Consideration of the Abatement Request for Maresa S. Hudson—#03-5179—314 SE 4 Street
Summary Explanation & Background:
The defendant was originally cited on 9/05/03 for 3 violations and given 30 days to comply. She
did not comply and was heard by the code board on 4/05/04. The board issued a final order
giving the defendant 60 days to comply or a fine of$100.00 per day would be levied. The
compliance date was 6/21/04, however, Ms. Hudson came back before the code board on 7/6/04
and requested an extension of time. The board granted a 90 day extension and the new
compliance date was 9/19/04. The property was not brought into compliance until 2/24/05. The
fine ran from 9/19/04 to 2/24/05, 158 days @ $100.00/day = $15,800.00 plus$100.00 recording
fee =$15,900.00 owed. The fine was confirmed on 12/06/04.

This was originally heard by the code board on 4/05/04 for 3 violations. A final order
was issued giving the defendant 60 days to comply or a fine of $100.00 per day would
be levied. The compliance date was 6/21/04, however, the board heard a request for
extension on 7/06/04 and granted a 90 day extension. The new compliance date was
9/19/04 and the property was not brought into compliance until 2/24/05.
The code enforcement board, after hearing testimony on 5/09/05, decided by
unanimous vote to abate to $2,000.00 because of a financial hardship.

SUPPLEMENTAL ORDER OF THE DANIA BEACH CODE ENFORCEMENT BOARD
This proceeding came on for Formal Hearing on July 6, 2004, after notice. Upon
the evidence presented, the Board makes the following findings of fact:
a. The board has jurisdiction of the Defendant and the subject matter of this action;
and
b. At a Formal Hearing on April 5, 2004, the Code Enforcement Board determined
that Defendant, Maresa S. Hudson, did allow the following code violations to exist at
property Defendant owns located at 314 SE 4 Street, Dania Beach, which property is
legally described as: HOLLYWOOD CENTER AMEN PLAT 9-43 B LOT 19 E 12.58,
ALL OF LOT 22, W 3.42 OF LOT 23, ALL LESS S 7.50, BLK 8 (# 1203 17 0217) :
1. Chapter 13, Section 13-23; Public Nuisance Violation. Failure to cut weeds in
alley and trim trees as to allow for 8 feet clearance over sidewalk.

2. Florida Building Code 104, Permits Required. Failure to obtain permit for
canopy/awning installed without permit or remove all work.
3. Chapter 8, Buildings, Article II, Property Standards, Section 8-21(4)(f). Minimum
standards for dwellings, hotels and rooming houses. General requirements for all
dwellings, dwelling units, hotels, hotel units, rooming houses and rooming units. Failure
to repair or replace fence which is in disrepair.
Upon consideration thereof, the motion was made and carried. It is, thereupon
ORDERED:
1. Defendant, Maresa S. Hudson:
(a) has been found to be in violation of the above described code sections listed in
paragraphs b.(1) through b.(3). A fine of $100.00 per day was scheduled to begin
running 60 days from the date this order was signed by the Chairperson of the Board.
The original order was signed on April 22, 2004.
(b) At the Formal Hearing on July 6, 2004, the City of Dania Beach Code
Enforcement Board has granted Defendant's request for extension on imposition of the
fine until September 19, 2004.
(c) Except as expressly amended herein this board's order in this case signed April
22, 2004, shall remain in full force and effect.

SUPPLEMENTAL ORDER/ CLAIM OF LIEN
The City of Dania Beach Code Enforcement Board ("Board") 100 West
Dania Beach Boulevard, Dania Beach, Florida 33004, having received the
testimony and affidavit of Code Inspector, Cary Tullos, on the City's Motion to
Confirm Fine held on the 6th day of December, 2004, and based on the
evidence, the Board enters the following findings of fact and order:
1. That the Board did issue on the 5th day of April, 2004, a Final Order in the
above captioned case commanding the defendant, Maresa S. Hudson, to
bring the violations specified in said Final Order into compliance on or
before the 21st day of June, 2004 or pay a fine in the amount of$100.00
per day for each day of non compliance thereafter.

