alternative to in-ground landscaping. If the City Commission rescinds the sign adjustment, the applicant will be required to remove one of the two wall signs facing Federal Highway. STAFF RECOMMENDATION Alternative 1: Rescind the sign adjustments. "Relief from requirements; Sign Adjustment;Variances", of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application SA-101 B-99, for a sign adjustment from Chapter 28 Zoning, Article 28, Signage, Downtown Dania Redevelopment District Sign Regulations, a copy of which is attached as Exhibit "A" is approved with the following conditions: A. Robert Fronek, Dania Beach Florist, agrees to plat a hedge on the east and south side of the building, except where window glass exists; B. Robert Fronek, Dania Beach Florist, agrees to place two(2)trees on the east side of the building (one tree between the awnings and one tree on the corner). C. Robert Fronek, Dania Beach Florist, agrees to place two(2)Alexander Palms on the I , 1 RESOLUTION NO. 2000-059 south side against the building; ® D. Robert Fronek, Dania Beach Florist, agrees to remove the sidewalk to provide additional room for cars, leaving the sidewalk in front of the windows, as long as there are no foundation problems. E. Robert Fronek, Dania Beach Florist, agrees to complete all work within 90 days or no later than July 25, 2000. Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3.
