A RESOLUTION OF THE CITY OF DANIA BEACH,
FLORIDA, APPROVING THE SITE PLAN REQUEST
SUBMITTED BY JAY PATEL, OWNER LUCKEY'S MOTEL,
FOR PROPERTY LOCATED AT 205 NORTH FEDERAL
HWY., DANIA BEACH; PROVIDING FOR CONFLICTS;
FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the
City of Dania Beach, Florida, states that a site plan is required as a condition to the
issuance of a building permit; and
WHEREAS, Jay Patel, Owner of Luckey's Motel, has applied for site plan approval
for the proposed construction of a four room addition to an existing 10 room motel
"Luckey's Motel" located at 205 North Federal Hwy., Dania Beach; and
WHEREAS, the Planning & Zoning Board on November 15, 2000, recommended
that the City Commission grant the site plan request (SP-39-00), based upon the criteria
set forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of
Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application (SP-39-00)for site plan approval, a copy of
which is attached and made a part of this Resolution as Exhibit "A" is approved,
and it is further noted that the original Site Plan is maintained in the office of the Growth
Management Department of the City of Dania Beach.

Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of
Chapter 8 of the Code of Ordinances of the City of Dania Beach, all site Ian approvals

shall automatically expire and become null and void unless building permits are obtained
on or before 18 months from the date of this resolution.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

Site Plan Fees are calculated as follows:
Residential- $275.00 Base Fee, plus $8.80 per unit for the first 100 units, plus $4.40 for each unit
in excess of 100 units.
Non-Residential 1 Hotel-Motel-$275.00 Base Fee, plus$1.10 per 100 sq.ft. for the first 10,000 sq.fL
plus 0.55 per 100 sq.ft.for that portion in excess of 10,000 sq.fL

(Luckey's Motel —205 North Federal Highway)
DATE: December 12, 2000
® VARIANCE
The applicant has requested a variance to provide 29.31% pervious area (30%
required). Staff supports this minimal variance (less than 1%).
SITE PLAN
ACCESS/LOCATION This site plan is located at the northwest corner of Federal
Highway and NW 2"d Street, directly north of Franco's Auto Repair. The applicant has
relocated the main entrance from Federal Highway to NW 2"d Street at the direction of
FDOT. The Fire Marshall has approved site access (see attached e-mail).
ZONING DESIGNATION The property is zoned C-3 and has an underlying land use of
"Commercial".
PRINCIPAL ARTERIAL DESIGN GUIDELINES The applicant has revised his
plan to meet the design guidelines (ie. pitched roof, spandrel glass).
LANDSCAPING
The City Landscape Consultant indicates the applicant has complied with all landscape
requirements.

STAFF RECOMMENDATION (SITE PLAN AND VARIANCE)
Staff recommends approval of both the variance and site plan subject to providing a
sidewalk along the west lot line (NW 1't Avenue).
PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION (SITE PLAN

Approval of both the variance and site plan subject to providing a sidewalk along the
west lot line (NW 1st Avenue).
PLEASE NOTE: The applicant has been advised to contact the Broward County
Planning Council to determine if replatting is required under the Broward County Land
Use Plan (Replatting is not required under the Dania Beach City Code).

access and egress from Northwest second Street and Northwest 1st Avenue is acceptable and complies with