2. That the Board did issue on the 6th day of July, 2004 a Supplemental
Order granting Defendant's request for extension on the imposition of the
fine until September 19, 2004.
3. That said violations occurred on the following described real property
situate, lying and being in Broward County, Florida, to wit: HOLLYWOOD
CENTER AMEN PLAT 9-43 B LOT 19 E 12.58, ALL OF LOT 22, W 3.42
OF LOT 23, ALL LESS S 7.50, BLK 8 (# 1203 17 0217).
4. That the Defendant, Maresa S. Hudson, did not comply with the Final
Order or Supplemental Order on or before the date specified therein.
5. It is the order of this Board that the fine specified in said Final Order is
hereby confirmed and ratified and shall accrue at the per diem specified
until such time as the defendant, Maresa S. Hudson, shall comply with
said Final Order. Upon complying, the defendant shall notify the City's
Code Enforcement Department and an officer will inspect the property
and notify the Code Enforcement Board whether defendant has complied.
6. It is the order of this Board that the fine shall constitute a lien against the
above described real property and it shall be a lien against any other real
or personal property owned by defendant.

The City of Dania Beach shall have and recover from Defendant, Maresa S.
Hudson, for the foregoing violations listed in paragraphs b.(1) through b.(3), a fine of
$100.00 per day, to begin running 60 days from the date this order is signed by the
Chairperson of the Board.
The fine shall continue until said violations come into compliance with said
sections of the City Code upon requested inspection. Upon complying, the Defendant
must notify the City's Code Enforcement Department and an officer will inspect the
property and notify the Code Enforcement Board whether Defendant has complied. If
the Defendant does not notify the City's Code Enforcement Department, an officer will
not inspect the property and the fine will continue to be imposed each day until a code
officer is notified, inspects the property and determines the property to be in compliance
with this order. Said fine shall constitute a lien upon the real property and personal
property of the Defendant.
In the event this Final Order is recorded as a lien, a charge will be imposed to
record the Final Order and any lien satisfaction. O DERED at Dania Beach, Broward

Violation. Property declared a public nuisance and must be
placed into good condition. Trash, junk, loose garbage and
all other debris and/or materials stored on the property
must be removed. Trees, hedges, shrubs, weeds and grass,
including the public right of ways (swale areas) abutting
the property, front, sides and rear, must be mowed, cut,
and trimmed as required by city ordinance and property must

Code Inspector Cary Tullos, having been previously sworn in, came forward and
gave the following testimony. Notice was sent Certified Mail, service was
obtained; also sent via first class mail, property was posted, and Affidavit of
Service is on file. This is a violation of FBC 104, permit for handicap ramp. As of
today, the property is still in violation of FBC 104. Ms. Tullos submitted two
photos of the property. The first contact with the violator was 9/08/03. Chairman
Bettor asked if there was anyone representing Artistotelis Daglaris; no one came
forward. Chairman Bettor asked Mr. Koch if he had any comment on the case.
Building Official Ken Koch, having been previously sworn in, came forward to
reply that they had performed the work without a permit. Judy Jensen made a
motion, to adopt the findings of fact by Building Official Ken Koch, move to find
that the violation exists as charged, move that the violator be given 30 days to
comply or thereafter a fine of $50.00 per day shall be levied. The motion was
seconded by Judith Tulacro and carried on the following roll call:

