AND THE BUDGET GROUP, INC. FOR PROPERTY LOCATED ON THE EAST SIDE OF NE 7TH AVENUE, NORTH OF TAYLOR ROAD, DANIA BEACH, ALSO KNOWN AS "PARCEL `A' OF THE JAMES BOND PLAT' FOR A SPECIAL EXCEPTION USE TO ALLOW A BUDGET RENTAL CAR FACILITY IN AN IRO ZONING DISTRICT,AS PROVIDED FOR IN CHAPTER 28, ZONING,ARTICLE 16.40 SPECIAL EXCEPTION USES (INDUSTRIAL RESEARCH OFFICE DISTRICT); PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 28, Zoning, Article 16, Industrial Research Office District, Section 16.40 provides for car leasing as a Special Exception Use; and WHEREAS, John Abdo, President/Owner, of Heartwood 90, Inc. and The Budget Group, Inc., have applied for a special exception use to allow a Budget Rental Facility in an IRO zoning district; and WHEREAS, the Planning & Zoning Board on September 20, 2000, recommended that the City Commission grant the special exception request, based upon the criteria set forth in Chapter 28, Zoning, Article 6, Supplementary Use Regulations, Section 6.40, Special Exception Uses, of the Code of Ordinances of the City of Dania. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. That certain application SE-36-00, for a Special Exception Use allowing property located on the East side of NE 7tn Ave., North of Taylor Rd., Dania Beach, also known as"Parcel A of the James Bond Plat"., to be used as a Budget Rental Car Facility, a copy of which application is attached and made a part of this Resolution as Exhibit"A", is • approved with the following conditions: 1) Payment of estimated value of the sidewalk into • the City Landscape Trust fund prior to issuance of a building permit; 2) Deletion of all signage from construction drawings (separate sign permit required), 3) Show 5" non- mountable curbs (including detail)where 9'x 16' spaces used; 4)Applicant to confirm that the Broward County Planning Council will not require the allocation of flex acreage; 5) Applicant agrees that all on-site parking spaces will be considered rental car spaces for purposes of calculating the Occupational License fees, expected to amount to approximately $10,000.00 a year. ("Applicant") proposes a new regional corporate headquarters ("Project") in the City of Dania Beach ("City"). The Project is described at length in the attached materials. The Project, which is generally located between N.E. 71h Avenue and N.E. 12th Avenue, North of Taylor Road and South of Eller Drive ("Property") is zoned IRO. Pursuant to the requirements of the City Code, the Project is subject to and meets the requirements for a special exception use as described in Sections .4 and 16.40, City Zoning Code. 1. The use is a Permitted Exception as set forth in the Schedule of Use Regulations. The proposed Project is comprised of a regional corporate office encompassing management and administrative functions, together with support facilities, including vehicle service and storage. Office uses are permitted pursuant to the City's IRO District and car storage is a permitted use subject to the conditions of the Section 16.40(a), Section 16.4(b), (c)1.2. and Section 6.4 of the City's Code. 2. The use is designed, located and proposed to be operated such that the public health, safety, welfare, and morals will be protected. This proposed Project is located on Property that is isolated from residential areas within the City. The Project is designed so that it will not have any negative impact on neighboring properties. The Project will also provide many jobs, such as corporate management personnel positions, to City residents. The office and storage facility will serve to enhance the tax base of Dania Beach by providing a phased office structure with the potential additional office and vehicle service use. I The use will not cause substantial injury to the value of other property in the neighbor where it is to be located. The property will not cause injury to the value of surrounding properties but will in fact enhance the value of neighboring properties. With regard to the site, the Property is bordered on the West by an approximate 100 feet landscape berm, with an internal canal. The canal continues around the Property for portions of the Southern and Eastern borders. The Project office building will face Taylor Road and will give the appearance of a traditional office park. The Project will enhance the tax base through development of a corporate administrative office use. The Applicant has chosen the City of Dania Beach as the optimum location for its new regional corporate headquarters, thereby proving to other businesses and national corporations that the City is a perfect location for business and that the market is right to purchase property for such a high value. • 1 FTL:6921 10:2 4. The use will be compatible with the adjoining development and the intended purpose of the District in which it is to be located. The IRO District is specifically intended to include office uses, and because of its proximity of the airport, is a logical location for airport-related uses. This kind of facility is specifically listed as a Special Exception Use in an IRO District, which requires that the conditions of the Special Exception Use be met. In addition, this Project provides a clean and safe development in an otherwise neglected area. The Project is completely compatible to and mirrors other development in the area such as the Hertz Rent-A-Car facility located nearby. The Project has been specifically designed to put an "office face" and on the public streets. In comparison, the hotel project which was once contemplated for this Property would be inappropriate due to the location, the remoteness of the site, and because of its proximity to the take-off and landing patterns of the airport. 5. Adequate landscaping and screening is provided. Adequate landscaping and screening is provided. The Project will more than meet the landscaping and screening requirements of the City while still presenting an office facade front. The Project has been set back from the Property by use of an approximate 100 feet buffer area, containing landscaping and a canal. The canal continues around the Property for portions of the Southern and Eastern borders. All other sides of the Property also comply with the City Code's requirements. 