A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING A SPECIAL
EXCEPTION REQUEST SUBMITTED BY ATTORNEY ALAN GABRIEL,
REPRESENTATIVE FOR NEXTEL SOUTH CORPORATION D/B/A NEXTEL
COMMUNICATIONS, FOR PROPERTY LOCATED AT 3201 GRIFFIN RD., DANIA
BEACH, FOR A SPECIAL EXCEPTION USE TO INSTALL A CELLULAR
TELECOMMUNICATION ANTENNA ON THE ROOF OF THE EXISTING FOUR-STORY
OFFICE BUILDING; AS PROVIDED FOR IN THE ZONING APPENDIX, ARTICLE VIII,
TELECOMMUNICATION TOWERS AND ANTENNAS; SECTION 33-308 ZONING
DISTRICTS, HEIGHT AND SETBACK REQUIREMENTS, ETC.; PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Chapter 28, Zoning Appendix, Article VIII, Telecommunication Towers and
Antennas; Section 33-308, Zoning districts, height and setback requirements, etc. provides for Stealth
towers or stealth rooftop and building mounted antennas as special exceptions in districts zoned
(Commercial); and
WHEREAS, Attorney Alan Gabriel, representative for Nextel South Corporation d/b/a Nextel
Communications, has applied for a special exception use to install a cellular telecommunication antenna
on the roof of the existing four-story office building at 3201 Griffin Rd., Dania Beach in a Commercial
® Zoning District; and
WHEREAS, the Planning & Zoning Advisory Board on September 20, 2000, recommended that
the City Commission grant the special exception request, based upon the criteria set forth in Chapter 28,
Zoning, Article 6, Supplementary Use Regulations, Section 6.40, Special Exception Uses, of the Code of
Ordinances of the City of Dania.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA,
FLORIDA:
Section 1. That that certain application SE-45-00, for a Special Exception Use allowing property
located at 3201 Griffin Rd., Dania Beach to install a cellular telecommunication antenna on the roof of the
existing four-story office building in a Commercial Zoning District, a copy of which is attached and made
a part of this Resolution as Exhibit"A", is approved with the following conditions:
(1) Applicant providing written certification that the operation of the facility
will not interfere with FAA, aviation-related, or airport related
communications;
(2) Applicant will voluntarily dedicate $5,000 to the City Tree Landscape
'10 Fund.

Section 2. That all resolutions or parts of resolutions in conflict with this resolution are repealed
to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its passage and
adoption.

The following questions pertain to the criteria which the City Commission and Planning and Zoning Board will
consider in reviewing the applicant's request.

1. Indicate that the use is a permitted/special exception us6in the schedule of use regulations, City of Dania
Beach, in Article 4 of the zoning code. The proposed use, on land currently zoned
Broward County B-2, is a permitted use per (1) the current Broward County

plan. The use is subject to special exception approval * (cont, below)
2. Indicate that the use will not cause a detrimental impact to the value of existing contiguous uses or to the
zoning district where it is to be located.
The proposed use is an unmanned, passive facility with rooftop antennas tc
be stealthed & ground shelter to be screened byexisting structures , land-
scaping & fencing. It will have no negative impact on surrounding propertiE
• or uses . Values could actually increase due to the resulting improvement it
the quality of the Nextel system in the vicinity.
3. Indicate that the use will be compatible with the existing uses on contiguous property or the zoning district
where the use is to be located and compatible with the general character of the area, considering
population density, design, scale and orientation of structures to the area, property values and existing
similar uses or zoning.
This unmanned, passive, stealthed and screened use will have no negative
impact on contiguous property and uses, and wiII tTjus th

4. Indicate that adequate landscaping and screening is provided as required in the Chapter.
The rooftop antennas will be stealthed as indicated; the shelter will be
screened by required landscaping; a fence; and by the existing ui ing
and dumpster enclosure .
5. Indicate that adequate parking and loading is provided and ingress and egress is so designed as to cause
minimum interference with traffic on abutting streets. Vehicular access to the property is
by way of entrances to the parent tract on SW 32nd Avenue . The proposed
use will generate no traffic except for one trip every two weeks y a tech
nician. The existing large parking lot will serve this need.