Code Inspector Cary Tullos, having been previously sworn in, came forward and
gave the following testimony. Notice was sent Certified Mail, service was not
obtained; also sent via first class mail, property was posted, Affidavit of Service is
on file. This is a violation of Chapter 13, Section 13-23, all; FBC 104.1, permits;
Chapter 8, Article Il, Section 8-214F, property standards. As of today, the
property is still in violation of Chapter 13, FBC 104, and Chapter 8. The first
contact with the violator was 9/05/03. Chairman Bettor asked if there was anyone
representing Maresa Hudson; no one came forward. Board Clerk Gloria Brandes
asked Chairman Bettor how many photos were presented. Mr. Bettor replied 4
were submitted. Judy Jensen made a motion, to adopt the findings of fact by Code
Enforcement Officer Cary Tullos, move that the violations exists as charged,

certified letter. Ms. Yehuda also stated that the property taxes are escrowed for so
she never inquired as to where notices were being sent which is her negligence.
Gary Luedtke asked, what was the nature of the violation? Mr. Phaneuf stated
that it was a street violation, overgrowth over onto the sidewalk and street, the
tree branches were overgrowing and were under 8 feet and it was that way for
quite sometime and they were under the 8 feet every time he went out there. Gary
Luedtke asked if there is a death notice date that we can work back from when the
owner could not be notified. Ms. Yehuda stated that she can get that for the
board. Gary Luedtke asked why she couldn't get it now. Ms. Yehuda stated that
she has to request it from the family members of the deceased, because the
deceased and his wife were estranged at the time of his death, it is Merrill Cohn
and he died approximately 4 years ago. Ms. Yehuda stated that she believes that
his former wife still resides at that address and that she would never have
forwarded any notices. Ms. Yehuda stated that she understands that there were
administrative fees incurred and that she worked with Gary and if she knew that
there was a violation she would have jumped right on it, but she had no
knowledge that this existed and had to ask Gary where the violation was. Tim
McLeod made a motion to abate the fine to $1,000.00; the motion was
seconded by David Nuby. Mr. Johnson interjected and stated that there
needed to be a reason for the abatement. Attorney Ryan stated that the
reason was based upon the owner was deceased, notice was sent to the
deceased owner, routine landscaping services were being furnished and that
the property manager provided a new address to the property appraiser for

testimony on the history of the case. Ms. Tullos stated that the compliance date
was 6/21/04 and that Ms. Hudson is requesting an extension from that date.
Chairman Bettor asked if there was anyone representing Maresa Hudson. Maresa
Hudson, 314 SE 4th Street, Dania Beach, FL 33314 and John Arrigoni, 314 SE 41n,
came forward and were sworn in. Ms. Hudson stated that she needs an extension
to complete the work on the property because she wasn't in a position financially
to be able to repair the fencing around the property, and she also stated that she
has obtained all the necessary permits and also all the equipment, she requested a
60 day extension. Ms. Hudson stated that she will be removing the awning that
was pre-existing when she bought the property as well. Gary Luedtke made a

property is in violation Chapter 8, building needs painting; Chapter 13, weeds still
need to be cut and trash removed from property. Chairman Bettor asked if there
was anyone representing Gilbert Carlo. Gilbert Carlo, 4185 SW 48`h Court, Dania
Beach, 33314, came forward and was sworn in. Chairman Bettor asked Mr. Carlo
to identify the four photos of his property. Mr. Carlo identified the photos of his
property. Mr. Carlo provided testimony as to why the property had not been
brought into compliance in which he explained Mrs. Carlo being hospitalized and
going through 3 to 4 months of recovery and it was during that time he neglected
maintenance of the house. Mr. Carlo also stated that they didn't paint the house
due to the extension on the house split from the house and they wanted to
demolish it and have it rebuilt. Mr. Carlo asked for 30 days to come into

Code Inspector Cary Tullos, having been previously sworn in, came forward
and gave the following testimony. She stated that corrective action was to be
taken on or before 10/20/04 but reinspection of the property on 12/06/04
revealed that the corrective action had not been taken and that Chapter 8,
Building Article 6, Section 8-21 (4) (F), failure to repair or replace fence was
still in violation. An Affidavit of non-compliance is on the file. Chairman
Bettor asked if anyone was present representing Maresa S. Hudson. Maresa
Hudson, 314 SE 4th Street, came forward and was sworn in. Ms Hudson
confirmed that she had not replaced her fence because she has been unable to
work and asked for more time until January. Attorney Tim Ryan explained to
Ms Hudson that she had a lot of liability exposure with an open pool and
recommended that she puts up the fence as quickly as possible because the
fine continues to run. After she puts up a chain link fence she could go back
and ask for an abatement to reduce the fine. Jimmy Peterman made a
motion to confirm the fine and the motion was seconded by Tim McLeod.