6. Adequate off-street parking and loading is provided and ingress and egress is designed as to cause minimum interference with traffic on abutting streets. The Project provides more than sufficient parking for the uses contemplated on the site and is limited to one access point at the adjoining right-of-way. Vehicular traffic generated by the Project will not have an adverse effect upon, or be detrimental to, surrounding land uses or the local and regional transportation network. This Project will not include any heavy truck traffic that could impact both city streets and the regional traffic network in this area. The Project will likely result in significantly lower volume of traffic than a larger office, warehouse or airport use. 7. The use conforms with all applicable regulations governing the district where it is located. The proposed Project conforms to all applicable regulations governing the district where it is located. The Project is a permitted use pursuant to the City's IRO District and car storage is a permitted use subject to the conditions of the Section 16.40(a), Section 16.4(b), (c)1.2. and Section 6.4 of the City's Code. Special exception uses are permitted upon authorization by the City Commission (after review by the Planning and Zoning Advisory Board) provided the Commission finds said uses comply with the attached special exception criteria. The site plan shows an office building, vehicle service building, and bus/car wash. The total building floor area is less than 10% of the site area. The remaining paved portions of the site are used for rental car parking and storage. Applicant has indicated that while most of the site will be used for rental car storage, the office building will be used for Budget's Corporate Offices. Rental car customers will continue to rent cars at a location within the airport. If this site were developed for multi-tenant warehouse/office use, buildings would occupy approximately 30% of the site or more (The proposed use shows only 10% building coverage). Based on square footage alone, multi-tenant warehouse/office use would appear to generate greater tax base than a rental car facility. Staff questioned the property owner as to the feasibility a constructing multi-tenant warehouse/office building at this location. The property owner indicates soil conditions make construction of a warehouse building on this site cost prohibitive. A copy of the engineer's report concerning soil conditions is attached. BUDGET SITE PLAN 092000.doc Occupational license fees for a rental car facility are $350.00 plus $25.00 per rental car space. Based upon the submitted site plan, the estimated annual occupational license fee would be approximately $8,000.00 (Hertz Rental Car pays in excess of twice this amount). SITE PLAN With the exception of a sidewalk along NE 7th Avenue, the site plan complies with all zoning and landscaping requirements. Perimeter landscaping is provided subject to compliance with Department of Environmental Protection mangrove preservation requirements. FUTURE LAND USE PLAN DESIGNATION The site has an "Employment Center" land use designation on the City Future Land Use Plan Map. It is unclear if allocation of "flex acreage" will be required to accommodate the proposed use. There are presently less than 20 acres of Employment Center "Flex Acreage" available in this part of the City. The subject parcel is approximately 4.36 acres. Special exception uses and their related accessory uses or any expansion, enlargement or modification of an existing special exception use shall be permitted only upon authorization by the city commission (after review on an advisory basis by the planning and zoning board) provided that such uses shall be found by the city commission to comply with the following requirements and other applicable requirements as set forth in this chapter. The study consisted of performing standard penetration test borings and test excavations to a maximum depth of 40 feet below grade. In summary, the primary geotechnical concern for development of this site is one of foundation and floor slab settlement arising from the consolidation within the loose and compressible soil materials encountered. Unsuitable foundation materials were encountered to an average depth of 8 feet which consisted of peat and marl soils. Typical office / warehouse structures utilizing shallow foundations are not technically feasible on these soils due to the projected settlements. The soils encountered appear to be consistent with those studied by GFA on several adjacent properties as part of the Hollywood / Ft. Lauderdale Airport Runway 27 Left project. Based upon our findings in both cases, the most economical use of these properties appears to be very lightly loaded single story structures with at grade parking and drive areas. Budget Group, Inc. is one of the world's leading vehicle rental companies, with 1999 annual revenues for continuing operations of nearly S2.4 billion. Budget Group, Inc. is rapidly growing in Broward County and hopes to relocate its regional administrative and management functions to the City of Dania Beach. Budget Group, Inc. proposes to relocate approximately 110 management and service employees to the new Dania Beach Budget facility. The proposed facility will include an administrative headquarters, vehicle service facilities and over-flow parking for Budget's airport rental operations. The administrative headquarters will be the central office for corporate management personnel responsible for the 12 Budget Rent-A-Car facilities, 32 Ryder T.R.S. facilities and 9 Budget Truck Rental facilities located throughout Broward County. The Broward County General Manager for Budget Group, Inc. will be stationed at the Dania Beach office and all new employee training will take place at the Dania Beach facility. The proposed Budget office and rental support facilities will also provide the necessary support facilities for Budget's rapidly growing Airport operations. The proposed facility will provide valuable new management level jobs for the residents of Dania Beach and increase substantially the City tax base for the commercial properties servicing the Fort Lauderdale - Hollywood International Airport. VYhile the initial phase of buildout calls for approximately 18,000 square feet of administrative space and service facilities, Budget expects that a full second floor of administrative office space will be required as the Budget airport and regional operations expand over the next 5 to 7 years.
