A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,APPROVING
A SPECIAL EXCEPTION REQUEST SUBMITTED BY ALEX MEDINA, SR.,
IMPORT EXPORT LIVESTOCK CORPORATION, D/B/A ALEX'S
FLAMINGO GROVES, FOR A SPECIAL EXCEPTION USE TO ALLOW
MULTIFAMILY USES AT 222 AND 236 NORTH FEDERAL HWY., DANIA
BEACH, AS PROVIDED FOR IN CHAPTER 28, ZONING, ARTICLE 4.20
SCHEDULE OF USE REGULATIONS, PROVIDING FOR CONFLICTS;
FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Chapter 28, Zoning, Article 4, District Regulations, Section 4.10,
Schedules of Regulations provides for Multifamily uses as a Special Exception Use In
districts zoned C-3 (Commercial); and
WHEREAS, Alex Medina, Sr., Import Export Livestock Corporation, d/b/a Alex's
Flamingo Groves has applied for a special exception use to allow six (6) multifamily units
at 222 and 236 North Federal Hwy., located within a C-3 (Commercial) zoning district; and
WHEREAS, the Planning & Zoning Board on August 16, 2000, recommended that
the City Commission grant the special exception request, based upon the criteria set forth
in Chapter 28, Zoning, Article 6, Supplementary Use Regulations, Section 6.40, Special
Exception Uses, of the Code of Ordinances of the City of Dania Beach.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That certain application SE-44-00, for a Special Exception Use for property
located at 222 and 236 North Federal Hwy., to allow six (6) multifamily units, a copy of
which is attached and made a part of this Resolution as Exhibit "A", is approved subject
to the Petitioner continuing to maintain the existing play area.
Section 2. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

SPECIAL EXCEPTION REQUEST BY PETITIONER:
Petitioner, Import-Export Livestock Corporation, d/b/a Alex's Flamingo Groves, requests a
special exception. One is located at 222 North Federal Highway, Dania Beach, Florida. This
address contains four apartment units in the back east part of the property. On this property there
are already retail stores as well as four apartment units located in the back east part of the
property that may be rented to tenants either yearly or monthly or for meetings. These apartment
units have been here for many years and are in great shape and are ready to be rented. On 236
North Federal Highway, Dania Beach, Florida, Petitioner desires to rent an open warehouse that
used to be used for fruit processing, but Petitioner wants to rent it as a warehouse. It has always
been a warehouse. This is located in the back east part of the property. Again, the open
warehouse has existed here for many years and there is no longer a need for a fruit processing
area.
The existing and adjacent properties include commercial and residential properties, so
Petitioner's requests are consistent with the existing and adjacent properties.

REQUEST: SE-44-00: Special Exception Request for six multi-family
residential units in a C-3 Commercial District
LOCATION: 222 and 236 North Federal Highway
The property is occupied by a shopping center containing retail uses, a martial
arts school, and a church. The church operates an accessory day care facility.
An existing wall and fence (and what appears to be overgrown exotic vegetation)
is located along the rear lot line. Two loading bays are located next to the rear
® lot line (These loading bays have not been used for well over a year). The rear
lot line backs up to single-family homes.
Existing retail and the church are permitted uses. Residential use requires
special exception approval by the City Commission.
The applicant proposes six apartment units. Allocation of six reserve units to
accommodate the six apartment units leaves a balance of 177 reserve units.
Please note that under the current Broward County Land Use Plan, once the
pool of reserve units is exhausted, it cannot be replenished. As such, reserve
units are a finite, limited source for adding or increasing residential density.