This proceeding came on for Formal Hearing on May 6, 2002, after notice. Upon
the evidence presented, the Board makes the following findings of fact:
a. The board has jurisdiction of the defendants and the subject matter of this action;
and
b. Defendants, Joseph F. & Margaret Enjedi and Jovan & Radinka Solic, did allow
the following code violations to exist at property defendants own located at 1401/1403
S. E. 2 Avenue, Dania Beach, Florida, which property is legally described as: ST
JAMES PARK NORTH 3-33 B LOT 27 BLK 2 (# 1203 07 0390):

1. Chapter 14, Section 14-2; Junked and Abandoned Vehicles; Public Nuisance.
Failure to remove all unlicensed and inoperative vehicles from the property.
2. Chapter 28, Section 4.20; Zoning Use Regulations. Outside Storage of vehicles,
equipment, tires, auto parts and outside tire and auto repairs are not permitted uses in
an RD-6000, Residential District. Failure to correct outside storage of vehicles and
remove auto parts from the premises.
Defendants have previously been found to be in violation of Chapter 14, Section
14-2 Junked and Abandoned Vehices; Public Nuisance and Chapter 28, Section 4.20;
Zoning Use Regulations, by this Board within the past five years.
Upon consideration thereof, the motion was made and carried. It is, thereupon
ORDERED:
1. Defendants, Joseph F. & Margaret Enjedi and Jovan & Radinka Solic:
(a) have been found to be in violation of the above described code sections listed in
paragraphs b.(1) & b.(2) and a fine in the amount of$100.00 per day will begin running
March 22, 2002.
The City of Dania Beach shall have and recover from defendants, Joseph F. &
Margaret Enjedi and Jovan & Radinka Solic, for the foregoing violations listed in
paragraphs b.(1) & b.(2) a fine of$100.00 per day beginning March 22, 2002.
The fine shall continue until said violations come into compliance with said
sections of the City Code upon requested inspection. Upon complying, the defendants
shall notify the City's Code. Enforcement Department and an officer will inspect the
property and notify the Code Enforcement Board whether defendants have complied.
Said fine shall constitute a lien upon the real property in violation and upon any other
real or personal property of the defendants.
In the event this Final Order is recorded as a lien, a charge will be imposed to
record the Final Order and any lien satisfaction. ORDERED at Dania Beach, Broward

Code Inspector William Dubisky came forward having been previously sworn in. Mr.
Dubisky said service was not obtained by Certified Mail, however notice was sent
regular mail and the property was posted; the Affidavit of Service is on file. This is a
repeat order of Chapter 14, Section 14-2, abandoned and unlicensed vehicles, and
Chapter 28, Zoning, Section 4.20, auto repairs and storage of inoperative vehicles and
auto parts. As of today, the property is still in violation of Chapter 14, Section 14-2,
there is no evidence that either vehicle has been licensed, one has been placed under a
cover, and there is no front end on the vehicle; and of Chapter 28, Zoning, the autos
and auto parts are still on the property. Seven photos were given to the Board. Mr.
Dubisky said the violation started on 3/21/0� and has run through today, 5/6/02, and
will continue to be in violation until the vehicles are removed or properly licensed.
Joseph Enjedi, 1403 SE 2 Avenue, and Jovan Solic, 1401 SE 2 Avenue, came forward
and were sworn in. Attorney Ryan gave testimony about repeat violations. Mr. Enjedi
gave testimony about the violations and asked for time to comply. Mr. Enjedi
identified the photos as being of his property. Mr. Dubisky gave additional testimony
about the case. It was on motion of Gary Luedtke that notice has been properly
served, that the violations, Chapter 14 and Chapter 28, exist as charged being a
repeat, to give 30 days or a fine of$200.00 a day thereafter on both Chapter 14 and
Chapter 28, to begin 30 days from today. Mr. Luedtke clarified $200.00 if both
violations are not completed in 30 days. Mr. Johnson gave testimony about giving
additional time on a repeat order. Gary Luedtke amended his motion to take the
violation back to 3/22/02 and make it $100.00 a day. Tim McLeod seconded the
motion. Mr. McLeod said as long as it has been in violation and as long as it remains
in violation the fine is $100.00 a day. Beulah Lair informed Mr. Enjedi that he has
already had 30 days. Gary Luedtke clarified the motion to be a $100.00 a day fine
from 3/22 when that was. The motion carried on the following roll call:

