AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA
APPROVING THE REZONING OF PROPERTY GENERALLY LOCATED AT
THE NORTHEAST CORNER OF SW 25TH TERRACE AND SW 45TH
STREET, DANIA BEACH, FLORIDA, AND LEGALLY DESCRIBED IN
EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS ORDINANCE;
CHANGING THE CURRENT ZONING CLASSIFICATION OF THE
PROPERTY FROM RI-C (SINGLE FAMILY RESIDENTIAL), TO OS (OPEN
SPACE); SUBJECT TO CERTAIN RESTRICTIONS; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the City's Planning and Zoning Advisory Board, sitting as the local
planning agency, has reviewed this Ordinance and recommended its approval to the City
Commission; and
WHEREAS, the City Commission has considered this Ordinance at a duly noticed public
hearing according to law; and
WHEREAS, the City Commission finds that this Ordinance is necessary for the
preservation of the public health, safety and welfare of the City's residents;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH,FLORIDA:
Section 1. That the rezoning request filed by the City of Dania Beach, for property
generally located at the northeast corner of SW 25th Terrace and SW 45th Street, Dania Beach,
within the City of Dania Beach, Florida, is granted and the parcels are rezoned as described in
Exhibit"A", a copy of which is attached to this Ordinance.
Section 2. That if any section, clause, sentence or phrase of this Ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this Ordinance.

Section 3. That all ordinances or parts of ordinances in conflict with the provisions of
this Ordinance are repealed.
Section 4. That this Ordinance shall be effective immediately at adoption on second
reading.

SUBJECT: RZ-14-06: The City of Dania Beach is requesting a zoning
change from Single Family Residential (R-1C) to Open Space
(OS) on a five acre parcel located north of Slit! 45'" Street,
south of the Dania Cut-off Canal and east of SW 25 Terrace
(SECOND READING).
REZONING:
To change the property zoning from Single Family Residential (RAC) to Open
Space (OS).
On March 22, 2005 the City Commission approved the Future Land Use change from
Low(5) Residential to Recreation and Open Space.
Broward County purchased this land through the County Bond program and has
transferred title to the City of Dania Beach.
One of the County's conditions of the land transfer was to change the City's Future Land
Use Map to match county's land use designation of Recreation and Open Space, which
was done last year. The County is now requesting the City to change the zoning
designation to match the Future Land Use designation. The uses allowed is the Open
Space zoning district will ensure the land will remain a park.
CITY COMMISSION PREVIOUS ACTION
On March 28, 2006 the City Commission approved the requested rezoning on first
reading.
PLANNING AND ZONING BOARD RECOMMENDATION
On March 15, 2005 the Planning and Zoning Board recommended approval of the
requested rezoning.