6. Indicate that the use will be consistent with the existing Comprehensive Plan.
The proposed use is the addition of an unmanned, passive, commercial
facility consisting of rooftop antennas and a small ground equipment
® shelter, which is consistent with the "commercial" land use designation.
7. Indicate that the use will not have a detrimental environmental impact upon contiguous properties or an
environmental impact inconsistent with the health, safety and welfare of the community.
This use will have no environmental impact on surrounding properties . The
limited radio frequency emissions generated will be well within federal
guidelines .
S. Indicate that the use will not have a detrimental effect on vehicular or pedestrian traffic, or parking
conditions, and will not result in the generation or creation of traffic inconsistent with the health, safety and
welfare of the community.
As indicated above, this use will have no impact on traffic or parking.
9. Indicate that the use will not utilize tuming movements in relation to its access to public roads or
intersections, or its location in relation to other structures or proposed structures on or near the site that
® would be hazardous or a nuisance.
There will be no such impact by this use .
10. Indicate that the use will not have a detrimental effect on the future development of contiguous properties
or the general area, according to the Comprehensive Plan.
The use is an unmanned, passive, stealthed and screened facility, and,as
such, will have no impact on surrounding properties or uses, whether existinc
or future.
11. Indicate that the use will not result in the creation of incompatible noise, lights, vibrations, fumes, odors,
dust or physical activities, taking into account existing uses or zoning in the vicinity due to its nature,
duration, direction or character.
The proposed use will not result in any of the impacts listed above.

standards and criteria of the zoning classification in which such use is proposed to be located, and all

SUBJECT: SE-45-00: Rooftop Cell Antennas (Nextel) at 3201 Griffin Road
This is a special exception request to install a cellular telecommunication
antenna on the roof of the existing four-story office building located at 3201
Griffin Road. The proposal consists of nine panel antennas (three arrays of
three panel antennas each) located on the rooftop and an equipment shelter
located at ground level on the north (rear) side of the building.
Two of the antennas arrays will be mounted to a new structural steel frame and
placed within an "antenna shroud" that will resemble a penthouse on the roof.
The third array will be attached to the existing penthouse wall and will be painted
to match the color of the building. This rooftop installation will eliminate the need
for an additional cellular tower in the City. The applicant has indicated that all
exposed finishes will be constructed or painted to be compatible with the existing
structure.
With respect to special exception approval:
1) The Building Official has approved the wind-load certification provided by
the applicant.
2) The applicant has certified that construction and operation of the facility
will not interfere with public safety communications. The applicant has
not specifically addressed FAA and aviation-related communications.
Staff requests the applicant provide $5,000 to the City Tree Landscape Fund to
mitigate the visual impact of cell-related facilities in the City of Dania Beach.

the facility will not interfere with FAA, aviation-related, or airport related
communications.

Nextel Communications, Inc. is proposing to install an equipment shelter at grade level with
antennas mounted atop the existing adjacent four-story building at the above referenced location.
PAL Telecom Group has designed the installation of antennas based on the existing building
drawings prepared by Roy Rosenbaum, P.C. in 1986. Based upon an analysis of the antenna
weight, screen weight and wind loading, calculations (previously submitted) show the total
imposed loads would be within the capacities of the existing building's structural system.
We trust that this information will satisfy all concerns; however, if you should have any

The following certifications are provided to the City of Dania Beach in conjunction
with the Application by Nextel for Special Exception approval of a stealth rooftop
telecommunications facility to be located on the rooftop of 3201 Griffin Road.
1. As the owner/operator of the antennas to be placed at the proposed
location, Nextel South Corp. d/b/a Nextel Communications certifies that
all franchises/licenses required for construction and operation of this
wireless telecommunications site in the City have been obtained. A copy
of Nextel's FCC license is attached hereto.
2. The construction and operation (including reception and transmission) of
this facility will not interfere with public safety communications, with the
visual and customary transmission or reception of radio, television or
similar services, or other wireless services enjoyed by adjacent properties.