grass on the property. As of today, the property is in compliance. The property was in
violation from 4/02/02 to 4/7/02, 6 days (he complied the property on 4/08). Mr.
Dubisky said on Thursday, March 28, he spoke directly to the tenant and told him to

the permit and they issued him the permit and that is when he started working on
the driveway as a family project that was during the time when the city switched
places. He said that he has every single thing that he needed to have on paper
except the piece of cardboard that got lost during the moving around. He did
apply for everything and the only difference is between the two is that one is
from the City of Fort Lauderdale and everything is the same. Mr. Funes said that
the same paperwork was approved with the same dimensions and everything in
the City of Dania. David Nuby asked if he has a permit with the City of Fort
Lauderdale. Mr. Funes said yes he has one they made him do it again because
they swapped cities from Fort Lauderdale to Dania and he said that is when he got
caught in this and he tried to explain to him that he already had the permit and he
faxed over the paperwork and he said the inspector said he doesn't care because
this is Dania now. Chairman Bettor stated that since it is up for discussion he
feels that Mr. Funes has tried to cooperate with the city and he believes that the
board told the defendant to come back for an abatement. Allison Funes, 5505 SW
44th Terrace, came forward and was sworn in. Mrs. Funes stated that the inspector
came to her house and knocked on the door and spoke to her mother-in-law who
didn't speak English at that time. She stated that at that time the inspector
decided to accuse them of something that was not true by saying they did not live
in the house and that they were renting out the house to someone else and they
have been living there since they bought the house on September 29, 1996 for the
last 8 years. She said that the inspector accused them without even checking
anything and then the second thing was the traile. Her husband moved the trailer
the next day and the third thing, all of the family with the 5 children did the
driveway together, and she says she has the pictures and the proof that they just
tried to make their house look beautiful. They needed the parking because they
have 5 kids so they needed more space to park the cars. Chief Code Inspector
William S. Johnson came forward and stated that it is his understanding that this
is an abatement. They are not here to retry the case and since this is an abatement
request, they are not going to present any evidence because the board already
decided in the case and all the evidence has been heard and the decision has been
made. If they want to appeal then they would have to go to the circuit court of
appeals to appeal this case. Chairman Bettor stated that he doesn't think that they
are appealing the case. Jimmy Peterman made a motion to abate the amount
to $5,000.00 based on the statement that was made from the family that they
didn't know that they should go to the City of Dania and they thought that
they had got a permit from Fort Lauderdale. Tim McLeod seconded the

Inspector William Dubisky having been previously sworn in, came forward and
made a statement. Mr. Dubisky stated that pursuant to the order corrective action
was to have been taken on or before 3/22/02 and a reinspection of the property on
3/10/02 revealed that the corrective action had been taken and the property was
complied as of that date. There is a total of $4,900.00 owed. Gary Luedtke
made a motion to confirm the fine. The motion was seconded by Jimmy
Peterman and carried on the following roll call:

Attorney Tim Ryan stated that this is one of those cases that after a citation is
issued, there is a final order and then there is a title search done to confirm the
fine. It was determined that there has been a change in ownership prior to the
entry of the final order and so it is recommended for dismissal. He said that they
will go out and if the property is still in violation then the new owner of record
will be cited. Gary Luedtke made a motion to dismiss the case. The motion

Inspector William Dubisky having been previously sworn in, came forward and
made the following statement. Mr. Dubisky stated that as of today the property is
still in violation of Chapter 13, vegetation remains overgrown; Chapter 8, Section
8-21 (4)(f), the fence has not been removed or replaced; Chapter 8, Section 8-21
(a)(5)(a) 1&2, the building remains unpainted; Chapter 8, Section 8-21(a)(5)(a)
(1), the deteriorated facia boards and soffit screens remain in a stated of disrepair
and Chapter 15, no occupational license has been obtained. The Chapter 28,
Zoning, for auto repairs and the Chapter 14, inoperative vehicles have complied
but he is requesting a finding of fact. Mr. Dubisky submitted 4 photos.
Chairman Bettor asked if there was anyone representing Tianna Chante
Copeland. No one came forward. Gary Luedtke made a motion that notice
was properly served, and to adopt the findings of fact of Officer Dubisky and
that the violators be given 40 days or a fine of$80.00 a day. The motion was

This was originally heard by the code board on 7/10/00 for 4 violations. A final order
was issued giving the defendants 30 days to comply or a fine of $250.00 per day would
be levied. The compliance date was 09/01/00 and the property was not brought into
compliance until 6/23/04.
The code enforcement board, after hearing testimony on 5/09/05, decided by
unanimous vote to abate to $1,500.00 because there were two different cases and the
new owner is making improvements to the property.

This proceeding came on for Formal Hearing on September 11, 2000, after
notice. Upon the evidence presented, the Board makes the following findings of fact:
a. The board has jurisdiction of the defendants and the subject matter of this action;
and
b. Defendants, Myriame Denoi and Jonas Denoi, did allow the following code

1. Dania City Code Section 8-21(a)(4)a. General requirements: roofs shall be
watertight. Failure to remove and replace loose or damaged tiles, replace missing tiles
and remove debris or replace roof. If roof is replaced, a permit will be required.
Upon consideration thereof, the motion was made and carried. It is, thereupon
ORDERED:
1. Defendants, Myriame Denoi and Jonas Denoi:
(a) have been found to be in violation of the above described code section listed in
paragraph b.(1). A fine of $100.00 per day will be imposed 60 days from the date this
order is signed by the Chairperson of the Board.
The City of Dania Beach shall have and recover from defendants, Myriame
Denoi and Jonas Denoi, for the foregoing violation listed in paragraph b.(1), a fine of
$100.00 per day, to be imposed 60 days from the date this order is signed by the
Chairperson of the Board.
The fine shall continue until said violation comes into compliance with said
section of the City Code upon requested inspection. Upon complying, the defendants
shall notify the City's Code Enforcement Department and an officer will inspect the
property and notify the Code Enforcement Board whether defendants have complied.
Said fine shall constitute a lien upon the real property and personal property of the
defendants.
In the event this Final Order is recorded as a lien, a charge will be imposed to
record the Final Order and any lien satisfaction. ORDERED at Dania Beach, Broward
County, Florida, this 11th day of September, 2000.

testimony and affidavit of Building Official, Kenneth Koch, on the City's Motion to
Confirm Fine held on the 2nd day of April, 2001, and based on the evidence, the
Board enters the following findings of fact and order:
1. That the Board did issue on the 3rd day of October, 2000, a Final Order in

comply with said Final Order. Upon complying, the defendants shall notify

Mr. Menendez asked for at least 30 days. Ms. Jensen stated he was given 45
days. Mr. Menendez then stated he wanted 90 days, Insp. Dubisky asked if
the motion included removing the fence. Ms. Jensen stated it included
replacing or removing the fence. Richard Bettor clarified he has 45 days from
the date the order is signed. Attorney Ryan stated when he paints the house
and removed the fence, Mr. Menendez needs to call the City to inspect it, that
the days start when the order gets signed, and the order takes 10-15 days to
get signed. Mr. Menendez read his address to the Board as 5615 SW 112 Ct.,
Miami, FL 33173.

4624 SW 28 Ave.

Frank Osorio came forward, having been previously sworn in, and had the
following testimony. The violations are located at 4624 SW 28 Avenue. It is a
violation of Chapter 28, Article 26, Repair and Maintenance of Vessels not
permitted in a single family zoned district, Chapter 28, unlicensed boat, and
Chapter 13, trash and junk pertaining to the boat. The violations were
confirmed on 5/26/00 and the letter was sent on 6/30/00; it failed inspection in
July. Service was not obtained by Certified Mail however, it was sent first
class mailing. Insp. Osorio stated he had a conversation with the occupant of
the house, he is not sure whether that was the owner. The occupant stated he
would correct the violations in May. He presented photos to the Board. The
boat is on private property in the rear of the house, but is the size of the
house. Donald Denis was sworn in and had the following testimony. He
assumed the boat was not a problem because it was behind the house and
his neighbors did not complain. He stated he was removing the boards to
replace the frame and is almost done and any trash from the boat is ready for
bulk trash pick up. He stated he needs 30 days to get the boat out of the yard.
He identified the pictures as those of the property. It was on motion of Pat
Flury, seconded by Judy Jensen, to adopt the findings of fact by Code
Enforcement Officer Frank Osorio, move to find the violation exists as
charged, move the violator be given 30 days to comply, thereafter a fine of
$50.00 per day be levied. The motion carried on the following roll call:

William Johnson, having been previously sworn in, came forward to present
the case. He had the following testimony. The violation is located at 1203 SW
3 Avenue. Service was obtained by posting the property, the Affidavit of
City of Dania Beach Code Enforcement Board 10 September 11,2000
Service is on file, from a first class letter, the Affidavit for that is on file, and
from the Certified Letter as we received the green card back. They were first
notified of the violation on 5/12/00. The Building Official Ken Koch came
forward, having been previously sworn in, and had the following testimony.
He gave one photo to the Board. This is a tile roof and the tiles have become
loose; some of the tiles are missing because they are loose and cracked.
There is also debris on the roof, which is the cracked tiles. This does not meet
the criteria of keeping the roof clean, neat, and watertight. The tile roof needs
to be repaired or replaced, not necessarily with another tile roof, but with a
new roofing system installed on it. Notice was first sent on 4/12/00; as of
today, there has been no activity and there is no permit issued for repair or
replacement of the roof system. Jonas Denoi was sworn in and had the
following testimony. He identified the picture as of his property. He has been
fixing the roof when it leaks himself. He is trying to get a loan to replace the
roof, not exactly a tile roof, but a new roof because the house is 20 years old.
The roof is ok, he could just replace the tile and paint it, but it is going to cost
$2,000 - $3,000. A new roof will cost between $5,000 - $6,000; he is trying to
get a loan to replace the roof. He has not been able to get it. He does not
know when he is going to get a loan to replace the roof; his only option is to
fix what he has and to paint it. He would rather not do it because he feels it is
a waste of money, but he has no other choice right now. He stated his big
mistake was not telling the City what he was planning to do. He can replace
the tiles and make it secure; he can get rid of the loose tiles and replace the
missing tiles. He does not want to paint it now; he has the paint, but does not
want to waste the paint on this roof as he wants to get a new roof in a few
months. Richard Bettor asked if the roof can be pressure cleaned and brought
into compliance without being painted; Building Official Koch responded no.
Mr. Koch stated the issue is not the painting, the issue is the loose tiles laying
on the roof and the missing tiles. He stated the trash and debris need to be
removed and the missing tiles need to be replaced, and paint just the raw
tiles. Mr. Denoi stated the tiles were already white; Mr. Koch stated then it
was not a problem and was a temporary fix. It was on motion of Jimmy
Peterman, seconded by Judy Jensen, to adopt the findings of fact by Building
Official Ken Koch, move to find the violation exists as charged, move the

and presented the following testimony. This case came before the Board on
09/11/00, compliance date was 12/02/00 but the defendant did not comply until
12/09/03. The fine ran for 1102 days @ a $100 per day plus $100 recording fee
which equals $110,300.00 owed. This fine was confirmed on 04/02/2001. The
new owner made an inspection request on 12/09/2003 and at that time the
property was complied. Chairman Bettor asked if there was anyone present
representing Myriame and Jonas Denoi. Jason Dubow Esq. came forward and
said that he was representing the new owner, Frank Belle. He stated that Mr.
Belle is a life long resident of Dania Beach and lived next door to this property.
Mr. Dubow presented pictures which showed that the previous owners let the
property go into serious disrepair and moved to New York. The property became
inhabited by drug traffickers and users. After living next to this property for two

The code enforcement board, after hearing testimony on 2/07/05, decided by
unanimous vote to recommend abating the lien to $1,500.00 because it is a good thing

maintain weeds and grass.
Upon consideration thereof, the motion was made and carried. It is, thereupon
ORDERED:
1. Defendants, Myriame Denoi and Jonas Denoi :
(a) have been found to be in violation of the above described code sections listed in
paragraphs b.(1) through b.(4). A fine of $250.00 per day will be imposed 30 days
from the date this order is signed by the Chairperson of the Board.
The City of Dania Beach shall have and recover from defendants, Myriame
Denoi and Jonas Denoi, for the foregoing violations listed in paragraphs b.(1) through
b.(4), a fine of $250.00 per day, to be imposed 30 days from the date this order is
signed by the Chairperson of the Board.
The fine shall continue until said violations come into compliance with said
sections of the City Code upon requested inspection. Upon complying, the defendants
shall notify the City's Code Enforcement Department and an officer will inspect the
property and notify the Code Enforcement Board whether defendants have complied.

William Dubisky, having been previously sworn in, had the following
testimony. The property is located at 334-336 SW 16 Street. It is a
violation of Chapter 8, Article 2, Section 8-21, Minimum Standards,
missing roof tiles on the roof that must be replaced. As of today the
property is still in violation, the roof tiles have not been replaced.
Service was not obtained by Certified Mail; notice was also sent via
first class mail and the property was posted, the Affidavit of Service is
on file. One photo was given to the Board. It was on motion of Jimmy
Peterman, seconded by Beulah Lair, to adopt the findings of fact by
Code Inspector William Dubisky, move to find the violation exits as
charged, move the violator be given 30 days to comply or a fine of
$100.00 per day. There being no further discussion, the motion carried

William Dubisky, having been previously sworn in, had the following
testimony. The property is located at 324 SW 13 Street. There is a
violation of Chapter 8, Article 2, Section 8-21, Minimum Standards,
fence must be replaced or removed. There is also a violation of
Chapter 13, Section 13-23, Public Nuisance, weeds and grass must be
cut and trash must be removed from the property. There is also a
violation of Chapter 14, Section 14-2, Abandoned Vehicles. As of
today the Chapter 14 violation has been complied, but is still is in
violation of Chapter 8, the fence still requires replacement in certain
areas and the Chapter 13, miscellaneous trash and debris is still on
the property. Service was obtained by Certified Mail; notice was also
sent via first class mail and the property was posted, the Affidavit of
Service is on file. Three photos were given to the Board. It was on

Inspector William Dubisky, having been previously sworn in, had the following
testimony. Mr. Dubisky stated the violations are located at 324 SW 13 Street.
A reinspection of the property today revealed that the corrective actions had
not been taken in that the fence has not been replaced, there is still trash and
miscellaneous debris on the property, and an unlicensed vehicle is in the rear
yard. The affidavit of noncompliance is in the file. It was on motion of Tim
McLeod, seconded by Judy Jensen, to confirm the fine. Pat Flury asked if the
owners were aware of this. Inspector Dubisky stated he spoke to the owners
on several occasions and was on the property the night of the Code Board
meeting. The motion carried on the following roll call:

replaced, the brick wall has not been removed, and the grass and weeds have

been taken in that the trash and debris remains in the backyard, and the trees
and hedges have not been trimmed at the alley. The Affidavit of
